o iPod Plant Accused of "Sweatshop" Conditions Sues Two Chinese Journalists

Beijing - Foxconn, the Chinese manufacturing plant that makes Apple's iPods, has filed a $3.75 million defamation lawsuit against two Chinese journalists who reported on working conditions at the plant, Wired News reported. The initial Chinese reports prompted stories overseas in publications like the U.K.'s Guardian, eventually compelling Apple to investigate allegations that workers were paid only $50 a month for 60-plus-hour work weeks, and were forced to live in cramped dormitories at the factory. Apple's investigation into conditions at Foxconn found that workers were paid the minimum wage for the region, but that Foxconn was indeed in violation of Apple's code of conduct and overtime rules. The two journalists' bank accounts and other assets have been frozen as a result of the Foxconn lawsuit. "We were fulfilling our duties as socially concerned reporters to expose this maltreatment of workers in Shenzhen," China Business News investigative reporter Weng Bao, one of the defendants in the suit, told Wired News. "Now this court case will make the entire media industry and every Chinese reporter fear writing investigative reports."

o NPR to Launch Digital Music Service Next Year

Washington - National Public Radio (NPR) on Wednesday announced plans to create a major digital music service, which it says will extend the role that public radio stations hold in music discovery. The site, scheduled to launch in the first half of 2007, will pool public radio's collective resources, and offer exposure for emerging and non-mainstream artists in genres including classical, jazz, folk, opera, AAA, electronica and alternative. "We have pioneered innovations -- independently and collaboratively -- including a modular music production and acquisition program service, NPR Music online, live streaming concerts, podcasts and, most recently, digital radio multicast channels," said NPR executive vice president Ken Stern. "The digital music discovery arena is a new and barely-explored one, and a logical place for NPR and the public radio system to take a leadership role."

o Minnesota to Appeal Ruling That Tossed Out Video Game Law

St. Paul, Minn. - Minnesota Attorney General Mike Hatch has announced plans to appeal a federal court ruling that declared the state's law fining minors who attempted to purchase M-rated games unconstitutional. Hatch, a Democrat, is also running for Governor of the state of Minnesota. In July, U.S. District Court Judge James Rosenbaum found the state's video game law unconstitutional. Hatch has appealed that ruling to the U.S. 8th Circuit Court of Appeals. "If the parents aren't troubled by their kids playing these games, they can buy them for their children," Hatch said in a statement.

o Satellite Radio Firm WorldSpace Receives Nasdaq Listing Warning

Silver Spring, Md. - WorldSpace Satellite Radio, a provider of satellite radio service to subscribers in foreign countries, said on Wednesday that it has received a letter from the Nasdaq warning that it no longer complies with a rule requiring a minimum $50 million market value for continued listing. As of Aug. 23, the Nasdaq said that WorldSpace's market value had sunk to $47.8 million. To regain compliance, The company said that it has agreed to a deal with its largest shareholder, Yenura, that will result in the issuance of another 17.4 million shares of stock, increasing its total number of shares outstanding to nearly 39 million. "The company believes that the issuance and listing of these additional Class A shares will resolve the aggregate trading value deficiency and bring the company back into compliance with the Nasdaq listing requirements," said WorldSpace in a statement.

o Google CEO Eric Schmidt Joins Apple's Board of Directors

Cupertino, Calif. - Eric Schmidt, the CEO of Internet search giant Google, has been elected to the board of directors of Apple, the company said. Schmidt also sits on Google's board of directors and Princeton University's board of trustees. Steve Jobs, the CEO of Apple, praised Schmidt's "insights and experience," adding that he will be "very valuable in helping to guide Apple in the years ahead." Earlier in his career, Schmidt was the chairman and CEO of Novell and CTO of Sun Microsystems.

o Ad Agency Omnicom to Use TiVo Audience Research Service

Alviso, Calif. - TiVo, the maker of digital video recorders, announced on Wednesday that ad agency Omnicom Media Group has purchased TiVo's audience measurement research, and partnered with the company to develop an engagement study that incorporates TiVo user behavioral data. TiVo launched its TiVo Audience Research and Management unit last month, to offer advertisers and marketers second-by-second data on DVR viewing. "As the only truly DVR-based advertising solution available today, TiVo is at the forefront in helping advertisers engage the consumer while allowing subscribers to maintain control of their television entertainment experience," said TiVo CEO Tom Rogers. "The partnership is all about working with the key advertisers…to embrace the biggest change in television viewing, consumers fast-forwarding through commercials."

o China.com to Invest $20 Million in Game Developer Program

Beijing - China.com's CDC Games unit on Wednesday announced the launch of an Online Games Developer Program, for which it has earmarked $20 million for investment in strategic game development partners. The investments will be used to help these partners build "culturally aware" titles for the Chinese market, aided by market and game research from CDC Games. CDC currently counts over 30 million registered users for its titles, which include the online game "Yulgang." CDC Games said it is now finalizing initial investments in several existing partners, and is actively seeking new development partners.

o Game Publisher Majesco Names New Interim CEO

Edison, N.J. - Video game publisher Majesco announced late on Tuesday that it has appointed Jesse Sutton, president of the company for the past ten years, as interim CEO and a member of the board. Sutton's father, Morris Sutton -- who was serving as interim CEO and chairman -- will vacate his seat on the company's board and return to his role as chairman emeritus. "As Interim CEO I will continue to execute on our goal of becoming a leading publisher of value and handheld products," said Jesse Sutton. "Additionally, I will endeavor to guide Majesco into its next phase of growth by exploring new avenues in the digital entertainment market. This move will allow my father, Morris Sutton, to focus more aggressively on sales and distribution." The company said it will continue its search for a permanent CEO and chairman.
