o Movie Studios Endorse Digital Video Security Technology

New York -- Movie studios Sony Pictures and Warner Bros. have announced
their endorsement of technology that protects the digital transmission of
video, bringing video-on-demand for movies and other similar services
closer to reality. The technology was developed by the 5C Entity --
composed of consumer electronics manufacturers Intel, Matsushita, Toshiba,
Sony and Hitachi -- and allows content providers such as the studios to
embed restrictions and limitations on how their video content can be used.
For instance, the technology can regulate whether or not a movie can be
recorded using TiVo or a similar personal video recorder. Sony and Warner
are the first major movie studios to adopt the technology; others such as
Disney and Vivendi Universal have yet to commit to a secure distribution
platform.

o Copyright Office Includes "Interactive" Webcasters in Arbitration

New York -- The U.S. Copyright Office has ruled that providers of
so-called "interactive" Web radio programming should be allowed to
participate in arbitration proceedings to determine what royalty rates
should be set for digital music, The Wall Street Journal reported on
Tuesday. The Recording Industry Association of America (RIAA) had argued
that streaming radio services that let users skip through songs and do
other functions that can influence the music they hear should have to pay
higher royalty rates than do non-interactive services. The Digital Media
Association -- a lobbying group that represents webcasters -- called the
ruling a victory for its members that brought the issue, which include
MTVi and Yahoo's recently-acquired Launch Media.

o Study: Dot-com Downturn Not Affecting U.S. 'Net Use

Washington, D.C. -- A new survey of Americans conducted by the Pew
Internet and American Life Project reveals that despite the growing number
of failed Internet companies, U.S. citizens are spending about the same
amount of time online as they were six months ago. In fact, only 8 percent
of those surveyed said that one of their favorite Web sites has closed in
the past year. The study also found that of those who said they were using
the Internet "more" than they were six months ago, 29 percent said it was
due to increased use at work or for school. The Pew Internet survey asked
questions of 1,081 Internet users who had been online for at least six
months.

o Court Sets Deadline for Submission of Napster Appeal

San Francisco -- The U.S. Ninth Circuit Court of Appeals has given Napster
until August 9th to submit an appeal of a recent ruling that said its
filters must be 100 percent effective before it can come back online, the
Associated Press reported. Napster has been offline since July 2nd, when
it voluntarily took the service down to fix technical errors related to
its implementation of new "audio fingerprinting" software that identifies
files based on their acoustic characteristics. In a hearing last week,
Judge Patel ordered that Napster must remain offline until its filtering
system allows no unauthorized copyrighted material to be traded. The Court
did not immediately grant Napster's request for a stay of Judge Patel's
ruling, the text of which is provided at a link below.
