o Royalty Talks Between Music
Publishers, Subscription Services Break Down
San Francisco -- Negotiations on how much digital music
subscription services like Napster, Yahoo and Rhapsody should pay
music publishers for the rights to offer their songwriters' music
have broken down, CNET News.com reported. While agreements exist
with download services and online radio stations, the subscription
services have only a temporary deal with music publishers, which has
been in place since 2001. While the National Music Publishers
Association (NMPA) is currently asking for 17% of subscription
services' revenues -- a premium over the 5.25% paid for Internet
radio and 8.5% for downloads -- the Digital Media Association (DiMA),
which represents Yahoo, RealNetworks and others, has offered 6.9% of
revenues. The subscription services say they "cannot justify -- for
any executive regardless of title -- paying double and triple
royalties in comparison to historical industry economics," DiMA
executive director Jon Potter wrote in a letter to the publishers
groups on Friday.

o BBC to Make
TV Channels Available Online to U.K. Users
London -- The BBC has announced plans to make its U.K. TV
channels available on the Internet, beginning next year. The
MyBBCPlayer application will allow U.K. viewers to download and
watch the previous week's TV shows on their computers; it will also
eventually include live simulcasts of channels like BBC One and BBC
Two. "We believe that on-demand changes the terms of the debate,
indeed that it will change what we mean by the word 'broadcasting',"
said BBC director general Mark Thompson. The MyBBCPlayer service
will also add audio and video content from the BBC's archive, which
is currently in the process of being digitized, and the company said
it will seek partnerships to provide links to purchase songs and
other media online through the service. The BBC will also continue
to offer online previews of its TV series, including "The Mighty
Boosh," "Titty Bang Bang," "Two Pints of Lager and a Packet of
Crisps" and "Ideal," as well as make clips available to cell phone
users.

BMG Settle Over Use of "Pac-Man" Sounds in Lil' Flip Song
San Jose, Calif. -- Japanese video game publisher Namco announced
on Monday that it has reached an out-of-court settlement with major
record label Sony BMG, over the alleged use of sound effects from
Namco's "Pac-Man" game in a song by Sony artist Lil' Flip. Terms of
the settlement were not disclosed, but the agreement will result in
the dismissal of copyright infringement claims brought by Namco
against Sony BMG in federal court in New York. The song in question
is Lil' Flip's "Game Over," from his 2004 album, "U Gotta Feel Me."
"Namco and Sony BMG are pleased to have resolved this matter and we
look forward to continuing our business relationship in the spirit
of our mutual respect for intellectual property," the companies said
in a joint statement.

Scientific-Atlanta, Microsoft Partner on IPTV Set-tops
Atlanta -- Set-top box manufacturer Scientific-Atlanta announced
on Monday that it is working with Microsoft to develop a new line of
set-tops for Internet-delivered TV services, including SBC's Project
Lightspeed. The new set-tops will run Microsoft's IPTV Edition
software, which supports advanced video compression like H.264,
standard and high-definition digital video recording, and home media
networking. The set-tops are being designed so that telephone
companies can forego the installment of additional wires in
consumers' homes, relying instead on existing coaxial cables. "This
collaboration on IP set-tops combined with our IPTV software and
advanced encoding technology initiatives already underway for SBC's
Project Lightspeed provides additional momentum to the drive toward
the compelling service and revenue opportunities that are possible
with IPTV," said Phil Corman, director of worldwide partner
development for the Microsoft TV Division. The new devices are
expected to be on display at the IBC conference in Amsterdam in
September.

Launches Online Music Discovery Service
Oakland, Calif. -- Pandora Media (formerly Savage Beast
Technologies) on Monday announced the launch of its online music
discovery service, which bases its recommendations on more than five
years of musicological study by 30 analysts. The company's "Music
Genome Project" studied over 400 musical traits for each song
contained in the database, resulting in connections between songs
that reach beyond genre or style. The service lets users enter an
artist or song title; the service then creates a tailored radio
station stream containing songs that share key musical traits, and
provides links to buy them from Amazon or iTunes. "The Music Genome
Project doesn't compare your preferences or shopping habits with
those of others," said Pandora founder Tim Westergren. "It doesn't
care whether the artists you like (or it suggests) are already
popular or just starting out. It levels the playing field by relying
exclusively on the unique musical quality of each song." Oakland,
Calif.-based Pandora will offer the service for free to users for
the first 10 hours, in addition to selling unlimited use
subscriptions for $3 per month.

Teens Have Free Reign Over Mobile Phone Usage
Gaithersburg, Md. -- Most North American parents aren't
supervising the mobile phone use of their teenaged children,
according to a new survey commissioned by Ace*Comm. The online
survey of 1,000 teens found that more than one-third (38%) of teens
use their mobile phones to text-message their friends during school,
while 30% play video games on their phones while in school and 26%
use their phones to talk to people their parents would not approve
of. The survey also revealed that on average, teens spend almost as
much time on their mobile phones as they spend doing physical
activity. In addition, half of those surveyed said that they would
rather have their TV privileges restricted than their mobile phone
use.

Chipmaker DiBcom Raises $30 Million in Fourth Round
Paris -- DiBcom, a chipmaker focused on the mobile TV delivery
market, announced on Monday that it has raised $30 million in its
fourth round of venture capital financing. Partech International led
the investment round; Intel Capital, 3i, WI Harper and UMC also
participated. Paris-based DiBcom's chips have already been
implemented in the delivery of mobile TV signals in the automotive,
notebook PC, cell phone and portable media player market segments.
The company will use the funds to expand its sales and marketing
presence in Asia and the U.S., as well as for product development.

o SIIA Survey
Finds State Progress Slow on Adoption of E-Textbooks
Washington -- The Software & Information Industry Association (SIIA),
on Friday released the results of a survey that shows that digital
textbooks and online educational materials are often getting bogged
down in states' textbook approval processes. The survey found that
only a handful of states have updated their review criteria to
account for electronic materials. It also found that states are
generally unwilling or unable to review materials more than once
every six years, making it difficult for digital materials to get
into schools. "We found that states are making progress in their
support for an e-curriculum, but a lot of work remains in order to
ensure that students have access to electronic resources that meet
their learning needs -- and their expectations," said Mark
Schneiderman, SIIA's director of education policy. "States are not
yet keeping pace with changes technology can bring to the
classroom."

agreements with five content producers who will provide video
programming for its forthcoming Verizon FiOS TV, Internet-based TV
service. The company said that FiOS TV will now also include content
from The America Channel, Blackbelt TV, Expo TV, LIME and the
Pentagon Channel when it launches later this year. Verizon has
previously announced content deals with NBC Universal, Starz,
Showtime, A&E, Discovery and TBS for FiOS TV, which will initially
be offered in 15 states.

Latin music ringtone market, spurred by the large and growing 15 to
25-year-old Latin population in the U.S. -- the age demographic

(New York) The Sunday New York Times reported on the current
state of the pirate film industry, focusing on the distribution
chain that begins with those who sneak camcorders into movie
theaters, and ends with pirate groups selling DVDs in street
markets, and the ordinary Internet surfers being sued for
downloading pirated films off the Internet by the Motion Picture
Association of America. "I don't believe piracy can be easily
beaten; fighting fire with fire by releasing movies on DVD at the
same time as cinemas is probably where the industry is heading in
the next few years," Peter Jackson, director of the upcoming movie
"King Kong," told The Times. "Electronic delivery directly into both
cinemas and people's homes will not necessarily beat pirates, but it
will mean studios are at least on a similar playing field."
