o Report: Strong Summer Video Game
Sales Continue; Up 29% in July
New York - Video game sales rose 29% in July, adding to a
stronger-than-expected summer for an industry that had been
experiencing a sales slump, according to sales data compiled market
research firm NPD Group. Game hardware sales grew 46% to $214.7
million in July, while sales of game software were up 22% to $386.4
million, and video game accessories sales rose 23% to $83.5 million.
"The premium pricing of the Xbox 360 contributed significantly to
the dollar sales increase in console hardware," said NPD video game
analyst Anita Frazier. The overall top-selling hardware in terms of
units during July was Nintendo's DS handheld; "NCAA Football '07"
for PlayStation 2 from Electronic Arts was the best selling game.

o CEA to Explore
Possible Spring 2007 Video Game Expo
Arlington, Va. - Less than two weeks after the
Entertainment Software Association announced plans to radically
downsize its annual E3 video game expo, the Consumer Electronics
Association (CEA) said that it is forming an advisory committee to
explore its own gaming event next spring. The event, focused on the
gaming and entertainment marketplace, would likely take place in
either Las Vegas or Los Angeles. CEA said that a majority of the
2,700 exhibitors at its annual International Consumer Electronics
Show (CES) are active in both the entertainment and gaming
categories. "Since ESA decided to eliminate the E3 event in its
known format, we have been deluged with inquiries on whether we
could fill the tradeshow needs of smaller video entertainment
companies," said Gary Shapiro, the president and CEO of the CEA.
"Our executive board met (Thursday) and unanimously asked staff to
explore ways that we can help the gaming community."

o Studios
Approve Burn-to-DVD Movie Downloads With Encryption Upgrade
Morgan Hill, Calif. - Hollywood movie studios will soon
allow downloaded movies to be burned to DVD, following changes made
to the encryption technology used to protect DVD movies from piracy.
The DVD Copy Control Association (DVD CCA), an industry group that
devised the Content Scramble System (CSS) encryption that protects
DVDs from unauthorized copying, said that movies will be able to be
burned to special blank DVD discs that utilize an upgraded version
of CSS. "Allowing the creation of high performance, protected DVDs
in the business or at home that, until now, could only be
mass-produced in factories is another major step forward," said DVD
CCA chairman Chris Cookson. In addition to burn-to-DVD movie
downloads, the association said an early commercial application of
the new technology would enable kiosks in retail stores, where
consumers make a selection of some form of video entertainment, and
wait while the disc is burned for them in the store. Recently, movie
download site CinemaNow launched a test of a service that allows
consumers to burn some downloaded films from its library to DVD.

o With Former
CEO in Jail, BetOnSports Closes U.S. 'Net Gambling Business
London - Online gambling site BetOnSports.com, whose CEO
was arrested last month by U.S. authorities on racketeering charges,
announced on Friday that it will shutter its U.S. business, which
provided most of its profits, Reuters reported. Nearly 800 employees
at the company's operations in Costa Rica and Antigua will be laid
off in connection with the closure. BetOnSports CEO David Carruthers
and others with the company have pleaded not guilty to all charges,
after the U.S. indicted Carruthers and others with the company under
U.S. laws that the government says prohibit online gambling. The
company, which terminated Carruthers as CEO following his arrest,
said that it will take time to pay off creditors, staff salaries and
deposits by U.S. customers because several monetary institutions --
including its online payment processors -- have ceased doing
business with BetOnSports.

o RIAA
Drops File-Sharing Lawsuit Against Wi-Fi Network User
Los Angeles - The Recording Industry Association of
America (RIAA) was recently compelled to drop one of its copyright
infringement lawsuits against an alleged file-swapper, after the
defendant argued that the RIAA could not definitively prove she was
the person who illegally shared music files online. Palm Desert,
Calif. resident Tammie Marson and attorney Seyamack Kouretchian of
Coast Law Group made two arguments in Virgin v. Marson: since she
was a cheerleading teacher and had many teenagers in her house, it
could have been one of them using file-sharing networks; more
interestingly, Marson's computer was also connected to an unsecured
Wi-Fi network, meaning any neighbors or someone else within range
could have used the account to share music. "The best they could
ever prove was somebody had used Tammie Marson's internet account to
download the music or make it available," Kouretchian told Out-Law.com.

o XM Says
FCC Seeks More Information About Radio Emissions
Washington - More than three months after first learning
that some of its radios were not in compliance with federal
emissions standards, XM Satellite Radio, a provider of satellite
radio service to more than 7 million subscribers, said on Friday
that the Federal Communications Commission (FCC) has requested
additional information about several of the devices. The company
said that the FCC is seeking "the chronology and circumstances
leading to the non-compliance, and actions and remedies undertaken
to correct the situation." XM said that it will respond promptly,
and has implemented a program to bring its radios into compliance.
Yesterday, rival Sirius Satellite Radio -- which was also notified
by the FCC of emissions violations by some of its radios -- said
that at least one manufacturer had re-started production of the
radios in question after alterations had passed FCC approval.

o Apple
Receives Nasdaq Delisting Notice
Cupertino, Calif. - In the midst of its internal
investigation into accounting irregularities related to stock option
grants, Apple said on Friday that it has received a delisting notice
from the Nasdaq for failing to file its quarterly report on time.
The company said that it will request a hearing to keep its listing.
Apple announced in late June that it discovered accounting errors
related to the issuance of stock option grants between 1997-2001.
The company said that it plans to file its quarterly report
following the completion of an investigation by a special committee
of its outside directors.

o Former
Virgin Digital Execs Launch Wilshire Media Group
Los Angeles - A pair of former Virgin Digital executives
on Friday announced the launch of Wilshire Media Group, a company
that will offer media firms consulting and software development
services. Former Virgin Digital president Zack Zalon and chief
technology officer Brendon Cassidy said that Virgin Entertainment
Worldwide will be the new company's first client. Los Angeles-based
Wilshire Media Group will aid in development and execution of
technical business strategies, digital content creation, software
application development, digital rights management (DRM), commerce
and micro-payment systems, media database management, and consumer
marketing for these applications. The company said it will also
develop entirely new products and businesses, both independently and
in partnership with other companies. "We built a unique skill-set
leading Virgin's digital efforts, designing and building end-to-end
technology solutions for media commerce and entertainment. We are
now able to leverage that expertise to provide media companies the
solutions necessary to stay on top of the ever-changing digital
landscape," said Cassidy.

o Report:
U.S. Computer Use Second Only to TV Among Electronic Media
Muncie, Ind. - Americans now spend more time using
computers -- the majority of the time at work -- than any other
electronic media except television, according to a new study from
Ball State University's Center for Media Design (CMD). "While well
over half of all media use is in the home, more than two-thirds of
all computer use is at work," said Robert Papper, a
telecommunications professor and member of CMD's research team. "The
television dominates at home, radio dominates the car and the
computer dominates the workplace." The report found computer users
spent 56% of time online compared to 44% of time using software;
while online, 54.8% used Web browsers while 37.7% accessed e-mail
and 7.6% used instant messaging. More than 22% of online computer
use and 44% of software use at home was found to be work related;
however, more than 44% of online computer use at work did not appear
to be work related. "It is a device used for work, communications,
accessing information, and learning -- and it is increasingly used
for entertainment," said Mike Bloxham, CMD's director of insight and
research. "It has managed to achieve this in a relatively short
period of time of about 20 years. This is a noteworthy achievement
for a new device in the average office and home."

Interview With 1st Jailed Blogger Josh Wolf
San Francisco - CNET News.com on Friday published an interview
with 24-year-old freelance journalist Josh Wolf, the first known
blogger to be sent to prison for not cooperating with a federal
prosecution. Wolf was jailed for refusing to turn over video footage
shot at a G8 protest in San Francisco during which a police car was
set on fire; the federal government says it has jurisdiction over
the matter because part of the car was paid for with federal
dollars. "When I went in and began documenting this movement, I gave
my word to numerous people that I would only publish what my
discretion allowed and beyond that would not turn over additional
material," Wolf told News.com. "I do feel it may be a political
