o National Geographic Appeals Archived Images Case to Supreme Court

San Francisco -- On the same day that the Supreme Court ruled in favor of
freelance writers, the National Geographic Society appealed a similar case
involving freelance photographers and archives of digital images to the
high court, Wired News reported Monday. Despite the fact that National
Geographic lost its appeal in a lower court, the organization believes the
recent decision bolsters its own case. "Although the court ruled in favor
of the freelance plaintiffs in [the writers'] case, its reasoning bolsters
National Geographic's position in the pending litigation," National
Geographic Society executive vice president Terry Adamson told Wired News.
National Geographic argues that the recent decision affirmed the legality
of republishing content if it appears in exactly the same form as the
printed version, such as microfilm or microfiche. National Geographic says
the CD-ROM on which the images in question were republished falls into
this safe harbor. The Supreme Court has not yet agreed to review the
matter.

o Ticketmaster to Lay Off 90 Employees at CitySearch Unit

Los Angeles -- Ticketmaster is laying off 90 employees, or about 17
percent of the staff at its CitySearch unit, a network of websites that
cover regional entertaiment, CNET reported. The layoffs are part of an
overall staff reduction announced by Ticketmaster last year that aimed to
achieve profitability by 2002. CitySearch is mainly supported by local
advertisers who place ads on its regional websites, and has been affected
by the general decline in the online advertising market. The division will
have 450 employees after the layoffs are complete.

o Online Publishing Marketplace Rightsworld.com Raises Funding

New York -- Rightsworld.com, an online marketplace for book publishing

new funding, which it expects will last until the company becomes
profitable. The funding came from a group of individual investors that
included David Israel of Cahners Business Information, former U.S.

New York -- Alloy Online, an entertainment and e-commerce website and
direct marketing firm targeting the Generation Y audience, announced on
Monday that it will acquire CASS Communications, an advertising firm
specializing in high school and college-age markets. New York-based Alloy

o Briefly Noted:

(San Francisco) CNET featured an article Monday that explores the concerns
of traditional retailers like Tower Records, Wal-Mart and Best Buy with
proposed digital music subscription services to be offered by the major
labels. The National Association of Recording Merchandisers (NARM) has
lobbied in Washington for regulators to examine potential antitrust
violations by the major labels, as they join forces to launch subscription
services that have the potential to affect album sales at retail stores as
consumers increasingly listen to and buy music online.

(Cambridge, Mass.) MediaUnbound, a provider of personalization software
for digital music, said on Monday that digital cable music provider
DMX/AEI Music and Dallas-based streaming music service provider
Streamwaves will use the company's software in their digital music
services. Massachusetts-based MediaUnbound's technology inputs the
opinions of music analysts into software that learns about a person's
musical preferences and can help to explore, organize and navigate a
library of music.

(Culver City, Calif.) Columbia Pictures said on Monday that it will
release its digitally animated feature "Final Fantasy: The Spirits Within"
in digital cinema format at seven theaters on July 11. The movie -- based
on the series of video games of the same name -- will be projected using
Texas Instruments' DLP projectors at theaters in Irvine, Burbank and San
Francisco, California as well as in New York, Dallas, Chicago and Toronto.

(San Francisco) CNET reported on Monday on the valuation of video game
companies' stocks, which have fared well amidst a general downturn for
technology companies. Several companies have doubled or tripled their
valuation in the past year, and both Microsoft and Nintendo are due to
launch new high-end game consoles by the holiday shopping season to
compete with Sony's PlayStation 2.

(San Francisco) Salon.com offered a feature Monday on the classic Atari
2600 game console -- generally recognized as the first-ever game console
-- and how it has maintained popularity among players and programmers
alike. Web-based versions of classic games like Pitfall and Space Invaders
are available online, and some developers have even designed new Atari
games and game cartridges for the original console, despite the relatively
difficult programming restrictions inherent in the aging technology.
