o Record Industry Sees Fewer CD Shipments in First Half of Year

Washington -- Domestic shipments of CDs from record labels to retail
stores dropped 5.3 percent in the first half of 2001 as compared with the
same period a year ago, according to mid-year figures released Tuesday by
the Recording Industry Association of America (RIAA). The total value of
the CDs shipped to retailers fell from $6.2 billion at this point last
year to $5.9 billion the first half of this year -- a decline of 4.4
percent. CDs represented about 90 percent of all units shipped; sales of
cassettes dropped off 41.9 percent compared to last year, while vinyl
sales increased 3.3 percent. "Our companies recognize the fact that more
consumers are looking to get music on-line and are experimenting with a
number of approaches, including legitimate subscription services," said
RIAA CEO Hilary Rosen. "We are committed to delivering the music consumers
love when they want it and how they want it. We are confident that our
year-end numbers will be strong."

o Fifty-two Independent Music Publishers Sue MP3.com for Infringement

San Diego -- Digital music distributor MP3.com, was recently purchased by
Vivendi Universal for $372 million, has been sued by Copyright.net Music
Publishing and 51 other independent music publishers for copyright
infringement, The San Jose Mercury News reported Tuesday. The suit --
which seeks $25 million in damages -- claims that MP3.com's streaming
service did not seek permission from the music publishers before
distributing around 1,000 songs to which they owned the copyrights. San
Diego-based MP3.com faces similar suits from a number of indie labels, and
has already paid out about $163 million in damages to major record labels
and music publishers for infringements relating to its My.MP3.com service.

o Musician Peter Gabriel Launches Subscription Music Service

London -- Peter Gabriel, the one-time bandmate of Phil Collins in Genesis
and solo artist known for his collaborations with world music performers,
has announced the launch of a digital music subscription service. The
$7.20 per month service will give users the choice of 40 tracks from
Gabriel, his Real World Records label -- featuring an assortment of world
music artists -- as well as music labels Telstar, Edel and those
represented by the Association of Independent Music (AIM). "The Internet
is allowing small, independent and minority interest music makers to be on
a level playing field with the big guys," said Gabriel. "I am always happy
to see David come home ahead of Goliath." The tracks will be deleted each
month and replaced by 40 new tracks, although users have the option to
purchase a permanent version of any song. Tracks can be played on a PC or
portable player, but may not be transferred to a different PC. A free

o Digital Jukebox Maker TouchTunes Secures $5 Million Loan

Las Vegas -- TouchTunes, a maker of coin-operated, digital music-based
jukeboxes, said that it has secured a $5 million loan -- $3 million of
which came from CDP Capital Communications and $2 million from CDP
Sofinov. Las Vegas-based TouchTunes also reported a 42 percent increase in
revenues as well as decreased losses for the current financial quarter.
The company has agreements with record labels including Capitol, BMG,
Universal, Warner and their music subsidiaries to provide digitized music
to businesses that use their jukeboxes.

Tuesday that IBM will use its technology on chips it makes for use in
set-top boxes designed to deliver interactive TV services. The
PowerPC-based IBM chips can be used by different device manufacturers, and

(New York) Pressplay, a music subscription service joint venture between
Sony Music and Universal Music Group, said on Tuesday that is has
appointed Glenn Kaino as executive vice president, head of programming and
creative director; Deborah Newman as senior vice president of marketing;
and Alex Luke as vice president of music programming. Kaino was previously
head of programming and creative director for Universal's online music
site Jimmy and Doug's Farmclub.com; Newman was most recently vice
president of strategic marketing for Chicago-based subscription service
FullAudio; and Luke has served as program and music director at various
radio stations, in addition to launching entertainment trading platform
Spun.com. The Pressplay service is expected to launch yet this summer.

(New York) MTV said on Tuesday that it has recruited wireless ad firm
SkyGo to develop wireless advertisements for its upcoming Music Video
Awards. The ads will tie into the online, print and broadcast ads prior to

use software developed by Massachusetts-based IntraLearn Software to run
the world's first online music school, which Berklee plans to launch in

(Austin, Texas) The game developers who designed "Max Payne" have launched
SubstanceTV, a DVD videomagazine that the company says will "deliver
high-quality video content that transcends the sound-bite mentality of
today's mass media and uses advanced technology to examine the human
condition through digital eyes." The company chose the DVD format to
address the 25 percent of households with access to DVD hardware, which
include DVD players and computer DVD drives. Eleven two-hour long issues
will be available for a subscription price of $14.95; each issue will
consist of four to six "features" that combine multimedia elements.

network, has launched a contest on its site that lets users edit video to
create a video remix of hip hop artist Ludacris's single, "Area Codes."

the "Video Cut Creator" contest on BET.com.
