o Excite@Home Receives Demand for Repayment of Notes
Redwood City, Calif. -- Broadband service provider Excite@Home said on
Monday that it has received a demand from two of its creditors for
repayment of a $50 million loan by Aug. 31. Promethan Investment Group --
one of the creditors -- said that Excite@Home "breached certain
representations" at the time that the notes were issued. Redwood
City-
based Excite@Home said in a statement that "if the company were
required
to make payments at this time, it would have a materially adverse impact
on the company's liquidity and its ability to fund its operations."
The
company said last week that Promethean Investment Group asserted it would
ask for repayment of its loan if the company’s stock were delisted from
the Nasdaq. Shares of Excite@Home have traded below the Nasdaq’s $1
minimum since mid-August. The company previously stated that it has only
enough cash to sustain operations through the end of the year.

o Korean File-Sharing Site Ordered to Pay for Copyright Infringements
Seoul, South Korea -- A Korean website that let users trade songs and
music videos has been ordered to pay two record labels damages for
copyright infringement, the Associated Press reported on Monday. Seoul-
based music site Internet Empire was ordered to pay damages of $76,800 to
music labels World Music Entertainment and Most Best Music. The company
has not yet decided whether to appeal the ruling. "We had operated
the site
to help spread the Internet in South Korea," said Internet Empire
spokesman Yoo Jung-mok. "It's regretful that we are depicted as
criminals." The Recording Industry Association of Korea recently
indicted
the operators of Soribada -- another Korean file-sharing service -- on
charges of copyright infringement.

o Seagate, Thomson Multimedia Enter Personal Video Recorder Market
San Jose, Calif. -- CacheVision, a joint venture between Seagate
Technology and Thomson multimedia, announced on Monday that it will become
a supplier of hardware and software for personal video recorders to
consumer electronics manufacturers and TV service operators. The company
joins TiVo, Microsoft’s UltimateTV and Sonicblue -- which acquired the
assets of ReplayTV -- in the market for supplying consumers with devices
that let them pause and record live television. San Jose-based CacheVision
said it will offer manufacturers, cable and satellite operators that use
its technology additional features to add to their personal video
recorders, such as t-commerce services, targeted advertising, video-on-
demand and audio jukeboxes.

o California DeCSS Case Returns to Court
San Francisco -- The Ninth Circuit Court of Appeals in San Francisco
heard
arguments last week in a case that centers around DeCSS, a computer
program that can break the encryption security on DVD discs. The DVD Copy
Control Association (DVDCCA) was granted a preliminary injunction against
several publishers who posted the code on their websites or otherwise
distributed the material. An appeal was filed on behalf of the
publishers by the Electronic Frontier Foundation and the First Amendment
Project. During the hearing last week, the EFF argued that the injunction
forced the defendants to edit their websites. "Our argument is
whenever
you are forcing somebody to edit their Web site, the First Amendment has
to be applied -- and the [lower court] didn't apply it," said EFF
Legal Director Cindy Cohn. Cohn told CNET that a ruling in the matter
should come within three months.

o Sony Removes R-Rated Movie Trailer from Website
Los Angeles -- Sony Pictures said that it removed an R-rated trailer
from
one of its promotional websites after receiving a request from the Motion
Picture Association of America (MPAA), which monitors the advertising
practices of the film industry. The MPAA requires that no R-rated trailers
be shown on websites where minors can see them. "We require R-rated
trailers to be put in an area that has restricted access and uses some
kind of adult verification," MPAA spokesman Richard Taylor told
Reuters.

(New York) Universal Music Group said that it will release albums on a

format called Super Audio CD (SACD). The SACD format provides the ability
to add text, graphics and copy-protection to CDs, in addition to providing
higher sound quality. UMG said it will release both new releases and older

releases or pricing for the new format.

(New York) Manga Entertainment, a distributor of anime films, said that
it
will stream "Blood: The Last Vampire" on the Web for twenty-four
hours on
the same day that it premieres in theaters and becomes available to
purchase on DVD. The decision is somewhat unorthodox for the movie
industry, which usually does not release films onto the Internet or into
other distribution outlets until long after a movie leaves the theaters.

(Redwood City, Calif.) Game developer Electronic Arts announced on
Monday
that it will begin offering online games to the Korean market this fall.
The company will first release "Ultima Online" and plans to
offer "The
Sims Online" and other titles. Redwood City-based Electronic Arts
estimates that there are 25,000 online "game rooms" in Korea
where users
pay by the hour to play games.

(Mountain View, Calif.) IM Networks, a provider of technology that
connects consumer electronics devices to the Internet, announced on Monday
that it has partnered with Texas Instruments to increase the availability

(San Francisco) Wired News reported on Monday that some universities
have
this year relaxed their stance on file-sharing services. Several artists
--
including Metallica and Dr. Dre -- last year sent notices to a handful of
schools requesting that they ban Napster use on campus. Many schools did
ban or place limits on the use of file-sharing services, but most saw the
drain on their networks’ bandwidth from students’ downloading as a
more
threatening issue. Indiana University said it will let students determine
how their own bandwidth is used, although it may charge them higher fees
to use the network if resources are strained.

(New York) The Wall Street Journal featured an article on Monday about
the
increasing amount of websites that allow users to place bets on horse
races. Currently, 41 states allow Internet wagering on horses, but a
federal law prohibits casino-style gambling online. One of the problems
with the new method of betting is software that can let a single bettor
place hundreds of bets on a race at the last second, possibly influencing
the odds in his favor.

(New York) The New York Times reported on Thursday that established
online
news sites run by national news organizations are gaining a larger
audience among users. Jupiter Media Metrix reported that the audience for
online news sites increased 14.7 percent over last year. Smaller, more
locally focused sites saw smaller increases than sites such as
NYTimes.com, MSNBC.com and CNN.com. "National sites will get more and
more of a share of the news audience and the smaller sites will get less
and
less," predicted Vin Crosbie, president of the consulting firm
