o Kazaa Owner Sharman Networks to be Added to File-Sharing Lawsuit

Los Angeles -- A federal judge has approved the addition of
Australia-based Sharman Networks, which owns the Kazaa file-sharing
service, to a list of defendants in the recording and motion picture
industries' lawsuit against a number of file-sharing services, CNET
News.com reported. U.S. District Judge Stephen V. Wilson on Monday said he
would allow the addition of Sharman to a list of defendants that also
includes Streamcast Networks (Morpheus) and Grokster. "Sharman's
fundamental belief is that the distribution of the Kazaa Media Desktop is
not only legal but also one of the most important drivers of the future of
peer-to-peer technology," the company said in a statement responding to
the decision. "We are confident that our legal position will be vindicated
by the court." The Los Angeles Times reported that Judge Wilson also
approved the addition of Niklas Zennstrom and Janus Friis, who launched
Kazaa, and three companies linked to Sharman or Zennstrom and Friis to the
lawsuit.

o Universal Licenses Back-Catalog Albums to EMusic As Unprotected MP3s

San Diego -- EMusic, a digital music subscription service and subsidiary
of Vivendi Universal, announced on Tuesday that Universal Music Group will
make about 1,000 back-catalog albums available through the EMusic service.
The deal is significant in that EMusic offers tracks mainly from
independent label artists in the unprotected MP3 format, which major
labels have shunned because of the ease involved with uploading MP3s to
file-sharing services. EMusic also allows its 50,000 subscribers to easily
burn songs they download onto CD or transfer them easily to any portable
device. "We hope our experiment with EMusic will help us generate new
interest in these titles, while offering a great opportunity for us to
give consumers some flexibility," said Universal Music Group eLabs
president Larry Kenswil. "In order to continue to assess the market, we
hope to enter into similar agreements for this segment of our catalog with
other subscription services."

o Video Compression Developer On2 Lays Off 40% of Staff

New York -- On2 Technologies, a developer of video compression and
streaming technology, has laid off 40 percent of its staff, or 20
employees. The company said the cuts, which came in the support, business
development and marketing areas, were made because of a likely reduction
in the amount of financing that it could receive under its equity line of
credit as a result of recent weakness in its stock price. New York-based
On2 said the layoffs will reduce its monthly operating costs by about
$300,000. "We believe that the new cost structure will support annual
revenues in the $6 million range. If revenue moves higher, as has been
budgeted for 2003, we will add back some staff," said On2 president and
CEO Douglas A. McIntyre.

o Report: Mobile Entertainment to Bring $22.9B in Western Europe by 2007

Cambridge, England -- Mobile content and entertainment services will
account for around $2.68 billion of Western European consumers' total
mobile service expenditure of $96.4 billion in 2002, increasing to $22.9
billion (17 percent of the total) by 2007, according to a report released
on Tuesday by British research firm Analysys. The report indicates that
downloadable ringtones and logos have become major revenue-earners in
recent years, contributing to the estimated and forecast revenue, along
with mobile games, information services and alerts. It also shows that
services billed directly to a user's cell phone bill are more popular with
both subscribers and content providers. "Many of the content providers
interviewed for the report would prefer to use operators' billing systems
because of the convenience to themselves and to customers," said Katrina
Bond, lead author of the Analysys report. "But they are frustrated that
operators have been slow to upgrade their billing systems to charge for a
wide range of mobile content and entertainment services on behalf of third
parties."

o Audible Magic Acquires Peer-to-Peer Network User ID Technology

Los Gatos, Calif. -- Audible Magic, a provider of media identification and
content management technologies, announced on Tuesday that it has acquired
network monitoring technology that identifies peer-to-peer applications,
applications users, and specific files exchanged from former start-up
ipArchive. Financial terms of the deal were not disclosed. The acquired
technology allows IT administrators and ISPs to identify individual
peer-to-peer users, for the purpose of monitoring and managing bandwidth
demands generated by traffic on peer-to-peer networks. The acquisition
also included technology for initiating action dependent on identifying
the contents of a specific file, such as the title and artist of an MP3
file. Los Gatos, Calif.-based Audible Magic said the new technology will
be integrated into a beta-stage service this month and will become
commercially available in the third quarter.

(Espoo, Finland) Finnish cell phone manufacturer Nokia announced on
Tuesday that it has partnered with IBM on digital content delivery for
mobile devices. Under the agreement, IBM will market Nokia's delivery
server software for mobile content downloading to wireless network
operators and service providers. The companies have also agreed to
collaborate on secure content delivery technology. The combined service
will offer the delivery of Java-based mobile games, polyphonic MIDI ring

Tuesday that it will deploy TVN Entertainment's video-on-demand system in

entertainment software, said on Tuesday that it has signed a worldwide
licensing agreement with Disney Interactive for the video game rights to
two upcoming Disney movies. "Haunted Mansion," based on the Disney theme
park attraction, will be adapted into a motion picture and released along
with games for most major consoles by Halloween 2003. Disney will also
adapt its "Pirates of the Caribbean" attraction into a movie and video

digital television, said on Tuesday that it has updated its software and
integrated it with Atlanta-based Concurrent Computer Corp.'s

it has signed a licensing agreement with King Features Syndicate that will
allow its subscribers to download comic strip characters such as "Popeye,"

feature on the forecast for the online games market, with a particular
focus on massively multiplayer online roleplaying games (MMORPGs) like
"EverQuest" and "Ultima Online." "I expect there will be 2 to 3 million
more [game subscribers] in the U.S. that come on board in the next two
years," David Cole, president of research firm DFC Intelligence, told
Salon.com. The article points to "Star Wars Galaxies" and "The Sims" as
two upcoming titles that have the potential to attract more users than
others, by catering to more than a hardcore gaming audience. "We think
Sims and Star Wars Galaxies will be a real indication of the potential for
the market," said DFC's Cole, adding, "either or both could be the first
games to top the 1 million [subscriber] mark."

helping to expand peer-to-peer network technology with his work on a
Gnutella website and open source version of the software, died on June 29
in an apparent suicide. "Gene was one of the first people to make hay with

a powerful approach to problems in computer networking," Tim O'Reilly, of
