o EFF Pushing for FTC Investigation Into Privacy Practices of AOL

Dulles, Va. - The Electronic Frontier Foundation (EFF), a digital civil liberties group, has asked the Federal Trade Commission (FTC) to investigate AOL after the company recently released three months worth of search queries by 650,000 of its users. The EFF said that it wants the FTC to require AOL to notify affected customers, as well as to stop logging search data except where absolutely necessary. "Though AOL has removed the data from its site and rightly apologized, the grave damage is already done," the EFF said on its web site. "AOL's actions demonstrate a shocking disregard for user privacy. Search terms can expose the most intimate details of a person's life." Though the data was linked only to random ID numbers, the EFF said that the information could still be connected back to individual users "given enough clues."

o InterActiveCorp Acquires Majority Stake in CollegeHumor.com

New York - IAC/InterActiveCorp, whose holdings include Ticketmaster, Citysearch, Match.com and Evite, announced on Tuesday that it has acquired a majority interest in Connected Ventures, the parent company of comedy site CollegeHumor.com. Financial terms of the deal were not disclosed. Founded in 1999, New York-based CollegeHumor offers videos, pictures, articles and jokes to an audience of more than 6 million monthly users; the company is also developing a film for Paramount Pictures. CollegeHumor founders Josh Abramson and Ricky Van Veen will continue to oversee operations at the company. "With its distinct brand of humor, CollegeHumor has emerged as a viral success with an enormously loyal audience among young adults," said Michael Jackson, president of IAC Programming.

o New Report Predicts Grim Times Ahead for Newspaper Industry

Burlingame, Calif. - The newspaper industry will experience a $20 billion revenue shortfall by 2010, according to a new report by Outsell, a provider of research and advisory services to the information industry. "The estimated shortfall is even larger than newspaper executives have acknowledged," says Ken Doctor, the firm's lead analyst. "The perfect storm of print circulation decline, accompanying pressures on print advertising and the rapid growth of lower-revenue-producing online news media is eroding the industry." The firm said that the decline of paid circulation revenues will speed up as 18-to-39 year-olds continue to look online for news, with total daily circulation dropping to as low as 43.9 million by 2010, nearly 20% less than 2004. Outsell also said that online revenues aren't replacing lost print revenues fast enough, and that workforce cuts, already underway, are insufficient to meet the accelerating financial challenges.

o Apple Seeks Trademark Relief from Makers of "Pod" Products

San Francisco - Seeking to crack down on copycats utilizing its trademarks, Apple has sent cease-and-desist letters to a number of companies it says make unfair use of the word "pod" in their product names, CNET News.com reported. One target of the letters was TightPod, a maker of laptop covers. Another is a vending machine accessory from Mach5products.com called Profit Pod. Both companies have been asked to rename their products. The maker of TightPod devices is considering going to court, but also offered to remove any reference to MP3 players, while asking that Apple pay half the cost of rebranding his product. The text of the cease-and-desist letter sent by Apple's attorneys to Mach5products.com reads in part: "We believe there is confusing similarity between Apple's iPod mark and the Profit Pod mark…it has not gone unnoticed that, like Apple's iPod device, the Profit Pod product is a small, flat, round-cornered rectangular device with a display screen."

o Altnet Sues Fellow File-Sharing Firm StreamCast for Patent Infringement

Sydney, Australia - Altnet, a unit of Sharman Networks -- which recently settled copyright infringement claims with the music industry over its Kazaa file-sharing network -- announced on Tuesday that it has filed patent infringement claims against fellow file-sharing firm StreamCast Networks. In the case filed in U.S. District Court in Los Angeles, Altnet alleges that StreamCast and its CEO, Michael Weiss, are intentionally infringing on the company's "TrueNames" file identification patents, which Altnet said are used in each of the 144 million copies of StreamCast's Morpheus file-sharing application downloaded by users. Altnet is seeking an injunction against StreamCast, and treble damages because of willful infringement of its patents. "StreamCast's brazen patent piracy underpins its massive copyright infringement business. They are simply running out of opportunities to go legal," said Altnet spokesman Michael Speck. As part of its settlement with the record labels, Altnet parent Sharman Networks is attempting to launch a legitimate version of its file-sharing service.

o Google Maps Adds Printable Online Coupons from Valpak

Mountain View, Calif. - Google on Tuesday launched a new feature that will allow users of its Google Maps service to print online coupons for local businesses. The company said that it has partnered with direct marketing company Valpak, which will provide coupons for its current clients. New coupons will be added on a nightly basis. The service will be free for Valpak advertisers, as well as those printing the coupons.

o Online Game Publisher WildTangent Gets Strategic Investment from WPP

Redmond, Wash. - Online game publisher WildTangent announced on Tuesday that it has received an undisclosed strategic investment from WPP, which owns a number of large advertising and public relations agencies. New York-based WPP said that its investment will enhance its clients' ability to utilize WildTangent's video game advertising network, which includes the company's own titles in addition to games from Nickelodeon and Walt Disney Internet Group. Redmond, Wash.-based WildTangent bundles its game titles with over 85% of all new PCs sold annually in North America. "Our clients are increasingly looking for ways to reach their customers online, particularly the harder to reach young adult demographic, and in-game advertising is of growing interest," said Mark Read, director of strategy and CEO of WPP.com. "WildTangent's strong track record in game distribution and advertising makes them an attractive partner for us and for our clients."

New York - PixFusion, a provider of personalized branded video products and services, announced on Tuesday that it has raised $4.2 million in its first round of venture capital financing, led by Mercury Capital Partners with participation from Stonehenge Capital Company. Founded in 2001, New York-based PixFusion's Kideo service allows consumers to insert a picture of child or grandchild into an entertainment DVD that features animated characters like Dora the Explorer and Arthur -- from partners Nickelodeon and WGBH Educational Foundation, respectively. o BET Networks, Film Roman Partner on Multi-Platform Animation Series

Viacom's BET Networks announced on Tuesday that its new animation division has signed a three-year agreement with animation studio Film Roman ("The Simpsons," "King of the Hill"), to produce a slate of animated films and series for the Internet, broadband and mobile applications. "There will be shorts that will air throughout our programming schedule as well as online content. Hopefully, by fall of next year, we'll begin to launch our animated series," said BET president of entertainment Reginald Hudlin. The company also recently signed agreements with Vin Diesel to develop an animated series, and with Black-owned comic publisher Milestone Media to create a new action adventure series.

Cable TV provider Charter Communications announced on Tuesday that it has launched the ResearchChannel video-on-demand service for its subscribers. The New York Times on Tuesday reported on the behavioral marketing tactics employed on the Internet, in the wake of AOL's accidental publishing online of the search queries entered by over 650,000 of its users over three months. In addition to AOL, firms including MSN and Yahoo also track the search queries entered by users to target them with ads.
