o EarthLink Launches Digital Music Subscription Service With FullAudio

Atlanta -- Internet access provider EarthLink announced on Monday the
launch of a digital music subscription service with technology partner
FullAudio. The service offers subscribers access to 75,000 tracks of
major-label music from BMG, EMI Recorded Music, Warner Music Group and
Universal Music Group. Users may download up to 50 tracks each month for a
$9.95 monthly fee or up to 100 tracks each month for a $17.95 monthly fee;
the songs may be listened to when not connected to the Internet, but may
not be transferred to portable players or burned onto CD. Also, songs
become unavailable once a member's subscription lapses. The service
features a branded EarthLink Digital Music Player that uses Microsoft's
media player and digital rights management technologies. FullAudio also
provides a branded subscription service to radio station owner Clear
Channel.

o Danish Court Outlaws Widespread Practice of "Deep-Linking" to Websites

Copenhagen, Denmark -- A Danish court has ruled that a news search service
may not provide links to pages deep within the websites of a number of
Danish newspapers, in a ruling that contradicts a practice used widely on
the Internet today, the Associated Press reported. The court ruled that
Newsbooster.com was damaging the newspapers' advertising value by linking
to specific articles, rather than to their homepages. The same practice of
"deep-linking" is used by search engines and many other online services,
and is regarded as a key function of the World Wide Web. As a result of
the ruling, Newsbooster.com, which locates articles from newspapers' and
other publications' websites based on keywords entered by users, has
removed links to 20 Danish newspapers. Newsbooster.com manager Anders
Lautrup told the Associated Press he has not received complaints from any
other of the over 4,000 sites that Newsbooster.com links to, and will
appeal the Dutch court ruling.

o 2600 Decides Against Supreme Court Appeal in DVD-Cracking Case

San Francisco -- Online and print magazine 2600 will not appeal its case
over linking to code that can crack the encryption security on DVD discs
to the U.S. Supreme Court, according to the Electronic Frontier Foundation
(EFF), a digital civil liberties group handling the publication's defense.
Eight movie studios sued 2600 in December 1999, arguing that the
magazine's publishing and linking to the controversial DeCSS code
constituted a violation of the Digital Millennium Copyright Act (DMCA),
which deems it a crime to circumvent the copyright controls on a digital
device. A federal judge sided with the studios, as did an appellate
ruling; 2600's next step would have been an appeal to the Supreme Court.
"Later cases will provide a better foundation for the Supreme Court to act
on the problems created by the Digital Millennium Copyright Act (DMCA),"
said EFF legal director Cindy Cohn.

o Set-Top Box Maker Scientific-Atlanta Cuts 1,300 Jobs From Mexico Plant

Atlanta -- Scientific-Atlanta, a manufacturer of digital set-top boxes,
has eliminated about 1,300 jobs at its Juarez, Mexico plant. The company
said that it no longer needs the third shift that the jobs represented to
satisfy demand. Scientific-Atlanta said on Wednesday that it is also
"evaluating the need for any additional restructuring in other parts of
the company due to reduced demand."

o Report: Wireless Gaming Expected to Generate $9.34 Billion in 2008

San Jose, Calif. -- Revenues generated from wireless gaming in 2001 were
$436.4 million, and are expected to grow to $9.34 billion in 2008,
according to a recently released report from market research firm Frost &
Sullivan. The report says that in order for wireless games to take off in
the U.S., network operators will have to implement micro-billing payment
systems, including "billing-on-behalf-of-others" (BOBO) techniques to
collect revenues for content providers. "Network operators will face an
uphill challenge in getting consumers to pay for premium mobile content
such as games," said Frost & Sullivan research analyst Kshitij Moghe. "The
internet model of free content has become well engraved in consumer
attitudes, especially in North America."

o Set-Top Box Manufacturer Pace Micro Technology Laying Off 20% of Staff

West Yorkshire, England -- Pace Micro Technology, a manufacturer of
digital set-top boxes for digital TV and interactive applications,
announced on Monday that it is in the process of laying off 20 percent of
its workforce as part of an earlier announced corporate restructuring. The
company said its plan reflects the turbulence in the broadcasting market
and difficult trading environment faced by global digital TV operators,
and expects the restructuring to reduce its overhead by about 20 percent
for the coming year. The company also announced that its annual profit was
down 70 percent from the previous year. England-based Pace's set-top boxes
have been deployed by Time Warner Cable in the U.S., as well as with
British Sky Broadcasting (BSkyB) in the U.K.

has reached a licensing agreement with Viacom, for the public performance
of BMI repertoire on Viacom's cable networks. Financial terms of the deal

(Paris) Vivendi Universal has announced that it has named Jean-Rene
Fourtou as its new chairman and CEO, replacing the ousted Jean-Marie
Messier. Previously, Fourtou was head of the French chemicals firm

(Geneva) The World Intellectual Property Organization (WIPO) announced the
launch of a searchable database of domain-name disputes that have been
arbitrated by its Arbitration and Mediation Center. The database allows
users to search for details on thousands of "cybersquatting" cases that
have been settled through arbitration. Last week, pop singer Alanis
Morissette sued the owner of Alanis.net for cybersquatting; many other
celebrities have sued site owners, claiming domain names were purchased to
unjustly make money off of their names and identities.

(Trevose, Pa.) WorldGate, a provider of interactive television systems for
cable TV operators, announced on Monday that the nation's third-largest
cable operator, Comcast, will deploy its system in select locations.
Huntsville and Tuscaloosa, Alabama will be the first cities where

(Washington) A group of small, independent webcasters called the Voice of
Webcasters has sent a petition letter to Congress, asking lawmakers to
grant a stay of the recent webcasting royalty rate determination by the
Librarian of Congress. The petition also pleads for a restructuring of the
CARP (Copyright Arbitration Royalty Panel) process, which did not include
representation of small businesses such as theirs, and resulted in the
recommendation of royalty rates they deemed too high. "Only with
Congressional help will small webcasters get a legitimate and fair chance
to survive and compete with large commercial webcasters," the Voice of
Webcasters wrote in their letter. The group's membership includes
webcasters Beethoven.com, 3WK, Ultimate 80's and Wolf FM.
