Service for Copyright Infringement
New York - A group of record labels that includes Sony
BMG, Warner Bros. Records and Virgin Records has filed a copyright
infringement lawsuit against peer-to-peer file-sharing service
LimeWire. Since winning a landmark Supreme Court case in 2005, which
found file-sharing firms Grokster and StreamCast guilty of copyright
infringement, the major labels have sent cease-and-desist letters to
a number of other file-sharing networks, including LimeWire. While
many -- including i2Hub, WinMx, BearShare and, most recently, Kazaa
-- have either shut down or agreed to convert to legitimate
services, LimeWire has continued to operate an unregulated
peer-to-peer network. "Despite numerous efforts to engage LimeWire,
the site's corporate owners have shown insufficient interest in
developing a legal business model," the Recording Industry
Association of America (RIAA) said in a statement. "While other
services have come productively to the table, LimeWire has sat back
and continued to reap profits on the backs of the music community.
That is unfortunate and has left us no choice but to file a lawsuit
to protect the rights and livelihoods of artists, songwriters and
record label employees." The record labels' suit, filed in U.S.
District Court in New York, seeks the maximum damages of $150,000
for every song offered on LimeWire.

Search, Ad Services for MySpace, Other Fox Websites
Mountain View, Calif. - Google announced on Monday that it
has signed a deal with News Corporation's Fox Interactive Media, to
provide search and keyword advertising services for Fox websites
including MySpace.com, IGN.com and RottenTomatoes.com. Under the
deal, which lasts from the fourth quarter of 2006 through the second
quarter of 2010, Google will be obligated to deliver minimum revenue
share payments of $900 million to Fox Interactive Media. In addition
to serving as the exclusive provider of text-based ads, Google will
also have a right of first refusal on display ads sold through third
parties on Fox Interactive Media's network. "Our partnership with
Google underscores News Corp's continued evolution to become a
powerful force in the digital media marketplace. To have come this
far and gained this much momentum in just over a year is truly
remarkable," said News Corp. president and COO Peter Chernin.

Would Mandate Ratings Board Play All New Video Games
Washington - A new bill in the U.S. House would mandate
that the video game industry's ratings board play all video games in
their entirety before issuing its ratings. The Truth in Video Game
Rating Act's sponsors include Reps. Cliff Stearns (R-Fla.), Jim
Matheson (D-Utah) and Mike McIntyre (D-N.C.). Currently, the
industry's voluntary ratings agency -- the Entertainment Software
Ratings Board (ESRB) -- bases its ratings partly on game play but
relies heavily on descriptions submitted by game publishers. The
proposed legislation would also create new penalties for publishers
that withhold or grossly mischaracterize the content in their games,
and asks the Government Accountability Office (GAO) to investigate
the effectiveness of the ESRB.

Distribute Ad-Supported Clips of MTV Networks Series
Mountain View, Calif. - Google announced on Monday that it
has partnered with Viacom's MTV Networks to test online distribution
of ad-supported clips of TV shows, through Google Video and targeted
website publishers. Beginning later this month, clips of shows like
MTV's "Laguna Beach" and Nickelodeon's "SpongeBob SquarePants" will
be made available to Google's AdSense network, which delivers
targeted text and image ads to its network of websites and blogs.
The third-party websites in the AdSense network will be able to add
an MTV-branded video player to their sites, which will offer the 2
to 4-minute licensed videos plus ads sold by MTV. A separate part of
the agreement calls for MTV Networks to begin selling $1.99 episodes
of its TV programs through Google Video on a download-to-own basis.
The deal covers MTVN series including Comedy Central's "Chappelle's
Show" and "South Park"; MTV's "Beavis & Butthead" and "Punk'd";
MTV2's "Wonder Showzen"; Nickelodeon's "Zoey 101"; and The N's
"Beyond the Break."

World Mobile Music Revenue to Reach $14 Billion in 2011
Hampshire, U.K. - Worldwide mobile music revenues will
reach $14 billion in 2011, according to a report from U.K.-based
Juniper Research. The Asia Pacific region is expected to account for
40% of the market, while Europe will represent 27%, North America
18%, and the rest of the world 15% of the market. A significant
shift within the mobile music market, driven by 3G penetration,
adoption of advanced handsets and dual mobile-PC song downloads,
will see full-track downloads gain on ringtones. The market share
for ringtones is expected to fall from 81% today to 51% by 2011,
while full-track downloads will grow from 9% to 32% of the market.
"Until now ringtones have dominated mobile music, but the balance is
shifting. Full track music has been the central offering of many 3G
service launches around the world and as 3G usage gathers pace, the
mobile music market is preparing to enter a new growth phase," said
Juniper research director Bruce Gibson.

Than Half of U.S. Internet Users Visit News Sites in June
Reston, Va. - More than half (54%) of all U.S. Internet
users visited news sites during June, led by Yahoo News, MSNBC and
AOL News, according to new figures released by Internet research
firm comScore Media Metrix. With the exception of Yahoo, each of the
sites among the top 10 have ties to traditional media outlets, the
firm said. "Interestingly, five of the top 10 general news sites
worldwide are operated by U.S.-based companies," said Jack Flanagan,
executive vice president of comScore Media Metrix. "Yahoo News is
the category leader, both domestically and worldwide, while MSNBC
and CNN rank among the top five news sites in the U.S. and among the
worldwide Internet population."

Lands $13.7 Million, Names Ex-Napster Exec as CEO
Herndon, Va. - Ruckus, a provider of digital entertainment
services to college students, said on Monday that it has landed
$13.7 million in its second round of funding and named Michael Bebel,
the former COO of Napster, as its CEO. Battery Ventures, Eastward
Capital, Pinnacle Ventures and Shelter Capital participated in the
round, which the company plans to use to continue building its
business and developing services targeted at the college
demographic. Part of that plan was to bring in Bebel. Aside from his
role at Napster, he also has been the president and CEO of Mashboxx,
and held a number of executive positions with both Universal Music
Group and Universal Studios. With the Ruckus service, students can
legally download music, access movies and exchange and share
downloaded tracks. The company said that it will have more than 70
schools as clients by the start of the fall semester.

Master Recording Ringtones Now 76% of Market
San Francisco - Ringtones of actual clips of master
recordings now account for 76% of the overall music ringtone market,
according to a report from market research firm Telephia. Monophonic
and polyphonic ringtones now represent just 12% of the market, down
from nearly 30% in the third quarter of 2005. Ringback tones, or
music that replaces the standard ring that plays for a caller
dialing a cell phone number, now make up 11.5% of consumer spending
in this category, an increase of almost 50% since last year.
Telephia reports that more than 24.6 million mobile consumers
purchased a ringtone in the second quarter of 2006. "It's no
surprise that mono and polyphonic ringtones have fallen out of favor
with mobile consumers as realtones are a far superior format, much
like how CDs replaced cassette tapes. This is all part of the
broader shift toward consumers expecting their mobile devices to
deliver a high-quality portable music experience," said Kanishka
Agarwal, vice president of new products at Telephia.

Broadband Video Delivery Firm Maven Networks Raises $12 Million
Cambridge, Mass. - Maven Networks, a developer of
broadband video delivery systems, has raised $12 million in its
third round of venture capital, led by Prism Venture Partners.
Massachusetts-based Maven Networks' products allow media companies
to create, manage and deliver broadband video channels that support
direct-to-consumer services and generate new revenue streams. Its
customers include 20th Century Fox, A&E Television Networks
International, Disney Buena Vista Pictures, Hallmark Channel,
National Geographic Channel, Pepsi, Nik, and Sony Pictures. Other
investors in Maven's latest funding round include Accel Partners and
General Catalyst Partners. The company has raised a total of $30
million to date.

Lanham, Md. - Vocus, a provider of on-demand software for

that it has acquired online press release distribution service PRWeb
for $28 million in cash and stock. Maryland-based Vocus said the
purchase will allow its customers to simultaneously deliver press

Content Distributor Mobile Streams Acquires The Nickels Group
London - Mobile Streams, a distributor of mobile music and
media for cell phones, announced on Monday that it has acquired The
Nickels Group, a Manhattan Beach, Calif.-based licensor and
distributor of urban music. Financial terms of the deal were not
disclosed. London-based Mobile Streams and The Nickels Group have
previously partnered to distribute mobile content like music and
reality series for artists including Paul Wall's G.R.I.T. Boys, Tego
Calderon and Voltio. Nickels Group co-founders Jonas Hudson and
Daryl Young will join Mobile Streams as senior vice presidents.
Mobile Streams said the deal will provide control over original

Kissimmee, Fla. - Google currently has no plans to enter the
digital music retail business, an executive told attendees at the
National Association of Recording Merchandisers (NARM) conference
last week, Billboard reported. "We are not going to be selling
music," Chris Sacca, Google's head of business development, said in
a keynote address at the event. "We're already in the music
business, because we're the complement to the offline life," added
Sacca. "After people hear the name 'Gnarls Barkley' their next move
is to go and check on Google for it." The company does sell music
videos, from labels including Sony BMG, through its Google Video
service.

"Castlevania" Animation Rights to Project 51 Productions
Los Angeles - Japanese video game publisher Konami has sold the
animation rights to its "Castlevania" game franchise to Project 51
Productions, according to The Hollywood Reporter. Financial terms of
the deal were not disclosed. Konami's "Castlevania" franchise has
shipped over 20 million units since its U.S. debut in 1987 for the
Nintendo Entertainment System. Project 51 said that potential
productions include theatrical features, direct-to-video films and a
TV series.

Softworks Signs "Star Trek" TV Writers for Video Games
Rockville, Md. - Video game developer and publisher Bethesda
Softworks announced that it has signed "Star Trek" TV writers
Dorothy "D.C." Fontana and Derek Chester to develop the storylines
for its "Star Trek Legacy" and "Star Trek: Tactical Assault" game
titles. Fontana has written for the original "Star Trek" TV series,
in addition to "The Next Generation," "Deep Space Nine" and other
sci-fi properties like "Babylon 5" and "Earth: Final Conflict."
"Star Trek Legacy" will be developed for PC and Xbox 360, while
"Star Trek: Tactical Assault" will be offered for PSP and DS; both
are slated for release in late 2006.

Press: World Series of Poker Mixes Off-line, Online Pros
Las Vegas - The Associated Press on Monday reported on the
relationship between the World Series of Poker, a real-world card
game tournament, and the online gambling sites that have recently
drawn the ire of the U.S. Justice Dept. It is estimated that about
half of the 8,700 players at the event in Las Vegas qualified in
tournaments for cash at sites like PokerStars.com, PartyPoker.com
and Bodog.com -- which the government says are illegal. Since the
Justice Dept. arrested the CEO of an online sportsbook site several
weeks ago as he was traveling in the U.S., Bodog.com founder Calvin
Ayre has stayed put in his native Canada. "I don't believe any
senior executive of any online gaming company is going to be going
into the United States for the foreseeable future," Ayre told AP.
"It's not just me, and I've talked to a lot of them."
