o Report: Downloading Not Responsible for 15% Drop in Record Sales

Cambridge, Mass. -- Despite reports from the recording industry, online
music piracy is not the root cause of a 15 percent decline in record sales
over the past two years, according to a report released on Tuesday by
Massachusetts-based Forrester Research. On the contrary, the firm predicts
that by the year 2007, digital music revenues from legitimate services
will reach $2 billion -- representing 17 percent of the music business.
"There is no denying that times are tough for the music business, but not
because of downloading. Based on surveys of 1,000 online consumers, we see
no evidence of decreased CD buying among frequent digital music
consumers," said Josh Bernoff, principal analyst at Forrester. "Plenty of
other causes are viable, including the economic recession and competition
from surging video game and DVD sales. But labels will soon discover that
there are several simple ways of satisfying today's sophisticated digital
music consumers." Forrester predicts a struggle for legitimate label
subscription services over the next two years, due to licensing
difficulties, but by 2005 labels will endorse a standard download contract
that supports burning and a greater range of devices.

o Microsoft to Launch Xbox Live Online Game Service in November

Redmond, Wash. -- Microsoft announced on Tuesday that it will launch its
Xbox Live online gaming service on Nov. 15, one year after the launch of
its Xbox video game console. The company said 5,000 North American retail
outlets will sell the $49.95 Xbox Live Starter Kit, which includes a
one-year subscription to the broadband-only service, the Xbox Communicator
headset, and a minigame so gamers can start playing with their friends
right away. At least seven Xbox Live-enabled games are currently scheduled
to be available on Nov. 15, with up to 10 more to follow by the end of the
holiday season. The service will be supported by datacenters in Seattle,
London and Tokyo that will enable Microsoft to assist publishers by
managing hosting, networking, security and billing. The company said it
will announce plans for the launch of Xbox Live in Japan and Europe in the
coming months.

o Report: Content Sites See Increased Ad Sales in Second Quarter

New York -- A number of the leading online content sites reported ad sales
were up by an average of 34.2 percent compared to the same quarter last
year, according to a poll conducted by the Online Publishers Association
(OPA) of its member companies. The report, which included data from sites
like Boston.com, ESPN.com, FoodTV.com, NYTimes.com, USAToday.com and Wall Street Journal Online, found that year-to-date ad revenue grew an average
of 33.5 percent compared to the same period last year. In addition, total
revenue among this group increased an average of 36.1 percent in the
second quarter of this year compared to the same quarter last year, with
year-to-date revenue growing an average of 33.7 percent. "The focus on
industry-wide Internet ad sales figures masks the important trend we're
witnessing, which indicates that advertisers are seeking out strongly
branded media sites for their online ad placements," said Michael
Zimbalist, executive director of the Online Publishers
Association. "Advertisers are beginning to realize that high-quality
content sites, with their rich editorial environments and loyal audiences,
provide significant return on media spending."

o Vivendi Forms Black Label Games Development Studio

Los Angeles -- Vivendi Universal Publishing announced on Tuesday the
formation of Black Label Games, a new video game development studio for
the company's global games division, Vivendi Universal Games. Black Label,
which will focus on games for "teen-to-mature audiences", joins fellow VU
Games units Blizzard Entertainment, NDA Productions, Sierra Entertainment
and Universal Interactive. Vivendi named former Universal Interactive
marketing head Torrie Dorrell as general manager of Black Label Games. The
first titles due under Black Label Games include "The Thing," a sequel to
John Carpenter's 1982 film of the same name, and "The Lord of The Rings:
Fellowship of the Ring."

o Spoken-Word Provider MediaBay Sues Audiogalaxy File-Sharing Service

Cedar Knolls, N.J. -- MediaBay, a provider of spoken-word audio content,
announced on Tuesday that it has sued file-sharing service Audiogalaxy for
contributory and vicarious copyright infringement and unfair competition.
The suit was filed last month in the United States District Court for the
Southern District of New York. New Jersey-based MediaBay holds the rights
to distribute a library of classic radio shows and other spoken-word
content it claims was made available on the file-sharing network. In June,
Audiogalaxy settled a similar lawsuit brought by the Recording Industry
Association of America (RIAA) and music publishers, paid out undisclosed
damages and agreed to ask permission from copyright holders in the future
before making songs available on its service. "Audiogalaxy's file-sharing
system has enabled MediaBay's classic radio programs to be traded without
our permission and is an infringement of our rights and the rights of the
many talented individuals who created these timeless programs," said
MediaBay CEO Michael Herrick.

company claimed 6,510 subscribers for its 100-channel, $12.95 per month
service. New York-Sirius had 3,347 subscribers the day before its service
became available nationwide on July 1, 2002. Rival XM Satellite Radio
reported 136,718 subscribers to its service for the second quarter ended
June 30.
