o Calif. Bill Mandating E-Mail Addresses on File-Swaps Heads to Governor

Sacramento -- A California state bill on Internet piracy has been overwhelmingly approved in both the Assembly (76-1) and Senate (33-1) and sent to Gov. Arnold Schwarzenegger for consideration. The legislation would require anyone disseminating copyrighted material on the Internet, as is done on peer-to-peer file-sharing networks like Kazaa and Freenet, to include his or her valid e-mail address. Author of SB 1506, Sen. Kevin Murray (D - Los Angeles), said the measure will help consumers and law enforcement distinguish between legitimate and pirated works distributed online. The statute would not apply within immediate families or home networks, but otherwise violators would face a $2,500 fine and up to one year in jail. Minors would pay $250 for early offenses but could also eventually face imprisonment. "I greatly appreciate the continuing support of the Motion Picture Association of America (MPAA) in addition to other supporters in our creative communities to enact responsible legislation that gives state and local law enforcement a greater ability to combat what is essentially the theft of creative works," said Senator Murray.

o Appeals Court Says No DMCA Violation for Garage Door Opener Maker

Washington -- The U.S. Court of Appeals for the Federal Circuit has ruled that a maker of universal garage door openers did not violate the Digital Millennium Copyright Act (DMCA) with its products, in an important decision that could limit the scope of the controversial law. The ruling upholds a lower court's finding that Skylink Group's garage door openers, which can be used to open garage doors manufactured by The Chamberlain Group, do not violate a section of the DMCA that prohibits circumvention of security technologies of a copyrighted work -- in this case, the transmitter code Chamberlain uses to open its garage doors. The court said that owners of Skylink devices were not looking to infringe copyrights, and that Chamberlain at the time did not place any restrictions on how its products could be used. "A homeowner who purchases a Chamberlain (garage door) owns it and has a right to use it to access his or her own garage," the appeals court said. The U.S. Copyright Office last year invalidated a similar charge brought against a maker of replacement toner cartridges for printers.

o Report: 2004 Global Game Sales to Remain Flat at $18.2 Billion

London -- Video game sales for this year are expected to come in flat in relation to 2003's record $18.2 billion, according to a report from London-based market research firm Screen Digest. After growing over 100% between 1997-2003, outpacing both movie box office and rentals for the same period, sales are projected to slow while the industry waits for the next generation of game consoles to be released in 2005 and 2006. Screen Digest predicts global retail sales will rebound and grow by 16% to $21.1 billion by 2007. The firm broke down its 2003 sales figures by region, showing that the U.S. led market share, followed by Japan and the U.K., which saw sales grow 7% in 2003 to $1.88 billion. Overall, Western Europe accounted for $6.4 billion of the total market. "Our research suggests there is plenty more scope for strong sales within the current console cycle. However, innovation is the cornerstone of the games industry and we expect the launch of exciting new handheld machines to give the market a huge boost ahead of the next generation of TV-based consoles." said Screen Digest chief analyst Ben Keen.

o Pop-Up Ad Firm Claria Settles Several Trademark Infringement Suits

San Francisco -- Claria (formerly Gator), a controversial provider of pop-up ads that display on top of competitors' ads, has settled trademark lawsuits brought against the company by Wells Fargo, Quicken Loans and others, CNET News.com reported. Settlement terms were not disclosed. As many as 13 companies have sued Claria, with some suits still pending, over its adware that has been distributed alongside the Kazaa file-sharing program, arguing that placing the ads over their own violated trademarks. Other plaintiffs including UPS, Hertz and L.L. Bean have also settled their claims with Claria. "These (cases) have been settled to the satisfaction of all parties," Claria spokesman Scott Eagle told News.com. "Claria will continue to protect (its) business model." Claria added that it has established business relationships with some of the former plaintiffs. The company's advertising software business practices have still not been vetted in court, although pending litigation against Claria rival WhenU.com is slated to go to trial next year.

o Microsoft Releases Windows Media 10, Portable Media Center Software

Redmond, Wash. -- Microsoft on Thursday released its Windows Media Player 10, the latest version of its audio and video playback software, which includes access to its recently launched online digital music store and support for a range of devices running its Portable Media Center software. The first such device, a $499 model from Creative featuring a 3.8-inch TFT LCD screen and 20GB hard drive, went on sale on Thursday. Microsoft's Portable Media Center software has been touted as a secure means of distributing copyrighted content onto portable devices. Content providers who have authorized content for download directly to Portable Media Center devices initially will include Major League Baseball and video-on-demand service CinemaNow; the devices can also store and playback TV programs recorded onto a PC. Microsoft said Samsung and iRiver will ship additional Portable Media Center devices in the fall.

o Digital Media Distributor DG Buys Ad Video Database Source TV

Dallas -- DG Systems, a provider of digital media distribution services to the ad and broadcast industries, announced that it has acquired Florida-based Source TV, which provides ad agencies and production companies with a searchable database of over 350,000 TV commercials and associated industry data. Financial terms of the transaction were not disclosed. Source TV founder and president Pamela Maythenyi will become senior vice president at DG Systems. DG said the acquisition will diversify its revenue, expand its products and customer base, and strengthen management. The company's digital network serves 5,000 advertisers, 2,000 TV and 10,000 radio stations.

o U.K. Program to Turn Russian Nuclear Scientists into Game Developers

London -- The U.K. Department of Trade and Industry unveiled a new program called the U.K.-Russia Closed Nuclear Cities Partnership (CNCP) that aims to turn former Russian nuclear scientists into video game designers. "Games software designers today are looking for increasingly sophisticated programmers with backgrounds in physics and advanced maths," said Trade and Industry Minister Nigel Griffiths, speaking at the European Games Network exhibition in London this week. "These are exactly the skills that these former nuclear weapons scientists have who need to find ways to use their skills in peaceful pursuits." The 6-million-pound ($10.7 million) program is part of a wider $20 billion plan spearheaded by the G8 countries to counter proliferation of nuclear material in the former Soviet Union.

(Frankfurt) Apple said on Thursday that it would team up with BMW, the second-largest luxury car maker in the world, to equip the German firm's cars in Europe with the iPod as early as this fall. Apple said drivers of the BMW X3, X5, 3 Series and Z4 would be to select songs without taking their hands from the steering wheel, which will come with an iPod control built into it. Other BMW models will be able to connect an iPod to the car's stereo, but will not come equipped with the built in steering-wheel control, the company said.
