o Microsoft Confirms Development
of "Zune" iPod Rival Device
Redmond, Wash. - Microsoft on Friday confirmed reports
that the company is developing a portable music player and
corresponding service, for release later this year, that will
compete with market leader Apple's iPod and iTunes Store. "Today we
confirmed a new music and entertainment project called Zune," Chris
Stephenson, Microsoft's general manager of marketing, told
Billboard. "Under the Zune brand, we will deliver a family of
hardware and software products, the first of which will be available
this year. We see a great opportunity to bring together technology
and community to allow consumers to explore and discover music
together." In addition to the music player -- which Microsoft
confirmed will feature a hard drive and Wi-Fi connectivity -- a Zune-branded
portable video player and handheld video game device are slated to
follow. The company told Billboard it is looking at wireless
features such as allowing Zune owners to view one another's song
playlists, access songs stored in online lockers, and download music
directly to the device.

o FTC Settles Charges
Against Take-Two Over "Grand Theft Auto"
New York - Video game publisher Take-Two Interactive
announced on Friday that the Federal Trade Commission (FTC) has
concluded its inquiry into the company, which centered on the
improper rating of its "Grand Theft Auto: San Andreas" in light of
sexually explicit content found hidden in the game's source code.
Take-Two said that, following the 30-day period for public comment
after the FTC announced its initial findings, the FTC has settled
all pending matters and no penalties or fines will be assessed. The
consent order between the FTC and the company stipulates that in the
future Take-Two shall not misrepresent a game's ratings or content
descriptors; the company must also implement a system to ensure that
all game content is reviewed in connection with submissions to
ratings authorities. "We are extremely pleased that the FTC has
concluded its very thorough investigation, and that the matter has
been resolved," said Take-Two president and CEO Paul Eibeler.
Despite the FTC's conclusion of its inquiry, the company still faces
several class action lawsuits filed by shareholders and consumers.

of U.S Adults Download Podcasts
Hollywood - More than 6% of U.S. adults, or about 9
million Web users, have downloaded podcasts in the past month,
according to a survey of 1,700 participants conducted for a report
by Nielsen Analytics. More than 75% of these regular podcast
downloaders were male, and 38% said they are now listening to radio
less often. The report noted that the most successful podcasts claim
as many as two million downloads per month, which has attracted
mainstream advertising. However, 60% of respondents said they
"always" fast-forward through commercials, prompting advertisers to
look to embedded ads and endorsements from podcast hosts. Some 72%
of respondents who regularly download podcasts download an average
of one to three podcasts per week, while the 10% considered "heavy
users" download eight or more per week. "While essentially still in
nascent form, podcasts offer free audio and video content that is
inexpensive to create, easy to access and on a portable platform
that has already reached mass distribution. This exciting new medium
has only just begun to stretch its legs," said Larry Gerbrandt,
general manager and senior vice president of Nielsen Analytics.

Over 5 Million Xbox 360s Shipped
Redmond, Wash. - Microsoft announced that it has now
shipped over five million Xbox 360 video game consoles worldwide,
including 3.3 million in North America, 1.3 million in Europe and
400,000 in Asia. The company met its previously stated goal of
selling 5 million consoles by the end of June. Microsoft still plans
to sell 10 million by the end of the year, and set a new goal of
selling 15 million units by June 2007. Microsoft's Home and
Entertainment Division, which includes the Xbox 360, saw revenues of
$1.14 billion in profits, and $414 million in losses for the quarter
-- which contributed to a decline in the company's overall profits
of $2.83 billion for the quarter, down from $3.7 billion last year.

Activision Sued Over Stock Option Grants
Santa Monica, Calif. - Video game publisher Activision
announced this week in an SEC filing that it has been served with a
lawsuit over its granting of stock options to employees. The company
said it is reviewing the allegations. Activision is among a growing
number of companies being scrutinized for a practice called
"backdating," whereby a company changes the date on which an option
was granted in order to increase the value of the option for
employees. Fellow game publisher Electronic Arts recently concluded
an internal investigation that found no backdating of its options,
but did alter its stock options plan for employees. Meanwhile, the
SEC filed criminal charges on Friday against former top executives
at Brocade Communications Systems over backdating, adding that it
has more than 80 similar investigations underway.

Nast Acquires Health Website NutritionData.com
New York - Magazine publisher Conde Nast on Friday
announced its second website acquisition in as many weeks, with the
purchase of health and lifestyle destination NutritionData.com.
Financial terms of the deal were not disclosed. Founded in 2003,
NutritionData.com offers nutritional data supplied by the USDA to an
audience of 600,000 monthly users. Conde Nast said the site's
toolset could be integrated into its sites for Gourmet, Bon Apetit,
Self and Glamour magazines. The acquisition follows Conde Nast's $25
million purchase of Wired News last week from Lycos, which reunited
the print and digital editions of Wired under one owner again after
eight years apart.

search marketing technology, has been acquired by Verizon
Directories Corp., a subsidiary of Verizon Communications. Financial

Tokyo - Japanese electronics firm Toshiba plans to begin
mass-producing a line of ultra-small 1GB and 2GB memory cards for
cell phones and other devices beginning in September, according to a
report in Japan's Nihon Keizai. Toshiba will make 3-4 million of the
microSD cards per month, which are one-quarter the size of the
current industry standard miniSD cards for cell phones.

Reduce License Fee for HDMI Specification
Beijing - HDMI Licensing, which controls licensing of the
High-Definition Multimedia Interface specification, announced on
Friday that it has reduced the annual administration fee for HDMI
adopters from $15,000 to $10,000. The HDMI specification -- a
single-cable interface for HD video and multi-channel audio -- was
developed by Hitachi, Matsushita, Philips, Silicon Image, Sony,
Thomson and Toshiba. The China Video Industry Association, a
consumer electronics trade group in China, applauded the reduction
and said it would promote and support the specification in China.

"Guarantee" Viewer Engagement for Toyota Ads
Torrance, Calif. - Toyota Motor Sales announced on Friday that
it has signed a first-of-its-kind agreement with NBC, whereby NBC
will "guarantee" a specific level of viewer engagement for its TV
shows. "Viewer engagement" will measure audience recall of elements
within TV programs, which studies have shown correlates to viewers'
retention of the programs' accompanying commercials. NBC has engaged
IAG Research to conduct audience panel surveys to gauge how
accurately show details are remembered.

Los Angeles - Video game publisher Legacy Interactive announced
this week that it will distribute its upcoming "Law & Order Criminal
Intent" title, based on the NBC drama series, as a four-part
downloadable PC video game through sites including NBC.com. The
game, which features celebrity voice work from actors from the show
including Vincent D'Onofrio and Jamey Sheridan, will be available in
a try-before-you-buy format from NBC.com, Legacy's game portal,
Yahoo and Big Fish Games. The four-part downloadable version will
cost $20, while all four episodes packaged on a CD-ROM will sell for
$30 at retail.
