o Copyright Office Recommends Changes to Digital Copyright Law

Washington -- The U.S. Copyright Office has issued a report that
recommends changes to current U.S. law that would extend certain "fair
use" provisions that exist for analog copyrighted works to digital works.
The report recommends that the Digital Millennium Copyright Act be amended
to give consumers the right to create backup copies of digital music and
movies they purchase, provided that they cannot sell these copies to
others. Also recommended is an exemption for webcasters from paying an
additional royalty to record labels and studios for incidental or
temporary "buffer" copies that are created when streaming works to users.
One provision that has been brought up but was not recommended by the
Copyright Office was allowing the "first sale" doctrine to be extended to
digital works -- which could have allowed consumers to sell a digital work
they have purchased to someone else, much the way that used books or CD
can be sold in the marketplace. The Copyright Office said that because
existing technology cannot ensure that the original user's copy of the
work is deleted once it is sold, it could not recommend such an amendment.
