o Radio Stations Appeal Streaming Music Royalties

Washington -- A group of radio broadcasters has filed an appeal of an August 2001 court ruling establishing royalty payments for streaming simulcasts, saying that they should not have to pay artists and record labels for streaming when they are not required to pay similar fees for over-the-air broadcasts. The Librarian of Congress set a rate of 0.07 cent per listener per song streamed to online listeners by both
Internet-only webcasters and large radio stations that simply simulcast
their over-the-air signals online. Webcasters, many of who said that the
royalty rates would put them out of business, were not party to the
appeal, which was submitted by the National Association of Broadcasters
and radio station owners Bonneville, Clear Channel, Cox Radio, Emmis,
Entercom and Susquehanna.

o Tauzin-Dingell Bill Would Accelerate Transition to Digital TV

Washington -- Reps. Billy Tauzin (R-La.) and John Dingell (D-Mi.)
announced they will draft a bill that would accelerate the delayed
transition to digital TV, Reuters reported. Tauzin, who chairs the House
of Representatives Energy and Commerce Committee, said the bill would be
given its own legislative hearing, rather than be bundled with other
proposed legislation. The bill would resolve issues such as
copy-protection of content using the "broadcast flag" recently agreed upon
by content producers and some technology firms, and how consumers would be
able to use personal copies of digital TV broadcasts. "The staff has been
ordered to begin drafting an omnibus digital television transmission bill
and to have it ready by September for discussion, unless all the parties
can tell us by September that they have resolved the remaining issues that
stand between their reaching agreement," Tauzin said at a press
conference. In a statement, consumer electronics firm Philips praised
Tauzin's call for "a comprehensive, bipartisan approach to further advance
the transition to digital television. Philips supports the process that
Chairman Tauzin and Mr. Dingell outlined today and pledges our full
support to assist the Committee in this endeavor," said Philips Consumer
Electronics North America chairman and CEO Lawrence J. Blanford.

o MPEG LA Releases Final Licensing Terms for MPEG-4 Technology

Denver, Colo. -- MPEG LA, a licensing body that represents companies
holding patents on emerging MPEG-4 digital video technology, announced
that it has reached final licensing terms for MPEG-4 technology. The
group, whose members include Philips, Sony, Microsoft and Matsushita,
faced criticism of its initial proposal on licensing fees. Companies
including Apple rejected the terms, and delayed the release of its
QuickTime 6 video software over the controversial rates. "We've made a lot
of progress as an industry working with MPEG LA, moving them considerably
from where they were six months ago," Frank Casanova, Apple's director of
QuickTime product marketing, told CNET News.com. The finalized terms let
companies license MPEG-4 for audio and video streaming to users for $0.25
per subscriber or $0.02 per hour, up to a total of $1 million annually.
The new terms also state that companies with fewer than 50,000 subscribers
do not have to pay any royalties.

o Universal Music Group Names Anti-Piracy Officer

Santa Monica, Calif. -- Universal Music Group, a record label group and
subsidiary of Vivendi Universal, announced on Tuesday the appointment of
David Benjamin to the newly created position of senior vice president,
anti-piracy. A former music attorney and executive at webcaster
ClickRadio, Benjamin will oversee and coordinate Universal's anti-piracy
activities. "At a time when two out of every five albums sold globally are
pirated recordings and online piracy jeopardizes the livelihood of
artists, songwriters, and all those who work in our industry, we believe
it is especially critical to have a fully-dedicated position to focus on
protecting creative content," said UMG president Zach Horowitz.

o Microsoft to Release Version of Windows XP for Digital Media Enthusiasts

Redmond, Wash. -- Microsoft on Tuesday announced plans to release a
version of its Windows XP operating system specially configured for
digital media uses in the home. Windows XP Media Center, previously
codenamed "Freestyle," will be installed only on new PCs beginning around
the holiday season, and will allow consumers to use a PC with a remote
control to access live television, personal video recording, digital
music, digital video, DVDs and pictures. Manufacturers including
Hewlett-Packard, NEC and Samsung have said they will bring PCs
pre-installed with the new operating system to market. Microsoft said that
Windows XP Media Center is targeted at "digital media enthusiasts and
consumers in small, space-constrained environments, such as teen-agers,
college students, young adults and families who want to use their PC for
multimedia entertainment."

o Loudeye Technologies' Shares Move to Nasdaq SmallCap Market

Seattle -- Loudeye Technologies, a provider of webcasting and digital
media services, announced on Tuesday that the Nasdaq has approved the
transfer of its shares to the Nasdaq SmallCap Market. Loudeye's shares
currently trade below the $1 minimum requirement for continued listing,
but the company was given a grace period of until Sept. 30 to boost its
shares. The grace period may again be extended until March 28, 2003 if the
company meets the SmallCap Market's initial listing standards. Last week,
Seattle-based Loudeye laid off 37 percent of its staff as part of a cost
savings initiative. The company provides streaming audio services to
companies including AOL, MSN and Radio Free Virgin.

Boston -- FastChannel Network, a provider of an online management and
distribution systems for digital advertising, announced on Tuesday that it
has acquired San Francisco-based Swan Systems, a provider of data and
asset management software. Financial terms of the transaction were not
disclosed. Swan's data and asset management technology will be integrated
with FastChannel's services. Belmont, Mass.-based FastChannel offers a
database of over 23,000 viewable commercials and provides a digital ad
delivery network for print and broadcast that provides its 18,000
subscribers with tools for ad delivery, creative search, project
