o RealNetworks To Offer Open Source Version of Streaming Software

San Francisco -- In the latest chapter in its battle with Microsoft,
RealNetworks, one of the largest providers of applications for Internet
media delivery, announced on Monday that it plans to offer a new open
source version of its streaming media software. The software will support
multiple file formats for audio and video -- including Microsoft's
proprietary file formats. Because the software will run Microsoft file
formats, analysts have speculated that RealNetworks could be forced into a
protracted legal battle with Microsoft, which may attempt to block the
move. The new software, called Helix, is aimed at large companies and
organizations that want to send audio and video data to customers.
RealNetworks said it will begin offering the source code within 90 days
and plans to release the server source code in later months.

o Russian Software Company Alleges Flaws in Adobe's eBook Software

San Francisco -- ElcomSoft, a Russian software firm scheduled to face
trial next month on criminal charges resulting from alleged violations of
the Digital Millennium Copyright Act (DMCA), is pointing out new flaws in
Adobe's software. The criminal charges are in connection with software
used to crack copyright protections on Adobe's e-Book software.
ElcomSoft's newest disclosures allege that flaws in Adobe's application
could allow a user to "check out" every copy of every book in Adobe's new
electronic library for an unlimited amount of time by changing the values
in the loan form. According to CNET, the bugs were discovered "on an
Adobe test web site that demonstrates how the software could be used to
set up a lending library -- not an actual site that offers books -- and
ElcomSoft gives information about how to fix the flaws." Last year,
federal agents arrested ElcomSoft employee Dmitry Sklyarov after he gave a
speech about his company's software, which could crack protections on
Adobe's eBooks.

o Report: Industry Statistics Point to Growth of E-Publishing

New York -- Bucking conventional wisdom, The Open eBook Forum, an
e-publishing industry trade and standards organization, on Monday released
the results of an industry-wide analysis of sales growth and new product
innovation, which shows significant growth in all areas of the business.
The report highlights the number of users adopting eBooks and related
software, the creation of new technologies and the increasing use of
eBooks by publishers as a marketing tool that works in tandem with
traditional book sales efforts. "The initial hype that surrounded the
early days of eBooks has overshadowed the steady growth of a burgeoning
industry," said Nicholas Bogaty, executive director of the Open eBook
Forum. The report, which is contrary to the public perception of late that
e-publishing is a struggling industry, cites the increasing revenues among
e-publishing companies. According to the report, Random House's eBook
revenues doubled year-over-year in 2001 and during the latest quarter,
revenues were the highest since the company began selling eBooks in 1998.
The Open eBook Forum's members include technology companies such as
Microsoft, Adobe and OverDrive as well as publishing companies such as
Random House, Simon & Schuster, AOL Time Warner, McGraw-Hill,
HarperCollins, Scholastic and Harcourt.

o SomaFM Closes Down; Cites Higher Webcasting Royalty Rates

San Francisco -- SomaFM, an Internet radio station which grew from 10
listeners an hour to 2,000 with its mix of independent music, announced
that it has shut down because of new federal copyright royalty fees that
go into effect in September. According to Rusty Hodge, who ran the San
Francisco area company out of his garage and was interviewed by USA Today,
"We would have to pay $10,500 a month. We existed on listener donations.
Our last month produced $3,000. We weren't in any position to pay that
kind of money." SomaFM is one of many independent Internet radio stations
that are expected to close rather than pay the new webcasting royalties
set by the Copyright Arbitration Royalty Panel last month. According to
CNET, more than 200 stations have closed since the royalty rates were set,
and more are expected to follow. Since the rate is retroactive to 1998,
webcasters like SomaFM will be expected to make large payments by October
20. "We shut down because we were scared of the liability," said Hodge.
''We were looking at a payment of $60,000 to $80,000…The labels have lots
of lawyers and a huge annual budget for lobbyists. It's hard to fight
that."

o Wharton Report: Webcasters Face Significant Hurdles With Royalty Fees

Philadelphia -- A report published by Knowledge@Wharton, an online
resource of the Wharton School of Business that covers current business
trends, questions whether independent webcasters will be able to survive
when faced with the recently established webcasting royalty fees and the
depressed advertising market. The report concludes that the combination of
these factors may price many small content providers out of the market,
leaving some with no choice but to shut down. According to Michael Mazis,
a professor of marketing at American University's Kogod School of
Business, the future of Internet radio depends at least in part on whether
the webcasting royalty ruling is reversed or modified. "It's hard to tell
in the long run where this will go," said Mazis. "Even if the economy
picks up and there are more advertising dollars being spent, it will be
difficult for webcasters to survive. Because of the low start-up costs
associated with these Internet radio stations, there are a lot of them.
All can't be profitable; there are too many in the market." Paul Maloney,
editor of RAIN, the Radio and Internet Newsletter, concludes that without
legislative action to address the royalty rates, many webcasters will be
forced to shut down. "It's almost certain that unless some emergency
legislation goes through, most of the webcasting industry will go away,"
he said.
