o Bill Introduced to Change Existing Web Radio Laws, Save Small Webcasters

Washington -- In response to what they view as the recent imposition of
high fees on webcasters for streaming music online by the U.S. Copyright
Office as well as a flawed CARP (Copyright Arbitration Royalty Panel)
process, a number of lawmakers have introduced a bill that would change
existing Web radio laws so that small webcasters would not be forced off
the air. The "Internet Radio Fairness Act," introduced by U.S. Reps. Jay
Inslee (D-Wa.), George Nethercutt (R-Wa.) and Rick Boucher (D-Va.), will
go before the House of Representatives' Judiciary and Small Business
Committees. The bill asks that small businesses -- with under $6 million
in gross revenue -- be exempted from the royalty rates for streaming music
online recently set by the Librarian of Congress. It also asks that
"ephemeral" or temporary copies of recordings, necessary to transmit music
through a webcast, be exempted from any future fees in CARP proceedings.
"Small web radio stations are bearing an unfair burden under the CARP's
decision, and the public stands to lose access to these useful services
unless the law is changed," said bill co-sponsor Jay Inslee, in a
statement.

o Under Pressure, Open Source Advocate Backs Off Public DMCA Challenge

San Jose, Calif. -- An open source advocate that had planned a public
criminal violation of the Digital Millennium Copyright Act (DMCA) has
backed off the plan at the behest of his employer, Hewlett-Packard,
according to The San Jose Mercury News. Dan Perens had plans to exhibit a
DVD player that could circumvent the regional coding rules embedded onto
discs and players, which could have violated the DMCA and subjected him to
possible arrest, fines and incarceration. Perens told The Merc that HP
funds him "to pursue a variety of free software projects," and frowned
upon his proposed demonstration. Although Perens was willing to assume any
potential legal risks, HP worried that it may have been seen as a "more
juicy target" for any potential litigation.

o Digital Video Production Firm Zoom Culture Raises $2.5 Million

Chapel Hill, N.C. -- Zoom Culture, a digital video production firm, has
raised $2.5 million in its third round of funding from Intersouth
Partners, Cordova Ventures and Chrysalis Ventures -- all existing backers
of Zoom Culture. Once a strictly Web-based video production company, North
Carolina-based Zoom Culture said the funds will help it speed attempts to
cross over into the TV market. The company recently signed a deal with a
group of NBC television stations to produce a series of shows based on
Zoom Culture's "Hip Hop Nation," which first aired in Raleigh last year.
Zoom Culture specializes in digital video production for television and
the Web, developing shows through a network of young-adult videographers.
It recruits, trains and manages the talent, some of whom actually pay to
contribute their work to the company's productions. The new $2.5 million
investment is in the form of convertible debt. Zoom Culture raised $7
million in its second round of venture capital earlier this year. The
company has raised a total of about $15 million.

o Aladdin Systems Terminates Merger With Web 3D Developer Activeworlds

Watsonville, Calif. -- Aladdin Systems, a developer of compression
software including the popular StuffIt application, announced that it has
terminated its letter of intent to merge with Massachusetts-based
Activeworlds, a provider of 3D virtual reality software. The companies had
announced their intention to merge on May 6. Watsonville, Calif.-based
Aladdin Systems also said it will continue its merger discussions with
Maryland-based Erevu, a provider of management software for distributed
networked computers.

services, announced that it will provide search results on the About

(Pasadena, Calif.) Digital video recorder manufacturer TiVo said on Friday
that it has partnered with the Public Broadcasting Service (PBS) to
promote the network's upcoming 9/11-related programming. Pasadena-based
TiVo and PBS also said they are developing a six-month alliance to promote
viewership on local PBS stations and to ascertain the best ways digital
video recorder applications can support public television programming.

(Redmond, Wash.) CNET News.com reported that Microsoft sent a letter to
its more than 50,000 employees on Thursday, warning that the exchange of
music or media files is not allowed on company PCs or networks. "Microsoft
is a leading innovator in the area of P2P technology," company executives
Will Poole, Brad Smith and Rick Devenuti wrote in the letter. "We also are
a company that makes its living based largely on our intellectual
property, just like music labels and movie studios. It is therefore
incumbent upon all of us to ensure that our employees develop and use P2P

the recent introduction of legislation aimed at preventing piracy of
copyrighted works on popular file-sharing networks such as Kazaa and
Gnutella in large part ignores the availability of file-sharing
