o iPod Plant Defangs Lawsuit
Against Chinese Journalists
San Francisco - Following an outpouring of negative
publicity, the Chinese manufacturing plant Apple hired to make its
iPods has largely taken the teeth out of a defamation lawsuit it
filed against two Chinese journalists who reported on alleged
sweatshop conditions at the plant, CNET News.com reported.
Initially, manufacturer Foxconn sued the China Business News
reporters for $3.8 million (30 million yuan); their assets were also
frozen as part of the proceedings. Reporters Without Borders, a free
press advocacy group, sent an open letter to Apple CEO Steve Jobs
asking him to intervene on behalf of the journalists. The amount of
damages sought by Foxconn has now been reduced to a token sum of 1
yuan, while the reporters' assets have also been unfrozen. An Apple
spokesman told News.com the company is "working behind the scenes to
resolve the issue." An Apple investigation into Foxconn found the
company was not violating the $100-a-month minimum wage for the
region, but was in violation of Apple's code of conduct for overtime
hours.

o Hollywood Studios
Expand Blu-ray Movie Distribution to Japan, Europe
Culver City, Calif. - The major Hollywood movie studios on
Thursday announced release schedules for around 75 Blu-ray Disc
movie titles in European and other foreign markets, to coincide with
the availability of Blu-ray hardware in Europe, Japan, Australia and
Korea. Sony Pictures Home Entertainment's initial titles, slated to
launch in October in all new territories, include "Hitch," "The
Exorcism of Emily Rose," "Hostel" and "Underworld Evolution." Warner
Home Video plans to release 10 Blu-ray Disc titles in European
markets in late 2006. Twentieth Century Fox Home Entertainment will
launch its first eight Blu-ray releases in Japan on Nov. 10, and in
North America, Australia and Europe on Nov. 14. MGM did not break
down its Blu-ray title distribution by region, but said it will
offer two titles on Nov. 28 and two more on Dec. 5. Both Paramount
and Disney also plan to expand distribution of their Blu-ray titles
overseas, while Universal remains the only major studio committed to
exclusively supporting Blu-ray's rival, Toshiba's HD DVD format.

o Electronic
Arts Signs In-Game Ad Deals With Massive, IGA Worldwide
Redwood City, Calif. - Video game developer and publisher
Electronic Arts on Thursday announced its entry into the in-game
advertising market, signing new agreements with in-game ad providers
Massive Incorporated and IGA Worldwide. Financial terms of the deals
were not disclosed. New York-based Massive, a recent Microsoft
acquisition, will deliver in-game ads for several of EA's titles for
the Xbox 360, including "Need for Speed: Carbon." IGA Worldwide will
enable advertisers to place ads within up to three EA titles,
including "Battlefield 2142." "In places like a basketball court,
football stadium or roadside in a racing game, advertising is not
only nice to have, but it's an essential component to create the
fiction of being there," said Chip Lange, EA's vice president of
online commerce.

o CEA, Public
Knowledge Deride RIAA Copyright Education Campaign
San Francisco - The Recording Industry Association of
America's (RIAA) "back to school" anti-piracy educational campaign
has been criticized by a number of trade associations and public
interest organizations as "inaccurate, self-contradictory, and a
disservice and embarrassment to the respectable institutions that
RIAA has enlisted." The Consumer Electronics Association, Computer
and Communications Industry Association (CCIA) and Public Knowledge
have in particular targeted a website the RIAA set up for students
and a free DVD it is distributing that they say distort the doctrine
of "fair use" of copyrights. The RIAA materials indicate that it is
fine to make a CD copy for yourself, but it is criminal to do so for
a friend. "Making copies for your friends, or giving it to them to
copy, or e-mailing it to anyone is just as illegal as free
downloading," the video states. "First, we were told we should not
enforce our rights," an RIAA representative responding to critics of
the video told CNET News.com. "Now we are told education is wrong,
too. We won't accept such a do-nothing approach. We'll continue to
work with respected higher-education groups to engage students to
think critically about these issues."

o TiVo
Subscribers Up 24% to 4.4 Million; Loss Widens on Legal Costs
Alviso, Calif. - TiVo, a provider of digital video
recorder hardware, software and services, announced on Thursday that
it now counts 4.4 million subscribers, a 24% increase from a year
ago. The company also reported a wider loss of $6.45 million for the
second quarter, up from $892,000 a year ago -- attributed largely to
legal costs associated with its patent dispute with DISH Network
parent EchoStar Communications. Earlier this month, a federal judge
ruled in TiVo's favor and ordered EchoStar to pay the company $89.6
million in damages.

California Senate Approves Video Franchising Bill
Sacramento, Calif. - The California State Senate voted
33-4 on Wednesday night in favor of a bill that would open the
state's cable franchising process and make it easier for
telecommunications firms like Verizon and AT&T to offer digital
video services in California. Currently, in California and many
other states, telcos must seek approval from each individual county
or city in which they wish to offer services like Verizon's FiOS TV
or AT&T's U-Verse. The California bill now goes back to the state
Assembly, where it is expected to come up for a vote on Thursday or
Friday.

San Francisco - Wired News reported on Thursday on a new service

BitTorrent users were encrypting their file transfers to protect
them from services like NetEnforcer that degrade their speed. Some
ISPs estimate BitTorrent file transfers account for up to 50% of all
