o Publishers Win Injunction Against Gator Pop-up Ads
Alexandria, Va. -- A federal judge has granted a preliminary injunction
against Gator, mandating that the online ad firm temporarily stop its
practice of serving targeted pop-up ads on top of existing ads on a number
of publishers' websites. Several major publishers, including The
Washington Post, The New York Times and Dow Jones sued Redwood City,
Calif.-based Gator in Virginia, claiming the company is siphoning their
online advertising revenue by serving ads on top of their own. U.S.
District Court Judge Claude Hilton issued the injunction on Friday; the
case will go to trial later this year. Gator asked the court for an
expedited trial and said it will continue to serve its pop-up ads to
customers other than the publisher plaintiffs. "We are highly
confident
that once all the facts are presented in the upcoming trial -- no Court
will issue a ruling eliminating a consumers' right to decide for
themselves what is displayed on their own computer screens," said
Gator

o Korean Court Orders Closure of Soribada File-Sharing Service
Seoul, South Korea -- A South Korean judge has issued an injunction
against Soribada, a Korean-language file-sharing service, which will
result in the closure of the popular service within a week, the Associated
Press reported. Soribada and its creators Yang Jung-hwan and brother Yang
Il-hwan were sued in February by the Recording Industry Association of
Korea for copyright infringement. "Soribada didn't violate copyrights
directly, but it must bear indirect responsibility for the degree of its
involvement in violations of copyrights," judge Kim Sun-hye told
South
Korean reporters Friday. The two brothers still also face criminal charges
of aiding and condoning copyright violation.

o Report: Interactive TV Ad Spending to Reach $2 Billion in 2005
Boston -- U.S. spending on interactive TV advertising is expected to
reach
$2.1 billion by the year 2005, accounting for 6.3 percent of total TV ad
revenues, according to a report released on Monday by Boston-based
research firm Trace Strategies. Growth areas forecasted by Trace include
an increase in spending for ads delivered over emerging video-on-demand,
walled garden and virtual channel platforms, which will experience revenue
growth averaging 238 percent each year. The firm predicts that interactive
program guides will bring the most interactive TV ad revenue, however,
with over $794 million in revenue by the end of 2005. The report also
indicates that U.S. household penetration of interactive TV advertising
will grow an average of 70 percent through 2005, reaching an estimated 122
million homes.

o Liquid Audio Rejects Buyout Offer, Amends Merger Deal with Alliance
Redwood City, Calif. -- Liquid Audio, a provider of digital music
distribution technology, announced on Monday that it has rejected a buyout
offer from Steel Partners II, a group of its shareholders, and amended its
previously announced agreement to merge with CD and DVD distributor
Alliance Entertainment. The company said it will now purchase 10 million
of its shares at $3 per share; it will then issue 36.3 million new shares
to Alliance. As a result, Redwood City, Calif.-based Liquid Audio's
shareholders will own 26 percent of the combined company while Alliance's
stake will increase from 67 to 74 percent ownership.

o Microsoft Details Launch Plans for Next Version of Windows Media
Redmond, Wash. -- Microsoft on Monday announced a Sept. 4 release date
for
the beta version of its latest audio and video digital media software,
formerly codenamed "Corona" but now officially dubbed Windows
Media 9
Series. The release will contain new versions of Windows Media Player, a
new streaming server, new audio and video compression, a new encoder and a
new software development kit. Microsoft also said that the new software
will be supported in consumer electronics firm Pioneer's DigitaLibrary, a
home theater device that can store and play audio and video files. The
device will let users access Windows Media content directly from selected
online content providers, and play back audio and video files located on
PCs anywhere in the home.

o Yahoo Inks Deals to Offer Buyers More Pervasive Ad Formats
New York -- Yahoo on Monday announced deals with a number of
advertising
software firms that will make more pervasive ads on the Web portal's
online services more easily available to advertisers. The advertising
formats are offered by New York-based firms Eyeblaster and Unicast,
Atlanta-based EyeWonder and Philadelphia-based Point.Roll. These formats
will offer advertisers the ability to create "floating" pop-up
ads,
streaming video ads and ads that expand when a mouse cursor rolls over
them. "We are at a key juncture in the industry, and there is
acknowledgement that the Internet is a key ingredient in successful
integrated marketing campaigns," said Yahoo chief sales officer Wenda
Harris Millard.

developed a version of its popular "Tomb Raider" title for

(Redmond, Wash.) MSNBC.com on Monday reported on the growing number of
individual Internet users being targeted by the Motion Picture Association
of America (MPAA), for making copyrighted content available on
file-sharing services like Gnutella and Kazaa. The MPAA says it is using
software including a program called "Ranger" to seek out users
who are
offering movies online and automatically send them and their Internet
service providers "takedown" notices, which threaten to shut
down a user's
broadband connection if he or she does not remove the content in question.
The MPAA told MSNBC.com that it is now sending around 2,000 such takedown
notices per week.
