o Adobe Settles Patent Infringement Litigation With Macromedia

San Jose, Calif. -- Adobe Systems, a provider of Web and print publishing
software, announced that it has settled all outstanding patent litigation
with rival Macromedia, which provides Web publishing software applications
such as Flash. The two companies said the terms of the settlement are
confidential, and that customers using products from either company will
not be affected. Adobe and Macromedia have both lost patent infringement
claims to one another; in May, Adobe was ordered to pay Macromedia $4.9
million in damages, while a week earlier Adobe was awarded $2.8 million in
damages for patent infringement claims it filed against Macromedia.

o Anti-Counterfeiting Bill Expanded to Protect Digital Rights Management

Washington -- A number of outlets have reported on recent changes that
were made to a bill introduced by Sen. Joseph Biden (D-Del.) that would
expand U.S. counterfeiting laws to include the holograms used to
authenticate digital media. These "physical features" named in the
original version of the bill have now been expanded to include "any
hologram, watermark, certification, symbol, code, image, sequence of
numbers or letters, or other feature that either individually or in
combination with another feature is used by the respective copyright owner
to verify that a phonorecord, a copy of a computer program, a copy of a
motion picture or other audiovisual work, or documentation or packaging is
not counterfeit or otherwise infringing of any copyright." Namely, most
digital rights management technologies could potentially receive
protection under the new version of the bill. CNET News.com reported that
Biden's bill has broad support in the Senate, although it is unlikely to
come to a vote in the short time left in the current Congressional
session.

o Independent Label Artemis Records Waives Webcasting Royalties

New York -- Independent record label Artemis Records, home to alt-country
artists Steve Earle and Jay Farrar, as well as Warren Zevon and The
Reverend Horton Heat, announced that it will waive royalty fees associated
with webcasting its artists' songs online for the term of one year. The
Librarian of Congress recently set royalty rates for streaming music
online -- which many smaller webcasters have said are too high and may
force them off the air. New York-based Artemis does ask webcasters who
broadcast its music for free to maintain a database of songs played and
other relevant information. "In allowing free use of our catalog at this
early stage we hope to stimulate the Internet radio format, " said Artemis
chairman and CEO Danny Goldberg. "Both [Artemis president] Daniel Glass
and I feel it to be an incredibly worthy marketing and promotional tool."

o Report: Western European DVD Market to Reach $15 Billion by 2006

London -- Western European consumers will spend $5.1 billion on DVDs in
2002, a figure that is expected to increase 150 percent to $15 billion by
2006, according to a report released on Tuesday by market research firm
Screen Digest. The firm predicts that volume sales of DVD software in
Western Europe will overtake VHS in 2003, with DVD rental revenue lagging
behind VHS until DVD overtakes the format in 2005. By 2006, 77 percent of
Western European homes are expected to own at least one TV-based device
capable of playing DVDs -- which include game consoles like the
PlayStation 2 and Xbox, which play DVDs -- as well as traditional
standalone DVD players. "The availability of affordably priced DVD Video
players across most European markets has been a major factor in consumers'
rapid take-up of DVD", said Screen Digest's John Miller.

o CNET: RIAA Suffers Denial-of-Service Hacker Attack

Washington -- CNET News.com reported that the Recording Industry
Association of America (RIAA) website was unreachable over the weekend,
due to a denial-of-service hacker attack on its servers. The RIAA last
week endorsed a bill introduced by Rep. Howard Berman (D-Calif.) that
would theoretically allow the RIAA and other copyright owners to perform
similar denial-of-service attacks -- which flood a website or server with
redundant requests for data so that few legitimate requests are allowed
through -- on popular peer-to-peer networks that offer file-sharing
services. "Don't they have something better to do during the summer than
hack our site?" an RIAA representative, who asked not to be identified,
told News.com. "Perhaps it at least took 10 minutes away from stealing
music." No party has claimed responsibility for the denial-of-service
attack, which did no damage to the RIAA's internal network.

o IMG Entertainment Acquires P2P Music Site Songspy.com

Los Angeles -- IMG Entertainment said on Tuesday that it has acquired
Songspy.com, a peer-to-peer file-sharing network that lets users download
music from the Internet. Financial terms of the deal were not disclosed.
The service aims to compensate artists and record labels for the music
offered while remaining free for users to download, raising money for
royalty payments through the sale of merchandise on the site. Consumers
earn "Karma Points" for downloading music, which go towards discounts on
CDs, T-shirts and other items sold by Sonyspy.com. Los Angeles-based IMG
said it should have software in place in three to four months that will
let the company track which songs are downloaded on the service. "We
believe consumers should be able to listen to their favorite artists
before deciding what to buy," said IMG CEO Sherman Shultz. "At the same
time, we recognize that the music industry is entitled to be paid fairly
for creating the music in the first place."

(London) U.K. technology news site TheRegister reported on Tuesday that
the U.K. government has passed a bill that will stiffen the penalties for
those convicted of copyright theft. The new law increases the maximum
penalty from two to ten years, and strengthens police search warrants to
include all copyright offenses, including the possession and sale of
infringing articles/bootlegs. The Copyright etc and Trade Marks (Offences
and Enforcement) Bill passed through Parliament last Friday and will go
into force in the fall.

(Encino, Calif.) The Video Software Dealers Association (VSDA), an
industry trade group, said on Tuesday that as of July 21st, 2002, consumer
spending on DVD rentals has surpassed DVD rentals for the entire year of
2001, both in number of rentals and rental revenues. So far this year,
consumers have spent $1.47 billion renting DVDs, an increase of $7 million
or 5 percent over the $1.40 billion spent in all of 2001. More than 459
million discs in total have been rented this year -- an increase of 15
million, or 3 percent more DVDs than the 444.8 million total rented in
2001.

(Trevose, Pa.) WorldGate, a provider of interactive TV services to cable
TV operators, said on Tuesday that it has partnered with news organization
The Associated Press. AP will provide interactive content to cable TV

(New York) Sirius Satellite Radio, a provider of satellite-delivered
digital radio programming, announced on Tuesday that Sears, Roebuck and
Co. has become a national retailer of Sirius radio receivers.
Installations with listening stations providing samples of Sirius' 100
channels of music and news will be installed in about 850 Sears stores by
August 30.

(San Diego) Sony Online Entertainment said on Tuesday that over 100,000
players were logged in simultaneously over the weekend to play its
massively multiplayer online roleplaying game, "EverQuest." Launched in
March 1999, the game currently claims over 430,000 paying subscribers. "As
we continue to expand EverQuest, most recently launching in the Korean
market, we expect to surpass even greater milestones in the future," said
Sony Online Entertainment COO John Smedley.

has acquired the publishing and distribution rights to "Gungrave," a
third-person action PlayStation 2 title, for the territories of Europe and
