Record Quarter
Cupertino, Calif. -- Shares of Apple surged nearly 6% on Thursday
after the company reported a 75% increase in revenue and its highest
quarterly profit ever, thanks in large part to continued brisk sales
of its iPod digital music players. The company reported net income
of $320 million up from $61 million a year ago, on revenue of $3.5
billion, up from $2.0 billion. Both the company's profit and revenue
topped analysts expectations, according to a survey by Thomson First
Call, with earnings eclipsing estimates by $0.06 a share. For the
quarter, which ended June 25, Apple said that it shipped 1.2 million
Macintosh computers (up 35%) and 6.2 million iPods (up more than
600%).

Asks FTC to Investigate Rockstar, Promises Game Legislation
Washington -- Sen. Hillary Clinton (D-N.Y.) on Thursday asked the
Federal Trade Commission (FTC) to look into whether a sexually
explicit mini-game tied to the video game "Grand Theft Auto: San
Andreas" was created by the game's developer, or is only available
as a modification downloadable online. Rockstar Games has said
previously that hackers developed the mini-game, and that the code
comprising it is not included on retail copies of GTA. Clinton's
inquiry follows actions taken in Australia toward banning the game,
and criticism of the Entertainment Software Ratings Board (ESRB) by
a California state lawmaker. Clinton asked the FTC to determine
whether the game should be given a rare "AO" (Adults Only) label,
instead of the current "M" (Mature) rating. Clinton also said she
would introduce legislation that would slap a $5,000 fine on
retailers who sold violent or sexually explicit games to minors.
"The disturbing material in Grand Theft Auto and other games like it
is stealing the innocence of our children and it's making the
difficult job of being a parent even harder," said Senator Clinton.
"I am announcing these measures today because I believe that the
ability of our children to access pornographic and outrageously
violent material on video games rated for adults is spiraling out of
control."

Players Gaining on Apple's iPod in Japanese Market
Tokyo -- Sony's new digital music players are gaining market
share on Apple's dominant iPod in the Japanese market, outselling
Apple in the flash memory-based player market for the past two
months, Reuters reported. Sony's flash memory-based players come in
capacities of 256MB, 512MB and 1GB, and compete with Apple's iPod
Shuffle players. Sony's share of the Japanese flash player market
climbed from 4% in March, to 16% in April and 27% in May and June,
while Apple's share is now below 20%, according to market research
firm BCN. Apple's hard drive-based iPods still greatly outsell
Sony's comparable players in Japan, and continue to command nearly
70% of the U.S. market.

Court Convicts MP3 Site Operator, ISP of Copyright Infringement
Sydney -- An Australian federal court has convicted both an
operator of a site that linked to free MP3 files and his ISP of
copyright infringement, ZDNet reported. The major record labels sued
MP3s4free.net operator Stephen Cooper, his ISP Comcen, and other
parties in October 2003 for operating the site, and for
collaborating with one another to improve the site's traffic and
increase ad revenue. Australian Federal Court Justice Brian
Tamberlin on Thursday ruled against Cooper; Comcen; a Comcen
employee; Comcen's parent company, E-Talk Communications; and a
director of both companies. "This is a very significant blow in the
war against piracy," said Michael Kern, general manager of the
Australian trade group Music Industry Piracy Investigations. "The
court has found against all the respondents. It sends the message
that ISPs who involve themselves in copyright infringement can be
found guilty…The verdict showed that employees of ISPs who engage in
piracy can be seen in the eyes of the court as guilty."

o XM Satellite
Radio to Acquire WCS Wireless for $200 Million
Washington -- Preparing to develop new video subscription
services, XM Satellite Radio, a provider of satellite radio services
with more than 4.4 million subscribers, said that it plans to
acquire WCS Wireless, a Nevada-based owner of wireless spectrum
licenses in geographic areas covering 163 million people throughout
the U.S., including 15 of the top 20 metropolitan markets. Under the
deal, XM will pay 5.5 million shares of its stock, worth
approximately $200 million. WCS's licenses include 10 megahertz in
the frequency bands adjacent to XM's satellite radio service, which
XM said that it plans to use to launch a variety of new video and
data offerings. The company said that it will expects to announce
more detailed plans for the use of this additional spectrum in the
future. The deal is expected to close by the end of the year.

15 Cable, Satellite TV Providers for Infringing DVR Patent
Austin, Texas -- Forgent Networks announced on Thursday that it
has sued 15 cable and satellite TV operators -- including Comcast,
DirecTV and Timer Warner -- for infringement of its digital video
recording (DVR) patent. Filed in the U.S. District Court for the
Eastern District of Texas, the suit claims the 15 companies are
violating U.S. patent No. 6,285,746, which describes a system that
plays back a program while it is being recorded. All of the
defendants offer digital video recorder services to their
subscribers; Forgent may also add additional defendants that make
such devices to the lawsuit, such as TiVo. "We believe we will
prevail in this action as the '746 Patent is valid, enforceable and
infringed by the defendants," said Forgent chairman and CEO Richard
Snyder. Texas-based Forgent said its enforcement actions relating to
a different JPEG patent have yielded $100 million in license fees
from companies in Asia, Europe and the U.S.

Acquires Overseas Assets of Liberate Technologies
San Mateo, Calif. -- SeaChange International, a
Massachusetts-based provider of digital video systems, said that it
has acquired San Mateo, Calif.-based San Liberate Technologies'
interactive TV software business assets outside of North America for
about $23.5 million. Liberate supplies software to some of the
world's largest network operators, including ntl, Telewest and UGC
in Europe. Under terms of the acquisition, SeaChange has been
assigned certain customer contracts, as well as receiving patents
and other intellectual property. The company said that it also will
continue operations at Liberate's former facilities in San Mateo and
London, England, and is continuing employment for about 20 Liberate
employees.

Create Multiplayer Online Game With Marvel Superheroes
San Diego -- Microsoft announced on Thursday that it has signed a
licensing agreement with Marvel Comics, to develop and publish a
massively multiplayer online game for the Xbox 360 featuring Marvel
superheroes. Marvel's stable of some 5,000 superheroes includes
Spider-Man, The X-Men, The Incredible Hulk, Captain America,
Daredevil and The Fantastic Four. The companies said that additional
details about the game, which will be published by Microsoft Game
Studios, will follow in coming months. "With this next generation of
gaming, Marvel fans will finally have the ability to create choices
with their favorite Super Heroes, villains and creatures in
unbelievable detail -- all with the power of Marvel's incredible
vision and the Xbox platform," said Peter Moore, corporate vice
president of worldwide marketing and publishing for Xbox at
Microsoft.

Japanese broadcaster Nippon Television Network has announced plans
to launch an Internet video-on-demand service in October, The Japan
Times reported. The network will offer downloadable video clips of
programs that have already aired on TV -- spliced into 15-minute
segments -- with no copyright restrictions, for a fee of about 89
cents. Nippon rival Fuji TV also plans to offer TV programs on the
Internet, beginning with women's volleyball games.

Dodson to join Jae Lee on the development of "Marvel Nemesis: Rise
of the Imperfects," a title being jointly produced by EA and Marvel

PlayStation 2, PSP, Xbox and GameCube, the title will feature a new
set of characters created by EA, called "The Imperfects." Redwood

licensing details and in-game talent signed for its "L.A. Rush" game
collaboration with MTV. The company said that actors Bill Bellamy

will lend their voices and likenesses to the game. The title's
soundtrack will also feature 75 songs from 25 artists including Lil
