o ACTV Appeals Interactive TV Patent Infringement Suit Lost to Disney

New York -- ACTV, a developer of enhanced TV programming technology,
announced on Wednesday that it has filed an appeal with the United States
Court of Appeals for the Federal Circuit, in its patent infringement claim
against The Walt Disney Co. and subsidiaries ABC and ESPN. New York-based
ACTV alleged in its original suit that ABC and ESPN infringed on three
ACTV patents for enhanced TV programming. The United States District Court
for the Southern District of New York previously granted summary judgment
in favor of Disney. "We believe an appeal is both a necessary and
appropriate course of action, and one that is consistent with our
determination to vigorously protect all of our intellectual property,"
said ACTV chairman and CEO David Reese.

o Singer Alanis Morissette Sues Alleged Cybersquatter

Los Angeles -- Pop singer Alanis Morissette has filed suit in Los Angeles
federal court, alleging the owner of the website Alanis.net is
"cybersquatting," or that he simply bought the domain name in the hopes of
using it for financial gain at the expense of the celebrity or business
trademark it mentions by name. The suit seeks the relinquishment of
Alanis.net to Morissette. Russel Smith, owner of Alanis.net and other
sites including Consumer.net, said in a statement that Alanis.net has been
online for three years and has never contained any information about
Morissette or anything related to her. "That is the way the game is played
... intimidation, threats and lies. Most of these lawyers are so used to
doing business this way they don't know how to operate in a legitimate
manner," Smith wrote in a note on the site. "Alanis Morissette is not only
an annoying singer, she Cyber Pirate [sic]. But, hey, what do I care as I
am a Fiona Apple fan anyway." Smith said he plans through his Consumer.net
business to sue Morissette for $10,000 in damages for "orchestrating the
scheme," as well as for mail fraud and "unethical practices."

o Game Developer 3DO Gets New $15 Million Line of Credit

Redwood City, Calif. -- Game developer 3DO announced on Wednesday that it
has arranged a new $15 million line of credit through GE Capital
Commercial Services. The credit line agreement requires the company to
raise an additional $4.6 million by October 1, 2002, which CEO Trip
Hawkins has said he will personally provide, if necessary. Redwood City,
Calif.-based 3DO develops video games for the PC, Internet and major video
game consoles. "This agreement represents an important step for increased
liquidity to meet our upcoming seasonal financing needs," said
Hawkins. "Our financing goals are to strengthen our balance sheet, reduce
our risks as a going concern, and put ourselves in position to deliver on
our growth and profit plans for next year."

(Los Angeles) Game developer Infogrames announced on Wednesday that it has
signed an agreement with C-2 Pictures and Intermedia to develop and
distribute titles based on the upcoming film, "Terminator 3: Rise of the
Machines." The company also secured the exclusive first option for
interactive rights to any Terminator 4 film. Infogrames said it will
release titles based on Terminator 3 for PC and all video game consoles in
the summer of 2003, coinciding with the film's release. It is also
currently developing "Terminator: Dawn of Fate," based on the original
"Terminator" movie, for Sony PlayStation 2 and Microsoft Xbox.

(Munich) A group of developers knows as The Xbox Linux Project announced
this week that an anonymous donor has given $200,000 in reward money for
programmers able to legally configure Microsoft's Xbox video game console
to run the Linux operating system. The sum will be divided as follows:
$100,000 to those able to get Linux to run on a hardware-modified Xbox,
with the second $100,000 going to those who develop a CD-ROM that will
boot the Linux system on the Xbox without any need for hardware
modification.

(Washington) The U.S. Army will launch two video games it has developed on
Thursday, in an attempt to increase interest and recruiting through a
medium popular with young men. Available at the "America's Army" website
tomorrow will be "Operations," a 3D multiplayer title, and "Soldiers,"
where players create a virtual soldier and "simulate the life of a U.S.
Army soldier from recruit to Sergeant." The games will be available for
free online and will also eventually be distributed on CD-ROM at
recruiting stations and other locations.

(San Francisco) CNET News.com on Wednesday reported on "Streamer," a
"pirate" Internet radio software program that masks the location of any
webcaster in an attempt to avoid paying royalty payments to copyright
holders. Written by 39-year-old British game developer Iain McLeod,
Streamer works by distributing a stream through many individual users --
making it much more difficult to determine the stream's origin. "I've
always been a fan of pirate radio and dislike badly used authority,"
McLeod told News.com.

(New York) The Wall Street Journal reported on Wednesday on talk among
record industry executives about suing individual users of file-sharing
services, in an effort to deter others from sharing unauthorized
copyrighted songs. Thus far, the Recording Industry Association of America
(RIAA) and its member labels have only sued software creators, such as
Napster, StreamCast Networks (Morpheus) and Audiogalaxy, and not the
individual users of the software. Any litigation, which is only in the
"planning stages" according to "people with knowledge of the matter," The
Journal reported, would only target users supplying the largest quantities
of songs or those operating "supernodes," which many file-sharing services
enable users to set-up on their own computers to act as centralized
directories of available files.
