o Congressmen Ask Attorney General to Prosecute P2P Networks, Users

Washington -- Nineteen U.S. Congressmen signed a letter that was sent to
John Ashcroft on July 25, asking the U.S. Attorney General to prosecute
peer-to-peer file-sharing networks such as Kazaa and Morpheus, as well as
those who use the services to download songs, movies and other copyrighted
content. Lawmakers also asked that the Justice Department generally spend
more of its resources on regulating copyrights on the Internet. The
bipartisan letter was hailed by the recording industry. "There is no
doubt, mass copying off the Internet is illegal and deserves to be a high
priority for the Department of Justice," said RIAA chairman and CEO Hilary
Rosen. "It poses a real threat to the vitality and economic growth of a
number of leading U.S. industries and ultimately hurts consumers by
undermining the creators' incentive to bring new works to the market."
Sen. Dianne Feinstein (D-Ca.), Rep. Howard Coble (R-N.C.), Rep. James
Sensenbrenner (R-Wisc.) and Rep. John Conyers (D-Mich.) were among those
to sign the letter.

o Napster Assets to Sell At Aug. 27 Auction; Creditors Soliciting Bids

Costa Mesa, Calif. -- The "Official Committee of Unsecured Creditors of
Napster," appointed by the judge overseeing the company's bankruptcy
hearing, has hired the investment bank of Trenwith Securities to aid it in
soliciting bids for the assets of the controversial file-sharing service.
Any bidders must work quickly to submit proposals by August 21, 2002 for
the asset auction, which will commence on August 27. "These assets should
be particularly attractive to: entertainment companies, media content and
broadband providers, music and online retailers, online portals, and any
other entity that can benefit from gaining direct access to potentially
millions of consumers," said Rick Chance, managing director investment
banking at Trenwith Securities. The Associated Press reported that
Bertelsmann has promised to bid an additional $9 million for the company
at auction, bringing its total offer to over $100 million. The creditors'
committee told the AP it thinks the bankruptcy judge may not count much of
Bertelsmann's initial $85 million in loans as part of its bid, lowering
the level of a winning bid to as little as $25 million.

o Report: U.S. Broadband Subscribers Climb to 13.5 Million

Durham, N.H. -- The number of broadband Internet subscribers in the U.S.
grew by 1.37 million in the second quarter of 2002 to reach 13.5 million,
according to a report released on Monday by New Hampshire-based Leichtman
Research Group. The report also shows cable-based broadband services, as
opposed to DSL, command 65 percent of the total market. In the past
quarter, the top cable companies added over 900,000 broadband Internet
subscribers compared to 460,000 broadband subscribers added by the major
DSL providers over the same time period; past year figures indicate cable
companies added over 3.5 million subscribers, while DSL providers added
1.9 million. "High speed Internet growth was clearly a bright spot in an
otherwise very challenging quarter for the cable industry," said Bruce
Leichtman, president and principal analyst for Leichtman Research Group.
"Cable continues to grow its high speed Internet base, and strongly
outpaces DSL providers in adding new subscribers."

Los Angeles -- Tonos Entertainment, an online musicians' network,

EMI Music, DreamWorks Publishing, Chrysalis Music and Famous Music shortly
after announcing similar deals with a number of major record labels. To
qualify for consideration for the deals, artists must be subscribed to the
company's TonosPRO service, which costs $100 annually or $11.95 each
