o Sirius Posts Wider Loss, Raises Subscriber Estimates for 2006

New York - Sirius Satellite Radio on Tuesday reported a wider loss for its second quarter than a year ago, but raised its subscriber forecast for the year. Sirius lost $237.8 million during the quarter, compared with a loss of $177.6 million in the same period a year ago, while posting revenue of $150.1 million for the quarter, compared with $52.2 million a year ago. The company added 600,460 new subscribers, ending the quarter with a total of 4.7 million subscribers; rival XM Satellite Radio said last week that it now counts 7 million subscribers. Sirius raised its 2006 subscriber forecast to 6.3 million, from 6.2 million, while XM for the second time lowered its subscriber forecasts last week. Sirius CEO Mel Karamazin also said in a conference call that the company plans to introduce a "personal live satellite radio product" by the end of the summer, Reuters reported.

o Minnesota Judge Overturns Violent Video Game Sales Law

Washington - A Minnesota judge has overturned a law banning the sale of violent video games to minors passed by lawmakers in the state, ruling the law to be unconstitutional. "This ruling is of particular interest because lawmakers tried to skirt the First Amendment issue by fining minors themselves for buying the games, not retailers, as they have tried in other states," said Doug Lowenstein, president of the video game industry's Entertainment Software Association. "We will move immediately for reimbursement of the substantial legal fees incurred in this court fight." Courts have consistently ruled similar video game sales bans in a number of states to be unconstitutional. "There is no showing whatsoever that video games, in the absence of other violent media, cause even the slightest injury to children," Chief District Judge James Rosenbaum wrote in his ruling.

o Adelphia Closes $12.5 Billion Asset Sale to Comcast, Time Warner Cable

Greenwood Village, Calif. - Bankrupt cable TV provider Adelphia announced on Tuesday that it has completed the sale of its assets to Time Warner Cable and Comcast for a combined $12.5 billion in cash, and about 16% of Time Warner Cable equity. The company's 4.8 million customers will now be distributed between Time Warner Cable and Comcast. "We should take this opportunity to thank Adelphia's employees who had the faith to endure through four years of uncertainty and whose hard work significantly increased values to our creditors and delivered much-improved cable systems to our buyers," said Adelphia chairman and CEO William Schleyer.

o Court Tosses Parts of French Copyright Law on iTunes-Type Services

San Francisco - A French copyright law that initially would have forced Apple and others to open their digital music stores to competitors' devices has seen several of its sections declared unconstitutional, CNET News.com reported. Unlike the initial version, the law now prohibits the circumventing of digital rights management by individuals in order to create interoperability between services, instead creating a digital rights management licensing authority empowered to order interoperability. The law now also states that companies must be fairly compensated for opening their security schemes. Another section of the original law, which would have eliminated potential jail time for file-swappers and instead impose set fines for uploading and downloading, has also been ruled unconstitutional. "Everyone has lost out," Lionel Thoumyre, of French artists' rights organization Spedidam, told News.com. "The real problem, sharing copyright-protected work, hasn't been solved." The law as it stands will now either be enacted by President Jacques Chirac, or sent back to parliament for changes.

o On Command Settles Trade Secret Dispute With NXTV

Denver, Colo. - On Command, a provider of in-room interactive entertainment systems to hotels, announced on Tuesday that it has settled a trade secret dispute against rival NXTV. On Command alleged that NXTV was in possession of its customer database, and had been using it for years to target its customers as agreements came up for renewal. The lawsuit revealed this allegation to be true. Under the settlement, NXTV will pay On Command $950,000; it also imposes anti-solicitation restrictions on NXTV until 2011.

o DreamWorks, Mark Burnett, AOL Partner on Online Game

Glendale, Calif. - DreamWorks Animation and Aardman Features announced on Tuesday that they have partnered with Mark Burnett Productions and AOL to create an online game featuring custom animation integration from DreamWorks' upcoming animated feature, "Flushed Away." The "Flushed Away Underground Adventure" online game will be offered for free on AOL beginning in October, in advance of the film's debut in theaters Nov. 3. The game, similar to the "Gold Rush" interactive treasure hunt developed by AOL and Mark Burnett Productions, will challenge kids and their parents to solve online puzzles to win digital prizes. The game will feature new character animation designed exclusively for the game by DreamWorks and Aardman, including real-time 3D environments that allow players to take control of the camera and explore the underground city of "Flushed Away."

o RoyaltyShare Launches Online Royalty Management Service

San Diego - RoyaltyShare, a provider of Web-based services that provide management of mechanical and artist royalties for sound recordings, announced on Tuesday the official launch of its service for record labels and music distributors. The service charges no upfront or set-up fees to clients, who are billed 1.5% of all royalty revenues from sales of content on services like iTunes, Rhapsody and eMusic processed by the company. San Diego-based RoyaltyShare said that KOCH Entertainment Distribution is among its initial clients.

o Visual Effects Firm Digital Domain Gets $31 Million Investment

Venice, Calif. - Digital Domain, a digital effects studio that has worked on films including "Titanic," "The Day After Tomorrow" and "I, Robot," announced on Tuesday that it has received a $31 million investment from Falcon Investment Advisors and GunnAllen Financial. Venice, Calif.-based Digital Domain's co-chairmen include director Michael Bay ("Bad Boys," "The Rock," "Armageddon"). "Having completed this round of financing, we are now in a position to make the substantial technology investments that will enable us to bring breakthroughs like photo-realistic, computer-generated human beings within reach of a wide range of feature film, video game, and advertising applications," said Digital Domain CEO Carl Stork. The company will use the funds to retire debt, and to invest in its feature film, TV commercial and digital visual effects software businesses.

Sony on Tuesday introduced a new line of flash-based Walkman digital music players, the NW-E Series, which will ship to retailers in August. TiVo, a provider of digital video recorder services, on Tuesday announced an agreement with electronics retailer RadioShack, which will now carry the TiVo Series2 Dual Tuner DVR and TiVo Wireless G Adapter in more than 3,000 of its U.S. retail stores, and on its website. o AT&T to Stream Live Webcasts of Lollapalooza

AT&T announced on Tuesday that it will provide live daily webcasts of performances from the Lollapalooza music festival in Chicago this week. o XM Satellite Radio Expands Traffic Information Service to New Markets

Washington -
XM Satellite Radio, a provider of satellite radio service to nearly 6.9 million subscribers, said on Tuesday that it plans to launch its satellite traffic information service, in 13 more U.S. markets during the third quarter. The new markets, including the Norfolk, Virginia Beach and Newport News area, increase the service's coverage area to 44 markets. XM's NavTraffic service, which costs a $3.99 a month when packaged with XM's $12.95 standard subscription, delivers real-time traffic information to vehicle navigation systems. Drivers see current traffic conditions on a screen, such as traffic speeds, accident locations and road closings.

iBiquity Digital, the developer of digital HD radio broadcasting, said on Tuesday that it has expanded its automotive team to support the implementation of HD radios in new vehicles. The moves come two months after iBiquity signed a deal with Sanyo Trading to expand its presence with Japanese automakers.
