o Apple Adds Podcast Support, Updates iPods With Color Screens

Cupertino, Calif. -- Apple on Tuesday introduced a new version of its iTunes music player software, which for the first time incorporates podcasting, an audio format whose name was coined for its ability to be automatically downloaded to Apple's iPod portable player. Apple's iTunes 4.9 lets users subscribe to over 3,000 free podcasts, from providers including ABC, Adam Curry, the BBC, Clear Channel, Disney and NPR. The release also includes a software update for iPods, which will now include a "Podcast" menu, as well as the ability to bookmark podcasts and display color podcast artwork. The company also announced that all future iPods will come with a color screen, and shrank its iPod offering to a 20GB ($299) and 60GB ($399) model, while also lowering the price of its 1GB iPod Shuffle to $129. Apple said that it has sold over 15 million iPods, as of March 31, while its iTunes Music Stores have now sold a combined 430 million songs worldwide.

o Sharman Networks: Grokster Ruling Will "Vindicate" the Company

Sydney -- Following yesterday's Supreme Court ruling that found file-sharing software providers like Grokster and StreamCast Networks can be sued for copyright infringement, fellow file-sharing company Sharman Networks released a statement saying the decision will ultimately vindicate the company from copyright infringement charges. "While the Supreme Court apparently found 'substantial evidence... on all elements of inducement' by other P2P providers Grokster and Morpheus, Sharman has never encouraged or assisted users of Kazaa software to share copyrighted material in violation of copyright law," said Sharman Networks executive vice president Alan Morris, who also pointed to the Kazaa end user license agreement -- which directs users to respect national copyright laws -- and its alliance with licensed peer-to-peer distributor Altnet. "We believe that further legal review of this case will also show that Sharman was diligent and aggressive in its lawful efforts to distribute copyrighted music and movies through peer-to-peer distribution, and was thwarted in its efforts to do so by the music and motion picture industries," said Morris. Sharman is currently awaiting a verdict in the copyright infringement and other actions brought against the company in Australia by the recording industry.

o Disney, Dolby Labs to Equip 100 Theaters With Digital Projectors

Burbank, Calif. -- The Walt Disney Studios announced that it has partnered with Dolby Laboratories, to install Dolby digital cinema projection systems in 100 theaters in 25 top U.S. markets. The installations will be done in part to promote Disney Digital 3D -- a new 3D format developed by effects firm Industrial Light & Magic -- that Disney is using for the release of its "Chicken Little" animated feature, due in theaters on Nov. 4. "We are pleased that Chicken Little is the first animated movie to use our new process using Disney's actual 3D models, animation, and camera data," said ILM president Chrissie England. "This process allows us to provide a richer, more nuanced viewing experience for moviegoers than any existing postproduction techniques."

o Google Launches Video Search Service

Mountain View, Calif. -- Google has launched a new video search service, which lets users search closed-captioned texts and view indexed video on a Google-branded video viewer. The service includes video provided by CNN, PBS, Unicef, Greenpeace and CNET Networks, among others. For now, the service is free to use and does not display advertisements, although Google aims to eventually offer hosting of independently produced video and allow producers to charge viewers, taking a cut for itself.

o U.K. Telco BT to Trial Microsoft's IPTV Software

Redmond, Wash. -- Microsoft announced on Tuesday that U.K. telecommunications giant BT will use its Microsoft TV IPTV software to deliver TV over broadband to its subscribers. BT will trial Microsoft's IPTV software in early 2006, with plans to launch a commercial service next summer for its 20 million consumer and business customers. The announcement comes a week after Australia's largest telecommunications provider, Telstra, decided not to advance its lab trials with Microsoft IPTV software into its customers' homes. Microsoft is also testing its IPTV software in the U.S. with providers including SBC, which recently signed a ten-year, $400 million deal to use the software.

o Fox Developing Film Version of "Max Payne" Video Game

Los Angeles -- Film studio Twentieth Century Fox is working on a film version of developer Remedy and publisher Take-Two Interactive's "Max Payne" video game franchise, according to The Hollywood Reporter. Collision Entertainment's Scott Faye will co-produce the film, along with Julie Yorn and Firm Films, who so far have not attached a director or any actors to the project. "I think this is a real actor's part because although the story will have action and intrigue, at its core it's a story about a man who loses everything in life that's dear to him," Faye told THR.

o Bob Dylan to Release Album Exclusively Through Starbucks

Seattle -- Legendary folk singer Bob Dylan will exclusively distribute a new live album in Starbucks cafes, label Sony BMG announced on Tuesday. "Bob Dylan: Live at the Gaslight 1962" will for 18 months only be available for purchase at Starbucks stores in the U.S. and Canada, as well as on the Starbucks website. The album goes on sale on August 30, alongside a two-CD soundtrack album for director Martin Scorsese's new feature-length film biography, "No Direction Home: Bob Dylan." The Starbucks deal with Dylan and Sony BMG follows the successful Starbucks-exclusive release of a Ray Charles album that went on to win a Grammy.

(Philadelphia) Comcast, the nation's largest cable TV operator, announced on Tuesday that it has signed an agreement with cable TV movie network Starz Entertainment Group, to offer more than 1,500 movies titles a year from the Starz library through video-on-demand. The agreement also includes the launch of two new premium Starz movie channels on Comcast systems. Comcast said its subscribers watched more than 100 million on-demand programs during May 2005, up from 20 million in January 2004.

(Old Lyme, Conn.) USA Video Technology Corporation (USVO) announced on Tuesday that it is appealing its loss in a patent infringement case it filed against Movielink, an Internet video-on-demand joint venture between a number of Hollywood studios. USVO sued Movielink in April 2003 for violating its patents that cover online delivery of movies. A U.S. District Court in Delaware granted Movielink's motion for summary judgment of non-infringement of USVO's patents; USVO has now appealed that ruling to the U.S. Court of Appeals for the Federal Circuit.

(Mountain View, Calif.) Google on Tuesday announced the launch of Google Earth, a free downloadable software program that lets users view 3D satellite images acquired through Google's purchase of Keyhole. The application lets users search for specific locations on Google, and navigate 3D maps showing businesses and other buildings using streaming video. A $20 premium version of Google Earth adds GPS compatibility and the ability to import data, while a $400 commercial version offers high-resolution printing and the ability to import GIS data.

(London) Ofcom, the U.K. telecommunications watchdog, has advocated a market-led approach to radio spectrum management, as opposed to the previous regime, under which Ofcom decided the type of organization that should have access to specific parts of the spectrum and how they should be used. In the conclusion of its Spectrum Framework Review published on Tuesday, Ofcom said that its proposals enjoyed broad support among stakeholders. Besides allowing the market to decide the best use and user for much of the spectrum (about 70%), the Review will also allow license holders to trade spectrum in an open market and change the use they make of it in order to develop new technologies and offer innovative services, Ofcom said.

(Washington) XM Satellite Radio announced that it has signed a multi-year deal to provide its satellite radio service free of charge to guestrooms at Hyatt hotels nationwide. Starting this fall, the companies will begin deploying the service -- which features more than 150 channels of commercial-free music, sports, news, talk and entertainment on custom tabletop radios -- to more than 50,000 Hyatt guest rooms. Members of Hyatt's frequent guest program also will receive special XM hardware offers.

(New York) Sirius Satellite Radio, a provider of subscription radio programming, announced on Tuesday that it has signed a multi-year agreement with MultiCultural Radio Broadcasting to launch Chinese- and Korean-language channels on Sirius. Interscope Records recording artists Nine Inch Nails on Tuesday launched a promotion with Sony Media Software, allowing fans to create their own remixes of the song "Only" using Sony's ACID music editing software. Fans are then encouraged to upload their remixes to the Nine Inch Nails site on MySpace.com, where other fans can vote for their favorites. The release follows a similar promotion that saw the band's song "The Hand that Feeds" released in Apple's GarageBand format, another remixable audio file format.

(Santa Monica, Calif.) Video game publisher Activision on Tuesday shipped its "Fantastic 4" title for PlayStation 2, Xbox, GameCube, Game Boy Advance and the PC to retailers. The game is based on the upcoming Twentieth Century Fox film of the same name, which itself is based on the Marvel comic book franchise. The game's storyline was co-written by "X2" co-writer Zak Penn, and features actors from the film including Jessica Alba, Michael Chiklis, Chris Evans, Ioan Gruffudd and Julian McMahon. Los Angeles-based Seven Studios developed the console versions of the game, while Beenox created the PC version and Torus Games developed the title for Game Boy Advance.

(Los Angeles) News outlets including Wired News, The Los Angeles Times, The New York Times, Salon.com and CNET News.com on Tuesday provided analysis of yesterday's landmark Supreme Court decision in MGM v. Grokster, which found that file-sharing software providers can be held liable for copyright infringement committed by users of their software. "This really has given a tremendous amount of leverage to content owners to dictate the kind of technology that consumers will have available to them," Jason Schultz, an attorney with the Electronic Frontier Foundation, which represented Grokster, told Wired News. U.S. Atty. General Alberto Gonzales hailed the ruling, which he said "determined that those who intentionally induce or encourage the theft of copyrighted music, movies, software or other protected works may be held liable for their actions."
