o Report: P2P File-Sharing to Peak in 2005 With 7.4 Billion Song Downloads

Boston -- The popularity of downloading music from peer-to-peer
file-sharing services such as Kazaa and Morpheus is expected to continue
to grow until 2005, when legitimate services finally present a more
compelling offer to consumers. Boston-based research firm Yankee Group
predicts that consumers will download 7.44 billion audio files in 2005,
before that number declines to 3.90 billion in 2007. The firm reports that
consumers aged 14 and older downloaded 5.16 billion audio files in the
U.S. via unlicensed file-sharing services in 2001. "Efforts by the record
labels to use the courts to quash music piracy have failed and legitimate
online music services have had little impact," said Yankee Group senior
analyst Michael Goodman. "The future of music, however, resides on the
Internet, and its dramatically lower distribution costs." Yankee Group
says that in order to be successful, legitimate services must offer: the
availability of all labels' music; ownership rather than rental of songs;
portability of songs; exclusive content not available on unlicensed
services; and a way for consumers to share music with one another.

o Consumers May Not Be Heard in ReplayTV Copyright Case

Los Angeles -- A federal judge has indicated she may not allow owners of
ReplayTV personal video recorders and the Electronic Frontier Foundation,
the digital civil liberties group representing them, to join ReplayTV
maker Sonicblue's legal battle against TV networks and movie studios that
allege the device facilitates copyright infringement. CNET News.com
reports that U.S. District Court Judge Florence-Marie Cooper "has not
issued a decision but did write a tentative order denying a request to
dismiss the case. In that same order she also granted a motion to stay the
case and denied a motion to consolidate the case." Several ReplayTV
owners, including Craigslist.com founder Craig Newberg, wished to provide
a consumers' viewpoint in the case -- arguing to protect their rights to
record TV programs and skip over commercials. Newberg told News.com a
decision from the judge may come yet this week.

o Report: Digital Video Recorder Sales Growth Lagging

London -- A recent report indicates that sales of digital video recorders,
which allow viewers to pause and record live TV shows, are progressing
more slowly than originally projected. According to U.K.-based media
research firm Screen Digest, the devices currently reside in 2.3 million
U.S. homes, a number that will rise to 15.3 million by 2006. But that
level is far below original forecasts that the devices would be in 20 to
50 million U.S. homes by 2005. Screen Digest also predicts that the
standalone market for digital video recorders, made by firms including
TiVo and Sonicblue, will see their market share erode from the current 35
percent to 19 percent by 2006, due to competition from satellite and cable
firms bundling the functionality with their digital set-top boxes.

o ArtistDirect to Up Investment, Receive Extra Stake in Record Label

Los Angeles -- ArtistDirect, an online music network, record label and
provider of music marketing services, announced on Wednesday that its
board has approved a plan to accelerate a funding arrangement with its
ArtistDirect record label, providing an additional $10 million in exchange
for an extra 20 percent stake in the label. ArtistDirect Records is a
joint venture between ArtistDirect, company chairman and CEO Ted Field,
and major record label BMG Entertainment. The label is home to fourteen
artists including Badly Drawn Boy, Blood Brothers and Custom. The new
agreement would be in addition to the original $15 million the company
provided the label, and would result in ArtistDirect increasing its stake
to 65 percent while CEO Ted Field's stake would decrease from 50 to 35
percent. Los Angeles-based ArtistDirect expects that to keep the label in
business, it will have to provide an additional $2.75 million in 2003 and
approximately $12.0 million in 2004.

o Report: European Digital, Interactive TV Revenues Up 31%

London -- In spite of the high-profile closure of European digital TV
services such as ITVDigital and Quiero, consumers are expected to spend
$13.4 billion on digital and interactive television services in 2002, a 31
percent increase over 2001, according to a report released on Wednesday by
U.K.-based research firm Strategy Analytics. Revenues from interactive
services are still limited and will be outpaced by premium content
subscriptions, but will grow significantly over the next six years, the
firm predicts. "Consumers are clearly unaffected by the doom and gloom
within the digital TV industry," said Strategy Analytics' Nick Griffiths.
Revenue from satellite platforms, like BSkyB and Canal Plus, will reach
$9.8 billion this year, and $23.8 billion by 2008. However, cable
operators will take an increasing share of the market once the industry
consolidates and upgrades to digital. By 2008, Strategy Analytics predicts
that cable will be the leading platform, accounting for 45 percent of
total revenues.

Wednesday that it has partnered with Los Angeles-based Lieberman Research
Worldwide to create a DVR-based research panel for marketers and
advertisers. The opt-in "Hotline2Hollyood" service lets TiVo owners
participate in surveys to test movie trailers, promos for TV shows and new
advertising campaigns. "We're going to be able to offer leading marketers
the opportunity to get almost immediate feedback from a discriminating
audience that can view video broadcast to their TiVo," said Brodie Keast,
general manager and senior vice president for the TiVo Service. "At the
same time, we'll be offering our audience a sneak peak at promotions for

software firm Scaraboo and phone maker Siemens to develop a wireless
wagering service that lets bettors place wagers after an event has already
started. The technology was introduced at the World Cup, where Germans
could use their phones to bet on the outcome of a match already underway.
The service mixes the ability of cell phones to send email with software
that determines "dynamic odds" that change as a sporting event progresses.
The service is unlikely to make it out of Europe, though, as wagering over
the phone is illegal in the U.S.
