o Radio Station Website Developer LMiV to Shut Down

Indianapolis -- Local Media Internet Venture (LMiV), a company created two
years ago by a group of large radio station owners to create websites for
their stations, announced that it will shut down at the end of September.
The company -- which launched with $37 million from its backers -- pointed
to its inability to attract additional radio stations to the network, the
newly set royalty rates for streaming and the advertising climate as
reasons for its closure. "Unfortunately, the fundamental change in the
economic viability of streaming and the recession in the broadcast
advertising market have conspired to cause many radio stations to reduce
the resources they are allocating to their interactive efforts," said LMiV
president and CEO Jack Swarbrick. "As we continued to encounter
prospective customers who loved our product but couldn't find the funds in
the 2003 budget to become an affiliate, we knew that it was time to shut
down LmiV." LmiV was a joint venture between radio station owners
Bonneville, Corus, Emmis, Entercom and Jefferson-Pilot Communications. The
company said responsibility for maintaining station websites will revert
back to individual stations.

o Judge Rules Against BT Hyperlink Patent

London -- British Telecom (BT) has lost a patent infringement lawsuit it
filed against Internet access provider Prodigy Communications, in which BT
claimed that Prodigy's use of "hyperlinks" -- common to the functionality
of the entire Internet -- was infringement and warranted licensing the
technology from BT. ZDNet U.K. reported that U.S. District Judge Colleen
McMahon awarded Prodigy its motion for summary judgment to have the case
dismissed, saying that no jury could find that Prodigy infringes the
patent. BT, which was issued the U.S. patent in 1989, planned to charge
Internet service providers that host websites containing hyperlinks --
essentially all of them -- a license fee for using the technology.

o No New Napster Bidders Emerge; Bertelsmann In Line to Take Over

Los Angeles -- No new bidders for the assets of file-sharing service
Napster emerged before a Wednesday deadline, making Bertelsmann the prime
candidate to acquire the assets of the company as early as next week, The
Los Angeles Times reported. A committee of unsecured creditors of the
company had tried to solicit bidders other than Bertelsmann, asking for a
minimum of $25 million compared to Bertelsmann's claimed bid of over $100
million -- including loans of around $85 million to Napster to develop a
paid membership service. "Given the time frame, I think we did everything
humanly possible," Rick Chance, managing director of Trenwith Securities,
the company hired to solicit additional bidders, told The Times.
Bertelsmann's plans for Napster remain unclear; former CEO Thomas
Middlehoff, who had championed the company's involvement with Napster, was
ousted from the company last month.

o Digital Cinema Developer World Theatre Gets Patent, Seeks Funding

Raleigh, N.C. -- World Theatre Inc., a developer of digital content
delivery and management systems, announced that it has been granted a U.S.
patent covering its business method for distributing and scheduling
digital movie content to cinemas and electronic billboards. The company
has raised $30 million in debt and equity so far, and said it has hired
Credit Suisse First Boston as its financial advisor for a second round of
venture capital. North Carolina-based World Theatre announced a license
agreement with BMG North America last October. The company is headed by
Robert Summer, the former president of Sony Music and RCA Records.
