o AOL Parent to Pay $2.4 Billion to Settle Shareholder Suit

Dulles, Va. -- Marking its latest attempt to quell the memories of an infamous five-year-old merger, media giant Time Warner said on Wednesday that it has agreed to pay $2.4 billion to settle a class action suit filed by angry shareholders after the company's 2000 merger with America Online. All told, the company said that it has set aside $3 billion to cover settlement-related expenses. "Reaching an agreement in principle to settle this securities litigation and reserving for it and all other related matters mark important steps toward putting these matters behind us," said Dick Person's the company's chairman and CEO. "By working to resolve these issues now, we're aiming to avoid the costs, risks and distractions of protracted litigation." In recent months, Time Warner has increasingly tried to separate itself from its underperforming AOL unit, even dropping AOL from its corporate name. In the most recent quarter, America Online lost 917,000 subscribers to fall to 20.8 million, with revenue falling 4% despite a healthy spike in advertising revenue.

o U.K. Record Industry Sues Five Internet Song-Swappers

London -- The British Phonographic Industry (BPI) announced that it has filed the first copyright infringement lawsuits against Internet song-swappers in the U.K. The suits were filed in the U.K. High Court, against five individuals who collectively were offering 8,906 songs for download. The BPI said the five have declined since April to settle charges brought against them. The cases were the subject of a March 11 court order, which requires U.K. Internet service providers to provide the identities of suspected file-swappers to copyright holders, as they are required to in the U.S. "So far 60 U.K. Internet users have settled legal claims against them for illegal file-sharing, paying up to $11,500 in compensation," said BPI general counsel Geoff Taylor. "We have tried to agree fair settlements, but if people refuse to deal with the evidence against them, then the law must take its course… We will be seeking an injunction and full damages for the losses they have caused, in addition to the considerable legal costs we are incurring as a result of their illegal activity."

o RealNetworks Reports Q2 Profit; Paid Subscribers Hit 2 Million

Seattle -- RealNetworks, a provider of media delivery technology and audio and video subscription services, announced that it made a second quarter net profit of $4.7 million, as revenue rose 26% to $82.7 million. The profit compares with a loss of $4.7 million and revenue of $65.5 million during the same period a year ago. The company said it ended the quarter with 2 million subscribers to its premium services, of which 1.15 million were subscribed to its premium digital music services -- Rhapsody and Radio Pass. Revenue at RealNetworks' music division for the quarter grew 61% to $24.1 million, while its video games unit saw a 63% sales increase, to $13.6 million. "With increased profitability, record revenue and a base of more than 2 million paid subscribers, we continue to make solid progress," said RealNetworks chairman and CEO Rob Glaser. The company also reported $4.7 million in court costs related to its ongoing $1 billion antitrust lawsuit against Microsoft.

o Howard Stern Signs Subscription Video-on-Demand Deal with In Demand

New York -- Radio personality Howard Stern, who signed a $500 million deal to move his show off of traditional radio and onto Sirius Satellite Radio, announced on Wednesday an additional agreement with In Demand, to offer his program on TV via subscription video-on-demand. The three-year deal, financial terms of which were not disclosed, will make In Demand the exclusive TV outlet for Stern's weekday program. Viewers will be able to watch episodes of Stern's show at their leisure by adding a flat subscription fee to their monthly cable TV bill. "By providing Howard Stern's show in a subscription VOD format, this content will be available to only those viewers that make an affirmative decision to view it, with the benefit of parental controls tools from their television provider," said In Demand president and CEO Rob Jacobson. New York-based In Demand said that Comcast, Time Warner Cable and Cox -- which jointly own In Demand -- have agreed to offer the subscription video-on-demand service, adding that it is also negotiating with other potential distributors.

o MobiTV Signs Satellite Deal to Launch in Canada, Europe, Latin America

Berkeley, Calif. -- MobiTV, a mobile phone TV network, announced on Wednesday that it has signed an agreement with global satellite services firm SES Americom that will enable MobiTV to deliver TV programming via satellite to cell phone owners in Canada, Europe and Latin America. Financial terms of the multi-year agreement were not disclosed. Berkeley, Calif.-based MobiTV offers a mobile TV service featuring content from ABC, NBC, ESPN, Fox, Major League Baseball and The Discovery Channel, which is currently available in the U.S. for Sprint and Cingular subscribers, and also on certain networks in the U.K. and Latin America. "As a leading international satellite distribution platform, SES brings the facilities, relationships and expertise to help MobiTV deliver mobile television to a global audience," said Alan Moskowitz, director of product development for MobiTV. "This infrastructure is a critical enabler of our upcoming launches in Canada, Europe, and Latin America."

o Online Gambling Firm Sportingbet Buys ISC for $27 Million

London -- Sportingbet, a U.K.-based Internet gambling firm, announced that it has acquired ISC Entertainment, an Antigua-based operator of gambling websites focused on the U.S. market, for approximately $27 million. Sportingbet said it would raise half the total by issuing about 2.7 million shares and pay the other half in cash. The company also said that it intended to use ISC's websites to drive further business to its own Paradise Poker brand. "ISC is a high-quality business, and the acquisition is a strong addition to our existing U.S.-facing brands," said Sportingbet CEO Nigel Payne. "With almost no integration required and solid organic growth prospects, we look forward to developing ISC's brands within our industry leading portfolio."

o Wireless Content Distributor WideRay Raises $10 Million

San Francisco -- WideRay, a developer of hardware that lets retailers and content providers wirelessly distribute digital media and promotional content to mobile devices, said on Wednesday that it has raised $10 million in its third round of funding. New investor Enterprise Partners Venture Capital led the round, with additional backing from previous investor Sequoia Capital and other private investors. San Francisco-based WideRay said that it will use the funds primarily to pursue new customers and capitalize on the accelerated demand for its technology. The company recently opened a European office in London and hired two senior-level executives in marketing and engineering. WideRay's customers include TeliaSonera, EB Games, GM, Nokia and Microsoft.

Moscow -- Russian PC game publisher Buka Entertainment announced that it has raised several million dollars through equity investments from Finam Investment Company and Norum, which now own 52.9% of the company. Buka claims to represent 12% of the total Russian video game market, and has distributed games in 70 countries and 15 languages. Moscow-based Buka will use the funds to publish a greater number of PC games, and to expand its distribution network.

o Approximately One Blog Created Every Second, Report Says

London -- According to the latest State of the Blogosphere report by Technorati, more than 80,000 web logs, or "blogs", are created every day -- approximately one every second. Technorati, which runs a search website that tracks the so-called "blogosphere," said that it is currently tracking more than 14.2 million blogs worldwide, a remarkable figure considering the fact that that the total was less than 7.8 million just five months ago. The report showed a sharp increase in the growth of "moblogs," blogs to which people with camera phones send pictures and text, and said that free blogging services like MSN Spaces, Blogger, LiveJournal, AOL Journals, WordPress and Movable Type were also growing quickly. The report also found that the blogosphere is spreading quickly from its traditional based in the U.S., growing rapidly in Brazil, China, France, Korea, Japan and the U.K.
