o Big Name Web Publishers Sue Pop-Up Ad Software Firm Gator

Redwood City, Calif. -- A group of major Web publishers including The New
York Times Company, The Washington Post, Dow Jones and several others have
sued online advertising firm Gator for copyright and trademark
infringement, over the company's ad technology that can serve pop-up ads
on top of existing ads on their news websites. "Gator sells advertising
space on the plaintiffs' Web sites without authorization and pockets the
profits from such sales," the publishers say in their suit, filed in
federal court in Virginia. Redwood City, Calif.-based Gator's ad-serving
technology is often downloaded along with file-sharing programs, and can
monitor users' surfing habits and serve them targeted ads for competitors'
sites, such as a discount on goods at Amazon.com while they are shopping
at BarnesandNoble.com. Gator defended its technology and said it may file
a countersuit against the publishers. "We're highly confident that the
allegations made by the plaintiffs are utterly baseless," said Gator CEO
Jeff McFadden. Gator, which has been entangled in separate litigation with
the Interactive Advertising Bureau and others over its technology, argues
that the publishers' contention that any software that pops up while
viewing their sites is stealing ad revenue from them "flies in the face of
the very nature of the Windows operating system. This flawed logic would
suggest that any software application that automatically displays
information in a separate window -- from ad-supported products like AOL
Instant Messenger and Yahoo! Messenger, to standard applications like
Microsoft Outlook and Norton Anti-Virus -- would be illegal," McFadden
said. The publishers are seeking an injunction against Gator's pop-up ads
and damages from any revenue made from pop-ups delivered to visitors to
their news sites.

o CNET Networks Lays Off 10% of Staff

San Francisco -- CNET Networks, operator of the News.com technology news
site and other information technology resources such as Download.com,
announced that it will lay off 10 percent of its staff -- or 190 employees
-- as part of cost-cutting plan aimed at achieving profitability for the
second half of 2002. CNET will also focus its business on six key areas:
business technology, commerce, downloads, gaming, international and
channel. The company expects to see realignment expenses, including
severance for laid off employees, of between $7 million and $8 million.
San Francisco-based CNET Networks also revised its earnings estimates
downward from between $58 million and $63 million to between $57 million
and $58 million.

o Australia to Allow Public CD-Copying Kiosks With Royalty Fee

Adelaide, Australia -- An Australian company has received authorization
from the Australian Mechanical Copyright Owners Society (AMCOS) to begin
installing CD copying kiosks in public places, where part of the fee
consumers would pay to burn a CD would include a royalty payment to
copyright holders. Beginning in September, Adelaide-based Little Ripper CD
Burner Pty. may begin installing kiosks in convenience stores and other
places, which charge consumers $5 Australian (about $2.85) to burn a
personal copy of any CD. Australia's Herald Sun paper reports that in
addition to the 6 percent royalty offered to AMCOS, Little Ripper has also
approached the Australian Record Industry Association (ARIA), concerning
potential royalty payments to record labels. "An approach has been made
and it will be considered," ARIA's Michael Speck told Wired News.
"However, I can see some significant difficulties in anyone in the process
adequately, fairly or justly compensating the copyright owners." The use
of such copying devices in public places would mirror how copyrights with
regard to photocopying machines are viewed in the U.S. The responsibility
to adhere to copyright law is essentially left to the person making
copies, instead of falling on the machine's manufacturer or place of
business where the machine is located.

o Altnet Creator Brilliant Digital Faces Stock Delisting

Los Angeles -- Brilliant Digital, a provider of online advertising
software and operator of Altnet, a secure file-sharing service, said this
week that its shares are in danger of being delisted from the American
Stock Exchange. Los Angeles-based Brilliant Digital formed a deal with
Sharman Networks, which operates the Kazaa file-sharing service, to offer
a separate peer-to-peer network to Kazaa users called Altnet. The service
offers licensed downloads of media from content providers, rather than
Kazaa's selection of unauthorized copyrighted material. Brilliant Digital
said that the American Stock Exchange has several concerns, including the
fact that "[the company's] financial condition has become so impaired that
it appears questionable, in the opinion of the Exchange, as to whether it
will be able to continue operations and/or meet its obligations as they
mature." The company said that it has been granted an extension of its
listing by the exchange as it executes a plan to try to regain the status
necessary for continued listing.

(Pasadena, Calif.) Search engine services provider Overture said it has
signed a short-term extension of an agreement with Microsoft to provide
search results for the MSN search pane. Pasadena-based Overture has
recently lost contracts to provide search results to AOL and EarthLink to
rival provider Google. Separately, Overture announced that it will offer
its pay-for-performance search listings in the Japanese and French markets
in the coming months. The company announced distribution deals with
NTT-owned Goo and Lycos Japan, as well as AOL France and Tiscali France.

(Irvine, Calif.) GameSpy, a provider of online gaming software and
services as well as video game news, said that its main gaming software,
GameSpy Arcade, was briefly infected with the Nimda computer virus twice
this week during maintenance, Reuters reported. The company said that
3,100 people downloaded the infected software from GameSpy, but that it
had received no complaints of damage to users' systems. "This registers
with us as a serious, serious error," GameSpy CEO Mark Surfas told
Reuters. "We're pretty upset about it. This is not cool."

(Dallas) DG Systems, a provider of satellite and Internet content delivery
technology for advertisers and broadcasters, said on Friday that it has
settled a patent dispute between Motorola and its Musicam USA unit,
resulting in Motorola's licensing of Musicam's MPEG digital audio
compression technology. Dallas-based DG Systems also announced its
StarGuide Digital Networks division has been granted two new patents, for
its satellite streaming system and Internet Protocol satellite receiver
technologies.

(Cincinnati) Interactive games firm GameBanc announced on Friday that it
has become a public company through an acquisition of 52.6 percent of its
stock by publicly-traded Colley Corporation. GameBanc, which does business
as The Lottery Channel and operates lottery, online games and digital
greetings sites including Lottery.com, Gameland.com, Cards.com and
SkillMoney.com, claims a total of 12 million combined subscribers.
Cincinnati-based Colley Corp. said it plans to change its name to Games,
Inc.

(San Francisco) Wired News on Friday reported on a raid of Swedish game
developer MindArk's offices, where government officials looked for and
found 600 pieces of unlicensed software. The raid was launched after a
complaint from Microsoft and industry trade group the Business Software
Alliance. MindArk said in a statement that Microsoft prompted the raid in
response to the popularity of MindArk's online roleplaying game "Project
Entropia," which competes with Microsoft's own "Asheron's Call." In a new
twist for online gaming, players in MindArk's game accrue items and
advance in the game using real-world money instead of the "virtual
currencies" used in other online games.
