o Video-on-Demand Server Firm MidStream Raises $26 Million

Bellevue, Wash. -- MidStream Technologies, a developer of broadcast
quality video-on-demand server equipment, announced on Monday that it has
raised $26 million in its third round of venture capital financing. New
investor Canaan Venture Partners led the round, joining other new
investors Frazier Technology Ventures, ProVen Private Equity, and The
University of North Carolina, and previous investors Polaris Venture
Partners, ARCH Venture Partners, Xilinx and Fluke Ventures.
Washington-based MidStream's servers are used to deliver video-on-demand,
a service that lets cable and satellite TV viewers view movies and other
content at their leisure with VCR capabilities. In June, the company
announced that Spyglass Integration would integrate its video-on-demand
servers with the Motorola set-top boxes it offers cable TV operators.
MidStream said it will use the funds for product development, in addition
to business development and sales and marketing efforts.

o Record Labels Sue ISPs to Block Users' Access to Music Download Site

New York -- Several major U.S. record labels have sued a number of
Internet service providers, asking them to block U.S. users' access to a
website based in China that offers unauthorized downloads of major label
artists' songs. Filed in federal court in Manhattan by labels including
Universal Music Group, Sony Music Entertainment, Bertelsmann's RCA and
Warner Bros. Records, the suit asks ISPs including AT&T Broadband, Cable &
Wireless, Sprint, Advanced Network Services and UUNet to block its
subscribers' access to a site called Listen4Ever. The record label
plaintiffs say in the suit that they have not been able to determine the
owner of the site, but allege that, "Listen4ever has clearly located
itself in China to avoid the ambit of United States copyright law."

o Judge Orders ReplayTV Owners' Suit Added to Networks' Copyright Claims

Los Angeles -- A federal judge has combined a lawsuit brought by five
ReplayTV digital video recorder owners -- asking the court to validate
their use of the device to skip commercials and share programs with
friends -- with a suit brought by major TV networks and movie studios
against the device's manufacturer, Sonicblue, for copyright infringement.
The ruling comes as somewhat of a surprise, as earlier last week the judge
had indicated she would not allow the cases to be combined. Judge Florence
Cooper also denied a motion from the studios and networks to dismiss the
suit, brought by Craigslist founder Craig Newmark and four other ReplayTV
owners, who are being represented by the Electronic Frontier Foundation.
"The issue of whether the Newmark Plaintiffs' use of the ReplayTV DVRs'
send-show and commercial-skipping features constitutes fair use will most
likely figure prominently in both the ReplayTV action and the Newmark
action," wrote Judge Cooper in her opinion.

o Vivendi Confirms Talks On Sale of Vizzavi Stake to Vodafone

Paris -- Debt-laden media conglomerate Vivendi Universal confirmed on
Monday that it is currently in talks with European telecom Vodafone to
possibly sell part or its entire stake in the two companies' Vizzavi joint
venture back to Vodafone. Launched in May 2000, Vizzavi operates Web
portals for wireless devices and PCs in the U.K., Portugal, Spain, France,
Germany, Italy, Greece and the Netherlands. "As a result of these
discussions, certain filings are being made with competition authorities
in various territories. This does not indicate the conclusion of any
discussions currently taking place, and no further comment will be made by
either party unless and until such a conclusion is reached," Vivendi said
in a statement.

(Atlanta) Internet service provider EarthLink on Monday released new
software for its subscribers that blocks the increasingly prominent
"pop-up" advertisements that open a new browser window containing an ad
while a user is surfing the Internet. Atlanta-based EarthLink claims to be
the first ISP to offer such a service. Users also have the ability to set
up the software to allow friendly pop-ups that commonly are served on bank
or fantasy sports sites to come through.

(Austin, Texas) BroadJump, a provider of software installation services
for broadband Internet access providers, announced on Monday an agreement
with Listen.com for distribution of the company's Rhapsody digital music
subscription service. Under the agreement, an offer for the Rhapsody
service will be included with the installation software Texas-based
BroadJump provides to broadband Internet service providers. BroadJump
reports that to date, six million residential broadband subscribers have
used its software to install their broadband connections, including
customers of Time Warner Cable, SBC Communications, Road Runner, Cox,
Charter, BellSouth and Adelphia.

signed an agreement with independent record label Edel Music. Under the
terms, multiple artists from the label will use New York-based Digital
World Services' BeFANatic fan-focused online subscription service. The
service offers members exclusive news, images, artist diaries and chats,
in addition to downloadable unpublished recordings and live music cuts
protected with Digital World Services' digital rights management. The sale
of exclusive fan merchandise and tickets is planned after launch.

(Washington) XM Satellite Radio, a provider of satellite-delivered digital
radio programming, announced on Monday that it has partnered with Baron
Services, a provider of analytical weather services to the TV broadcast
and emergency management industries. Under the agreement, the two
companies will create a graphical weather data feed that can be received
by XM subscribers. The service, expected to launch within a year, will be
targeted to marine and aviation customers, as well as those listening on
the ground.

(San Francisco) CNET News.com reported on Monday on the action that search
engine providers are taking at the behest of the Federal Trade Commission
to separate their regular search results from paid listings that appear
along with them. A letter sent by the FTC to many search engine providers
last month asked them to demarcate paid listings more clearly or else face
possible action. Since then, providers including Terra Lycos, Ask Jeeves,
AOL and MSN have made changes regarding how paid listings appear in their
search results.

(Washington) The Chronicle of Higher Education recently reported on how
many college radio webcasters are being compelled to shut down their
streams in light of the recent ruling from the Librarian of Congress on
how much such stations must pay to stream music online. San Jose State
University's KSJS-FM shut down its webcast signal in January to avoid the
fees. "As soon as I saw the suggested rates, I thought, 'I don't even want
to play this game anymore,'" KSJS general manager Nick Martinez told The
Chronicle.
