o Report: AOL Plan to Include Thousands of Layoffs, Near Halt to Marketing

Dulles, Va. - Two weeks away from pitching his radical plan to transform AOL into a free, ad-supported service, CEO Jonathan Miller is expected to call for thousands of layoffs and a "near halt" to marketing of the company's trademark Internet service, The New York Times reported on Monday. Miller, who will detail his proposal to the board of parent Time Warner, is expected to "defend his unusually draconian plan by arguing that trying to wring every last dime from its dial-up subscribers is preventing AOL from being as aggressive as it can in competing with Yahoo, Microsoft and Google on the web," The Times reported, citing anonymous AOL executives. The plan, however, could be a tough sell to some board members, since they would initially have to accept lower profits until the company is able to boost its advertising revenue. The plan is scheduled for public announcement on August 2.

o Judge Rules "Sanitized" DVDs Violate Filmmakers' Copyrights

Los Angeles - A federal court in Denver has ruled that companies that sell unauthorized edited versions of VHS and DVD movies that remove profanity, sex and other content deemed offensive are infringing on the filmmakers' copyrights. The major Hollywood studios and the Directors Guild of America sued companies including CleanFlicks, Family Flix, CleanFilms and Play It Clean Video, who claimed that their products were protected by traditional "fair use" rights. U.S. District Court Judge Richard Matsch said in his ruling that "what is protected are the creator's rights to protect its creation in the form in which it was created." Utah-based CleanFlicks and the other defendants were given five days to turn over all copies of their "sanitized" movies to the studios for destruction. CleanFlicks told The Hollywood Reporter that it plans to fight the ruling. While the ruling effectively outlaws selling edited copies of movies, it did not address companies like ClearPlay, which offer DVD player technology that does not alter a DVD but rather skips past, bleeps out or otherwise shields viewers from offensive content.

o U.K. Record Industry Asks ISPs to Shut Down File-Swapper Accounts

London - A record label trade group in the U.K. has asked two Internet service providers there to suspend the Internet accounts of 59 subscribers they allege are engaged in illegal file-sharing. The British Phonographic Institute (BPI) said its has provided ISPs Tiscali and Cable & Wireless with "unequivocal evidence" of copyright infringement on their services, "gathered using the unauthorized file-sharing networks themselves." BPI general counsel Roz Groome said, "Both Tiscali and Cable & Wireless state in their terms of use for subscribers that internet accounts should not be used for copyright infringement. We now invite them to enforce their own terms of use." A spokesperson for Cable & Wireless told the BBC that it will "take whatever steps are necessary to put the matter right…this would normally mean that any accounts used for illegal file-sharing are closed." Until this point, the BPI has targeted its lawsuits at individuals who have uploaded copyrighted files, filing 139 suits. Four cases that went to court were ruled in favor of BPI, while 111 defendants have agreed to settle for up to $12,000 each.

o Game Publisher Take-Two Facing SEC Probe Into Stock Option Grants

New York - Video game publisher Take-Two Interactive on Monday became the latest firm to come under investigation by the SEC over its granting of employee stock options. Many other companies, including Apple and CNET Networks, have either launched internal investigations or become the subjects of SEC probes into matters including whether they "back-dated" stock options, or changed the dates upon which the grants went effective to increase their values for employees. Take-Two said the SEC sent notice that it has launched an investigation into its stock options grants dating back to January 1997, adding that it had already initiated an internal review of its options grants, which is being conducted by independent counsel and accountants. New York-based Take-Two was also the target of several lawsuits and an FTC probe over the inclusion of hidden sexually explicit material in its "Grand Theft Auto: San Andreas" game.

o CNET to Restate Results; Correct Accounting Errors

San Francisco - CNET Networks, a San Francisco-based technology-focused media company, said on Monday that it expects to restate previously issued financial statements to correct errors related to accounting for stock-based compensation. The company said that the changes shouldn't have any impact on its previously reported revenues or cash positions. CNET said that it and a special committee from its board has reached the preliminary conclusion that the actual measurement dates for certain stock options granted between 1998 and 2001 differ from the recorded measurement dates. As a result, the company said that it expects to record non-cash charges for stock-based compensation expenses. CNET's brands include GameSpot, TV.com, MP3.com, Webshots and ZDNet.

o CacheLogic Raises $20 Million for Peer-to-Peer Traffic Management

Cambridge, England - CacheLogic, a provider of technology that allows Internet service providers to monitor and manage peer-to-peer file-sharing network traffic, announced on Monday that it has raised $20 million in its third round of venture capital financing. Amadeus Capital Partners led the investment round; 3i, Pentech Ventures and The Cambridge Gateway Fund also participated. Founded in 2002, U.K.-based CacheLogic provides technology that helps Internet service providers save on costs associated with the enormous amount of peer-to-peer traffic on their networks. The company recently named former UUNET executive Pat Chapma-Pincher as its CEO. CacheLogic will use the funds to expand sales into new territories, and to develop products to support the delivery of legitimate video content on peer-to-peer networks.

o Wireless Casino Gambling Developer Sona Mobile Raises $10.1 Million

New York - Sona Mobile, a developer of mobile gambling technology platforms for casinos, announced on Monday that it has raised $10.1 million through a private placement of its shares. Participants in the transaction included Shuffle Master, a provider of casino technologies, and Sona chairman and CEO Shawn Kreloff. Founded in 2000, New York-based Sona Mobile develops mobile 3D gambling software for casinos that supports devices including the BlackBerry and Windows Mobile-based devices. The company will use the funds for general working capital purposes.

o Sulake Gets $7.6 Million for Habbo Hotel Online Teen Community

Helsinki, Finland - Sulake Corporation, operator of the Habbo Hotel online community for teenagers, announced on Monday that it has received a $7.6 million equity investment from Movida Group, a joint venture between Japan's Softbank and interactive entertainment firm Asian Groove. Founded in 2000, Finland-based Sulake said there are now localized Habbo Hotels in 18 countries. The sites claim nearly 7 million unique visitors each month, who have created over 53 million Habbo characters. The company plans to extend the Habbo brand into mobile games and content, and merchandising and licensing products.

o Report: Over Half of All Mobile Games are Downloaded Over-the-Air

San Francisco - Over half of all mobile games played are titles purchased and downloaded to phones, while 39% are games that came embedded on the phone and 8% are played on the mobile Web, according to a report from market research firm Telephia. "The large share of pre-existing games reflects an opportunity for carriers and content providers to generate more revenue by converting that game play into downloaded, pay-for-play games," said Telephia's Kanishka Agarwal. The report also found that 71% of downloaded games were purchased on a portal operated by the subscriber's mobile carrier, compared with 29% purchased elsewhere. When purchasing mobile games, familiarity with the title from its console or PC version was cited as the most important criteria by 43% of those surveyed, third only to factors of price (59%) and availability of a free trial version (48%). "Cohesive marketing across all platforms -- PC, console and mobile -- is critical to a mobile game title's overall success," added Agarwal.

o Pump Audio Launches Music Licensing Service for Online Video

Pump Audio, a provider of licensed independent music for use by TV and advertising producers, on Monday announced the launch of a new Web-based service that lets anyone license music for use in online videos and interactive productions. Fandango, a provider of advance online movie ticket sales, announced on Monday that it has named Chuck Davis as its new chief executive officer. Davis previously served as president and CEO of Shopzilla (formerly BizRate), and president of e-commerce for Walt Disney Internet Group, and has been chairman of Fandango since January. o Wired News: Interview with Former RIAA Head Hilary Rosen

San Francisco -
Wired News on Monday published an interview with former Recording Industry Association of America (RIAA) head Hilary Rosen, who has since gone on to launch a consultancy whose clients include XM Satellite Radio -- which is currently involved in litigation with the record labels. "I think it's a fair thing to question the ongoing value of the individual lawsuits now when there's so much opportunity in the legitimate marketplace," Rosen said of the thousands of copyright infringement suits the RIAA has filed against individual file-swappers. On the RIAA's lawsuit against XM over radios that can record songs: "It's in the business sphere, although the RIAA has taken it into the political sphere to try and get legislation to regulate these recorders, and I just am optimistic that there will be a settlement. I think this doesn't rise to the level of court precedent and legal precedent and frankly, I think if the court case continued, the record companies would lose," Rosen told Wired News.
