o Apple Pays Creative $100 Million to Settle MP3 Player Patent Dispute

Cupertino, Calif. - Apple and rival MP3 player maker Creative Technology announced that they have settled all outstanding patent litigation between the companies, with Apple agreeing to pay Creative $100 million. Singapore-based Creative, which has U.S. operations in Milpitas, Calif., sued Apple in June, alleging the company's iPods used patented song navigation technology found on Creative's Zen line of MP3 players. Creative also filed a complaint with the U.S. International Trade Commission, asking for an injunction against the import of Apple's iPods from their Asian manufacturing plants into the U.S. The settlement, which halts Creative's patent suits against Apple, Apple's countersuits and the ITC complaint, includes a license for Apple to use Creative's patented technologies in all Apple products. Creative also joins Apple's "Made for iPod" program and plans to release a line of accessories later this year. "Creative is very fortunate to have been granted this early patent," said Apple CEO Steve Jobs. "This settlement resolves all of our differences with Creative, including the five lawsuits currently pending between the companies, and removes the uncertainty and distraction of prolonged litigation."

o AOL Launches Movie Download Service

Dulles, Va. - AOL said on Thursday that it has launched a new movie download service through partnerships with 20th Century Fox, Sony Pictures Home Entertainment, Universal Pictures and Warner Bros. Home Entertainment Group. The films -- from recent DVD releases to a large selection of older titles -- will be available through AOL's video portal from $9.99-$19.99 each. Once downloaded, movies can be viewed offline as well as on other PCs and compatible portable devices. The new partnerships complement the more than 17 video content partnerships and more than 45 on-demand channels that AOL Video announced in July.

o Apple Recalls 1.8 Million Notebook Batteries

Cupertino, Calif. - Just a week after Dell's major recall of notebook computer batteries,
Apple on Thursday followed suit, announcing plans to recalls 1.8 million lithium-ion batteries manufactured by Sony. The Consumer Product Safety Commission said that the batteries, used in 12-inch iBook G4, 12-inch PowerBook G4 and 15-inch PowerBook G4 models, can "overheat, posing a fire hazard to consumers." The commission said that Apple has received nine reports of batteries overheating, including two reports of minor burns from handling overheated computers. No serious injuries were reported. About 1.1 million of the batteries were in notebooks sold in the U.S., with the other 700,000 sold abroad. Just last week, Dell recalled 4.1 million of its lithium-ion batteries.

o Cox to Deploy TiVo Digital Video Recorder Software

Alviso, Calif. - TiVo, the maker of digital video recorders, announced on Thursday that it has signed an agreement with Cox Communications, the nation's fourth-largest cable TV provider, to customize its digital video recorder software for deployment on Cox digital video recorder set-tops. Cox Digital Cable subscribers with digital video recorder service will be given the option to subscribe to TiVo, and the TiVo software will be pushed to their existing digital video recorder set-tops. The service is expected to launch in select Cox markets in the first half of 2007.

o Report: Nearly 13.5 Million Wireless Users Downloaded Games Last Quarter

San Francisco - Nearly 13.5 million mobile subscribers downloaded a game during the most recent quarter, an increase of 15% from the third quarter of last year, according to a report from market research firm Telephia. During that same period, monthly revenue jumped 63%. "In less than a year, average monthly mobile game revenues have increased by nearly two-thirds," said Kanishka Agarwal, the vice president of new products at Telephia. "Backed by an increasingly growing audience, both big gaming brands and new upstarts have taken a slice of that revenue pie." Top games last quarter in terms of revenue share were "Tetris" by EA Mobile, "Pac-Man" by Namco and "Bejeweled" by EA Mobile.

o 85 Public Radio Stations Awarded $7.74 Million for Digital Transition

Washington - The Corporation for Public Broadcasting (CPB) announced on Thursday that it has awarded $7.74 million in new grants to 85 public radio stations transitioning to digital broadcasting technology. The grants come from the roughly $220 million Congress has earmarked to help public radio and TV stations transition to digital. Since 2002, CPB has distributed grants to 540 public radio and 324 public TV stations. "Building on support from Congress, state governments and local communities across the nation, these critical grants will help ensure the success of public radio's digital transition and new and better radio broadcast service for the communities these stations are connected to," said CPB president and CEO Patricia Harrison.

o Microsoft Scores Next-Gen Soccer Game Exclusives for Xbox 360

Leipzig, Germany - Microsoft announced this week from the Leipzig Games Convention that its Xbox 360 will be the only next-generation video game console that versions of both Electronic Arts' "FIFA 07" and Konami's "Pro Evolution Soccer 6" soccer titles will be available on for the next 12 months. The deal means the two top-selling soccer franchises will not be available for the Sony PlayStation 3 for at least a year, although versions will be released for both PlayStation 2 and Sony PSP. "FIFA 07" for Xbox 360 is slated for release on Sept. 29, while "Pro Evolution Soccer 6" will come later in October.

o Intel Capital Invests in Asian Video-on-Demand Firm Anytime

Singapore - Anytime, a Singapore-based provider of video-on-demand programming over IPTV, broadband and digital cable networks in the Asia Pacific region, announced on Thursday that it has received an undisclosed sum from Intel Capital. The company's other investors include Fox, Sony and Warner Bros. Anytime has existing carriage deals in Australia, Hong Kong, Taiwan and Thailand, and the rights to license into 14 territories in Asia Pacific. The company also announced plans to launch Anytime TV, a new on-demand portal that will deliver Hollywood movies, TV shows, music videos and premium games throughout the region. Anytime said the investment from Intel Capital will accelerate the availability of its service via the Internet to homes in the Asia Pacific region.

CBS has signed agreements with Warner Bros. Television and 20th Century Fox Television to add several primetime CBS shows to its Innertube free TV streaming site, TVWeek.com reported. Fox will offer episodes of its CBS series "Shark," "How I Met Your Mother" and "The Unit" on Innertube, while Warner Bros. will provide episodes of "The Class," "Smith" and "The New Adventures of Old Christine." The promotional deal gives CBS the rights to offer the first four episodes of each series on Innertube for a week following their initial broadcasts.

o Nintendo Plans Two New Colors for DS Lite Handheld

Redmond, Wash. - Nintendo on Thursday announced plans to introduce two new colors for its DS Lite handheld game system. The Onyx and Coral Pink DS Lite systems will join existing white units at retailers on Sept. 13. Nintendo added that its "New Super Mario Bros." title for the DS platform has now sold 1 million units in just over three months.

MP3tunes, a provider of online digital music services, on Thursday launched Oboe Free, a free online locker service that offers personal storage for up to 1,000 songs. "Oboe customers are discovering the importance of enjoying their own music through their mobile phone, DVR or computers," said MP3tunes CEO Michael Robertson. Oboe includes Ajax-based music manager software that lets users pause, skip, repeat tracks, shuffle, create playlists, label music and control volume all directly within the Web page. The company also offers Oboe Basic, which upgrades to a 2,000-song capacity for $19.95 per year, and Oboe Premium, which offers unlimited storage for $39.95 per year.

o DirecTV Adds Interactive Features to NFL Sunday Ticket Service

Satellite TV provider DirecTV on Thursday announced the launch of several new interactive features for subscribers to its NFL Sunday Ticket service. "Player Tracker" allows viewers to track up to nine NFL players throughout the day via real-time on-screen alerts, sent anytime a player does anything of significance, as well as a "My Players" overlay that lists up-to-the-minute stats for their players. DirecTV also added new on-demand team stats, including first downs, third-down efficiency, interceptions/interception yards and fumbles/fumbles lost. The DirecTV NFL Sunday Ticket is being offered in a bundle with four free months of free premium programming, for four payments of $69.

French consumer electronics maker Archos on Thursday introduced two new large-screen portable media players. The $299 Archos 404 features a 3.5-inch screen, while the $349 Archos 604 sports a 4.3-inch display. Both players can function as portable digital video recorders, support movie downloads from online services, include a PDF viewer, and can store up to 30 movies, 130 hours of TV programming, 300,000 photos or 15,000 songs. Archos is now accepting pre-orders now and will begin shipping the products in early September.

o WIRED: Beck Talks Multi-Platform Releases, YouTube Videos

San Francisco -
The latest issue of WIRED magazine features an interview with recording artist Beck, in which he discusses the multi-platform (Internet leaks, official CD, deluxe CD/DVD, fan mashups, remix album) releases of his last album, Guero, and forthcoming follow-up scheduled for release in the fall. Beck plans to release a version of his new record on YouTube that features 15 low-budget, impromptu videos shot to accompany the songs. "The whole idea behind making videos is to get them out there for people to see. They don't really play videos on TV anymore, so I have no problem with people putting them online," Beck told WIRED.
