o Bill Would Limit Liability of Labels, Studios Who Hack P2P Networks

Washington -- Two lawmakers have followed up on a promise to introduce
legislation that would make it legal for movie and music companies to use
technological countermeasures to help stem the use of peer-to-peer
file-sharing networks for piracy of copyrighted works. The bill,
introduced on Thursday by Reps. Howard Berman (D-Ca.) and Howard Coble
(R-N.C.), would limit the liability of copyright owners who use
technological "self-help measures" to thwart file-swappers. "Copyright
owners could employ a variety of technological tools to prevent the
distribution of copyrighted works over a P2P network. Interdiction, decoy,
redirection, file-blocking, and spoofing technologies can help prevent
unauthorized P2P distribution," Berman said in a speech announcing the

o ACLU Sues Over DMCA Restrictions In 'Net Content Filtering Case

Washington -- The American Civil Liberties Union has filed a federal
lawsuit that challenges the Digital Millennium Copyright Act (DMCA),
arguing that a computer researcher has First Amendment and "fair use"
rights to examine the full list of sites contained in an Internet blocking
program and to share his research tools and results with others. The ACLU
filed the suit on behalf of Ben Edelman, a researcher looking to examine
the list of "offensive" Internet content being blocked by software
developed by Seattle-based N2H2, which is used by several states on PCs in
their public libraries. The DMCA stipulates that anyone who circumvents
copy-protection technology on digital media, which would be necessary in
order for Edelman to conduct his research, is in criminal violation and
subject to fines and possible jail time. "Especially when governments in
the U.S. and abroad mandate the use of blocking programs, the public has a
right to know what is being blocked, and I believe I have a right to
uncover this information without being subject to a corporate lawsuit,"
said Edelman.

o Open Source Advocate Plans to Explain DVD Hack in Public DMCA Challenge

San Francisco -- Open source software advocate Bruce Perens plans to mount
a challenge to the criminal aspects of the Digital Millennium Copyright
Act (DMCA) on Friday, when he will demonstrate at a technology conference
how a hacked DVD player can circumvent the device's embedded "regional
coding" rules, technology news site InfoWorld reported. Perens said he
will show how the modified DVD player breaks the digital rights management
technology during his presentation at the O'Reilly Open Source Convention
in San Diego -- an act that got Dmitry Sklyarov, a Russian software
developer -- arrested for violating the DMCA at a technology conference
last year. "What happened to Dmitry could conceivably happen to me as
well," Perens told InfoWorld. "It is a political and social statement, and
the statement is that the people do not need to have a hall monitor living
in their stereo system and should be able to play any kind of media on the
device they wish." Perens said he was moved to pose the challenge the law
after purchasing DVDs in England that would not play on his U.S.-bought
DVD player.

(Los Angeles) NDC (New Digital Cinema), a consortium of Hollywood studios
working to implement technology standards for digital cinema, announced
that it has named Charles Goldwater as chief executive officer. NDC, which
counts studios including Twentieth Century Fox, Warner Bros., Paramount,
Disney, Sony, Universal and MGM among its members, was created to address
technical standards for digital film projection, and to help facilitate
the costly transition for theaters from film to digital projection. "It's
a little early in my tenure to be able to predict what will get
accomplished and when it will happen," Goldwater told Reuters.

announced on Thursday that it has partnered with European digital TV
sports network Eurosport to develop interactive programming. Eurosport

(Ann Arbor, Mich.) Software developer Cybernet Systems announced on
Thursday that it has entered into a licensing agreement with Sony Computer
Entertainment. Under the agreement, Sony PlayStation 2 game developers
will be given access to Michigan-based Cybernet's OpenSkies massively
multiplayer network engine, for the purpose of developing multiplayer
online games for PS2. OpenSkies enables tens of thousands of players to
simultaneously interact in the same online environment. Cybernet will also
work with these developers and scale the OpenSkies network engine to their
needs.

technology for audio and video, announced on Thursday that Columbia
TriStar Home Entertainment, a division of Sony Pictures Entertainment, has
signed a multi-year contract renewal to utilize Macrovision's DVD
