Fantasy Sports Data is Public Domain
St. Louis - A federal judge has ruled against the Major
League Baseball Players Association (MLBPA) and Major League
Baseball Advanced Media (MLBAM), saying that baseball statistics are
in the public domain and may be freely used by providers of fantasy
sports games. U.S. District Court Judge Mary Ann Medler sided with
St. Louis-based CDM Fantasy Sports, which filed the lawsuit against
the players' organization and new media unit of Major League
Baseball. CDM was among a number of fantasy sports games providers
who were not granted a license renewal, following the signing of a
$50 million deal between the league's new media unit and players'
organization. MLBAM sent cease-and-desist letters to several fantasy
sports providers who continued to use player statistics without a
license. "We are disappointed by the court's decision yesterday in
CBC v. MLBPA and MLBAM," the two groups said in a statement. "We
expect to appeal the decision and remain confident that we will
prevail in that effort. We continue to believe that the use of the
players, without their consent, to create this type of commercial
venture is improper."

Gamblers Facing Hard Time Retrieving Deposits
New York - Since U.S. authorities arrested the CEO of
online sports betting site BetOnSports.com and announced they are
seeking the forfeiture of $4.5 billion in illegal gains from the
company, U.S. residents who placed wagers with the site have had a
difficult time retrieving their money, the Associated Press
reported. A U.S. Attorney told AP that a federal restraining order
requires the company to return the money. While an executive with
the firm told AP that returning the funds is the company's
intention, some online payment processors have stopped doing
business with BetOnSports, leading the executive to add that the
company is in "a difficult position," and has no way to return the
bulk of money to U.S. online gamblers. Prosecutors told AP that 97%
of wagers at BetOnSports were made on American football, basketball
and baseball, and that almost all of the Costa Rica-based company's
business came from U.S. residents.

Orders Illinois to Pay $500K in Attorney's Fees to Video Game
Industry
Washington - The State of Illinois has been ordered by a
federal judge to pay the video game industry over $500,000 in
attorney's fees, to compensate for the industry's legal expenses in
suing the state to have a law banning the sale of violent games to
minors overturned. U.S. District Judge Matthew F. Kennelly, who
ruled that the law enacted by Illinois lawmakers was
unconstitutional on First Amendment free speech grounds, ordered the
state to pay the fees to the Entertainment Software Association (ESA),
Video Software Dealers Association and Illinois Retail Merchants
Association. "Judge Kennelly's rulings send two irrefutable messages
-- not only are efforts to ban the sale of violent video games
clearly unconstitutional, they are a waste of taxpayer dollars,"
said Douglas Lowenstein, president of the ESA, the trade group
representing U.S. computer and video game publishers. "Taxpayers
have a right to know that over half a million of their dollars and
countless government hours were thrown away in this fruitless
effort."

Arts Faces Shareholder Suit Over Stock Option Grants
Redwood City, Calif. - Video game publisher Electronic
Arts announced on Thursday that it has been sued by a group of
shareholders over its past granting of stock options. The lawsuit
comes as fellow game publishers Take-Two, Activision and THQ all
announced having received inquiries from the SEC regarding their
stock options grants. The SEC said it is investigating more than 80
companies over the practice of "backdating," or changing the date on
which past stock options were granted in order to increase their
value. The suit against Electronic Arts was filed in San Mateo,
Calif. superior court by a pension fund that also previously sued
Apple over stock options grants.

to Launch XM Satellite Radio Channels on Mobile Phones
Washington - Alltel Wireless said on Thursday that it has
signed a deal to become the first wireless carrier to give
subscribers access to programming from XM Satellite Radio through
their cell phones. Through the deal, Alltel subscribers will be able
to gain access to audio streams of 20 XM music channels for an extra
$7.99 a month. Information such as song title, artist and album will
appear on compatible handsets. The application was developed by
MobiTV, a provider of television and digital radio services for
cellular, Wi-Fi and broadband devices.

Grants Approval to Resume Production of Sirius Radios
New York - Sirius Satellite Radio, a subscription radio
service with 4.7 million subscribers, announced on Thursday that one
of its manufacturing partners has resumed production of Sirius
radios with FM transmitters, after receiving new grants of authority
from the FCC. The FCC had previously declared that some radios from
both Sirius and rival XM violated its emissions standards. New
York-based Sirius said that Korea's Kiryung Electronics has
re-started production of its Xact Visor, Sirius One and Sportster
Replay radios.

Licenses Tracks to Qtrax Ad-Supported File-Sharing Service
New York - EMI Music Publishing, which holds the
copyrights to over one million songs, announced on Thursday that it
has licensed its compositions to Brilliant Technologies, for
listening and download on the company's Qtrax ad-supported
peer-to-peer file-sharing service. Financial terms of the deal were
not disclosed. Qtrax has also secured licensing agreements with BMI
and the Association of Independent Music, but has yet to reach deals
with any major record labels except EMI Recorded Music. EMI Music Publishing's sister record
label has also licensed its tracks to Mashboxx, another legal
file-sharing service that has yet to launch. Brilliant Technologies
plans to allow Qtrax users to download unlimited tracks in exchange
for viewing ads when it launches in the fourth quarter.

Indianapolis, Ind. - Sony Online Entertainment (SOE), the
company's online games unit that operates massively multiplayer
titles like "EverQuest" and "PlanetSide," announced on Thursday that
it has acquired key assets of World Apart Productions, a developer
of online trading card games. Financial terms of the deal were not
disclosed. Key World Apart employees will form the core of Sony
Online's new studio in Denver, where World Apart is based. World
Apart's CTP (Collect Trade Play) Platform can be used to develop
online collectible object-based games, such as the company's "Star
Chamber." Sony Online said the technology has the ability to
integrate board or card games into existing SOE titles.

Silver Spring, Md. - A year after its initial public
offering (IPO), the share price of Worldspace, a provider of
satellite radio service to international markets, fell 31% on
Thursday, reaching a new 52-week low of $2.26. The sharp decline
came after the company released worse-than-expected quarterly
results on Wednesday with a loss of $36 million. Silver Spring,
Md.-based Worldspace raised over $100 million through its IPO last
August, pricing its shares at $21 per share. The company was founded
in 1990 by Noah Samara, its chairman and CEO, with a focus on
providing digital satellite audio, data and multimedia services in
Africa and Asia. Samara was an early backer of XM Satellite Radio.
