o Draft Bill Would Limit Consumers' "Fair Use" Rights of Copyrighted Works

Washington -- A new bill drafted by Reps. Howard Coble (R-N.C.) and Howard
Berman (D-Ca.) would limit consumers' traditional "fair use" rights to
copyrighted content, CNET News.com reported. The bill would limit backup
copies of copyrighted materials, and likely outlaw such acts as taping a
TV or radio program and sending it to a friend. The bill also contains a
clause that benefits webcasters -- the temporary or "buffer" copies of
files that are briefly stored on users' PCs to facilitate transmission of
a stream would not be subject to licensing. The bill has not yet been
introduced, and in fact is not wholeheartedly endorsed by either of its
authors. "Part of it exempts buffer copies," Berman spokeswoman Gene Smith
told CNET News.com. "Howard thinks there has been no demonstrated need for
that. It's not a demonstrated problem." Rep. Berman also plans next week
to introduce legislation that would give record labels the authority to
use technological countermeasures to deter consumers from using
file-sharing networks.

o Reuters: VUNet USA President Robin Richards Expected to Step Down

Los Angeles -- Vivendi Universal Net USA president Robin Richards,
formerly president of digital music site MP3.com before it was acquired by
Vivendi Universal, is expected to announce his resignation shortly,
sources familiar with the situation told Reuters. The company is Vivendi
Universal's U.S. Internet unit, responsible for operations at MP3.com,
GetMusic.com, RollingStone.com, EMusic, The Flipside Network and others.
The move would come during a time of turmoil for Vivendi Universal, which
faces some accounting issues and whose chairman and CEO Jean-Marie Messier
was ousted last week.

o Sega Looks to Increase Video Game Market Share Through Acquisitions

Los Angeles -- Video game maker Sega is looking to expand its share of the
video game market through the acquisition of other game developers, and
has only ruled out taking over Electronic Arts, the top independent game
publisher, Reuters reported. Sega of America vice president Charles
Bellfield told Reuters that Sega aims to be the No. 2 game publisher in
the U.S. this year and the No. 1 globally next year. The company exited
the video game hardware market over a year ago to focus exclusively on
games, after competing for years with its Genesis, Saturn, Dreamcast and
other consoles. Shares of French video game publisher Infogrames spiked
earlier this week after speculation that the company was a prime target
for acquisition by Sega, which neither company would confirm.

o Report: European Spending on Video Games to Grow 5000% by 2006

London -- European spending on console, wireless and interactive TV video
games will grow 5000 percent, from $126 million in 2001 to $6.4 billion in
2006, according to a recent report from Screen Digest that was
commissioned by the European Leisure Software Publishers Association. New
online services being launched for Sony's PlayStation 2, Microsoft's Xbox
and Nintendo's GameCube are expected to generate $2.5 billion by 2006,
while spending on games for mobile phones and other wireless devices are
expected to generate $2.2 billion. Online games for PC, such as EverQuest
and Ultima Online, will claim seven million subscribers by 2006 and
represent a market value of $1.3 billion. The Screen Digest report also
predicts that U.K. consumer spending on interactive TV games will more
than double from $78 million in 2002 to $204 million in 2006, with the
total European iTV gaming market expected to be worth $465 million.

o AOL Buys $45 Million Stake in NBA Digital Cable Channel

New York -- AOL Time Warner spent $45 million to purchase a 10 percent
stake in NBA TV, the National Basketball Association's digital cable
channel, The New York Times reported. The investment replaces the notion
set forth in an earlier agreement that would have created a completely new
network. "We believe there is a place for a second full-time sports
channel after the demise of CNN/SI," NBA spokesman Adam Silver told The
Times. NBA TV is currently available to the 9.5 million digital cable
subscribers and 2.5 million satellite subscribers. The channel, which the
NBA said will eventually offer interactive TV features and high-definition
broadcasts, will carry 98 NBA games, some WNBA games and other content to
possibly include basketball-themed films.

o Report: 25% of U.S. Households to Have Digital Video Recorders by 2008

Carmel-by-the-Sea, Calif. -- Digital video recorders (DVR), which allow
viewers to pause and record live television, will be in an estimated 1.5
percent of U.S. TV households by 2002, increasing to 25 percent in 2008,
according to a report from California-based media research firm The Carmel
Group. The report also predicts that by the end of 2005, U.S. cable TV
operators will have an estimated 4.8 million DVR-based users, up from
300,000 users in 2002; U.S. satellite TV providers like DirecTV are
expected to have 4.9 million DVR-based users, up from 1.0 million in 2002.
The Carmel Group forecasts that six DVR manufacturers will control 72
percent of the market by 2005: Digeo/Moxi, Metabyte Networks, Microsoft,
OpenTV, Sonicblue and TiVo. Cable operators will be more inclined to work
with unbranded products, such as those provided by OpenTV and Metabyte
Networks, because they provide greater flexibility and control.

Chantilly, Va. -- The International Webcasting Association (IWA), an
international, non-profit group supporting small webcasters, announced
that it will hold a benefit concert to raise funds for its potential
negotiations or legislative relief from the U.S. Copyright Office's
recently announced webcasting royalty rates. A live webcast of the July 22
event, featuring headliner The Gerry Beaudoin Trio with Jay Geils, will be
produced by TVWorldwide.com. "Webcasters recognize there is a cost to do
business. What they cannot accept is a fee that restricts their ability to
stay in business," said IWA executive director Susan Pickering. "Without a
percentage of revenue structure, there is a barrier to entry for all but

the MPEG LA patent pool, a group of companies that hold the patents on
MPEG-2 digital video technology. MPEG-2 technology is notably used in set

expanding its licensing activities of certain other digital-related

partnered with Texas-based video game retailer GameStop to create an
online game retail site. IGN Gamestore will offer new and used game
hardware, software and accessories, as well as related entertainment

will serve as the store's fulfillment partner and will work with San

LEGO to developer a CGI-animated motion picture based on LEGO's Bionicle
