o FCC Votes to Mandate Digital TV Tuners

Washington -- In further efforts to accelerate the transition to digital
TV, the Federal Communications Commission (FCC) on Thursday voted 3-1 to
mandate that all TVs over 13" sold in the U.S. contain a digital TV tuner
by 2007. The FCC also voted unanimously to require that a "broadcast flag"
be inserted into digital broadcasts to prevent unauthorized copying of TV
programs and movies. However, the FCC indicated that the industry has not
agreed on technical details for the broadcast flag, and issued a request
for further comments on specific issues rather than setting a deadline for
programs to include the security technology. "Given digital media's
susceptibility to piracy, the issue of content protection must be resolved
before broadcasters will make new, innovative and expensive digital
content widely available," said FCC Commissioner Michael J. Copps. "Yet a
decade of discussion among the players has yielded no solution. It is time
for a solution. Today's Commission action should make this plain for all
to understand." Groups including the National Association of Broadcasters
hailed the ruling, while consumer groups and manufacturers including the
Consumer Electronics Association decried it. A listing of questions for

o RIAA, Webcasters File Appeals on Streaming Music Royalty Rates

Washington -- Several groups including the Recording Industry Association
of America (RIAA) filed appeals on Wednesday to the Librarian of Congress'
recent decision on what royalty rates webcasters should pay to stream
music online. The RIAA intends to argue in its appeal for higher rates,
saying that the Librarian ignored licensing agreements it had with
webcasters other than Yahoo, an agreement that weighed heavily in the
Librarian's decision. "The Librarian's decision was based on a misguided
reading of the record. The end result significantly undervalued the music
used by Internet radio companies," said RIAA chairman and CEO Hilary
Rosen. The Digital Media Association, which represents a group of
webcasters, filed appeals demanding lower rates, saying that many small
webcasters are and will be going out of business. "There has been no
indication that the RIAA or SoundExchange are seriously interested in
royalty rates that will enable thousands of small webcasters to survive,
or that will enable music lovers to continue enjoying the diverse Internet
radio experience that promotes myriad artists whose music is never
performed on traditional radio."

o RealNetworks Laying Off 10% of Staff

Seattle -- RealNetworks, a provider of media delivery technologies,
announced that it will lay off 10 percent of its staff, or 90 of its 800
employees, as part of a cost-cutting initiative. The company expects to
take a restructuring charge of approximately $4-6 million resulting from
the staff reductions and other related restructuring activities. "The
impact of the on-going turbulence in the telecommunications industry and
the weak capital spending environment on our systems business has caused
us to step back and thoroughly review our strategy and operations," said
RealNetworks chairman and CEO Rob Glaser.

o EMI Sues AOL Time Warner Over Internet Music Royalties

New York -- Major record label EMI Group has sued fellow major record
label-owner AOL Time Warner for copyright infringement, alleging that
songs from movies like "The Wizard of Oz" and "Singin' in the Rain," to
which EMI holds the rights, are being played on the AOL Internet service
without any compensation. The suit also alleges infringement by AOL Time
Warner's Turner Broadcasting network. "We believe that AOL Time Warner,
and a whole bunch of their companies, have been rampantly using our
copyrighted material without licensing it or paying for it," said EMI
Music Publishing chairman and CEO Martin Bandier. The suit relates to
music rights held by movie studio MGM, which is now owned by AOL Time
Warner. EMI says that AOL Time Warner is abusing the limited rights that
the studio holds to the songs for promotions on AOL and Turner
Broadcasting. "Based on the information made public, we see no basis for
the claim," an MGM spokeswoman told Reuters.

o Sprint PCS Launches First U.S. Nationwide 3G Wireless Network

Overland Park, Kan. -- Wireless network operator Sprint PCS announced on
Thursday the launch of its third-generation ("3G") wireless network, the
first of its kind in the U.S. The Sprint "PCS Vision" 3G service will
provide peak data speeds of up to 144 kbps, with average user speeds of
50-70 kbps, anywhere in the country. The company also said that certain
applications, such as accessing or downloading files from the Web, will
experience speeds two to five times greater if a subscriber is using PCS
Vision-enabled devices. Rival Verizon Wireless has also launched 3G
wireless services in the U.S., but its service is not yet available
nationwide.

(Loveland, Colo.) The DVD+RW Alliance, a trade group of PC, optical
storage and consumer electronics manufacturers that support the DVD+RW
format, said on Thursday that it has released specifications for 4x DVD+R
recording speeds and for 8cm DVD+RW/+R media. The first specification will
allow drives to record at 44 megabits per second, taking less than 15
minutes to record a full capacity DVD+RW/+R disc. The second specification
is a smaller-sized, 1.46GB-capacity disc format -- as opposed to the
standard 12cm, 4.7GB format -- designed for mobile devices such as digital

"Halo: Combat Evolved" and "Project Gotham Racing" titles for the Xbox
