o Judge Orders Madster File-Sharing Site to Shut Down

Chicago -- A federal judge has ruled in favor of Recording Industry of
America (RIAA) member record labels, granting an injunction against
file-sharing service Madster -- formerly known as Aimster -- and ordering
the service offline within days. In his ruling, Judge Marvin Aspen wrote
that Madster "is a service whose very raison d'etre appears to be the
facilitation of and contribution to copyright infringement on a massive
scale. Defendants manage to do everything but actually steal the music off
the store shelf and hand it to Aimster's users." CNET News.com reports
that the judge asked the RIAA to suggest language for the injunction,
advising RIAA attorneys to examine the similar ruling against the
now-defunct Napster. "This decision helps to support the continued
development of the legitimate on-line music market for fans, which is, of
course, our goal in all of our on-line enforcement activities, " said RIAA
CEO Hilary Rosen.

o MP3Board.com Copyright Infringement Case Gets Jury Trial

New York -- A federal judge has denied motions for summary judgment on
both sides of a copyright infringement case between record labels
represented by the Recording Industry Association of America (RIAA) and
MP3Board.com, a site that provides links to audio files on public websites
-- setting the stage for a jury trial to begin within the next 30 days.
The RIAA sued MP3Board.com for copyright infringement, over its website
that directs users to other sites offering both authorized and
unauthorized MP3 files for download; for its part, MP3Board.com
countersued, arguing the RIAA misrepresented the Digital Millennium
Copyright Act by asking its Internet service provider to take the site
offline. Judge Sidney H. Stein denied both the record labels' request for
summary judgment and MP3Board.com's summary judgment motion, which argued
that the site should be protected under the First Amendment.

o Microsoft Releases Windows Media Series 9 Audio, Video Software

Los Angeles -- Microsoft chairman Bill Gates was on hand at an event
Wednesday night at Los Angeles' Hollywood and Highland complex to announce
the launch of the company's latest audio and video player software,
Windows Media 9 Series. The platform, currently available in a public beta
version, includes a new streaming server, media player and new versions of
the company's proprietary audio and video codecs. The platform also now
supports 5.1 surround sound, which will be included on musician Peter
Gabriel's upcoming album "Up." Microsoft said that BMW Films, a series of
short films commissioned from acclaimed directors like Ang Lee and Guy
Ritchie to promote the cars, will use Windows Media 9 to digitally project
its films in digital-equipped theaters across the country.

o National Lampoon Acquires College Cable TV Network Burly Bear

Los Angeles -- Comedy content creator National Lampoon announced on
Thursday that it has acquired the defunct Burly Bear Network, an on-campus
cable television network that served 400 colleges. Financial terms of the
cash and stock transaction were not disclosed. Burly Bear, which shut down
in June, counted among its major shareholders Broadway Video/Lorne
Michaels and Constellation Ventures. National Lampoon plans to air its own
library and original animated and live-action content, as well as Burly
Bear's library of programming. "Acquiring the distribution system of Burly
Bear gives National Lampoon control over the distribution of its
programming to its target audience," said National Lampoon CEO James P.
Jimirro.

(Burbank, Calif.) The Walt Disney Studios announced on Thursday that it
has partnered with "Shrek" producer John Williams' Vanguard Films to
produce a slate of computer animated feature films. A new venture,
Vanguard Animation, will be formed to expand Vanguard from an independent
production company into a fully financed digital animation studio. The
first film from the partnership will be "Valiant," followed by an
anticipated slate of three more CG-animated films. "Our production
approach is best summarized by the fact that we will make these films for
under $40 million each, and they will be delivered within two years of
their start date," said Williams.

(Los Angeles) Vivendi Universal Publishing announced on Thursday that its
"American Idol: The Search for a Superstar" CD-ROM video game title will
ship to retailers on Nov. 1. The game lets players record their own
performances of popular songs and submit them to a website, where they
will be judged in a nationwide voting competition.

(San Francisco) The San Francisco Chronicle said on Thursday that it will
become the first newspaper to offer a daily audio edition on CD. The
service, which uses software developed by Atlanta-based MobileSoft, will
allow users to enter the paper's online site, select sections of interest
and specify the time of their typical commute. The server-client software
will then automatically write an audio CD before the subscriber wakes up,
in time for their commute. The customized CD will contain an audio version
of requested news topics, lasting the time specified.

(Redmond, Wash.) Nintendo announced on Thursday that its "Super Mario
Sunshine" title for the GameCube video game console has sold over 350,000
units in its first ten days of release, outpacing sales of other popular
titles like "Halo" for the Xbox and "Grand Theft Auto 3" for PlayStation
2. The company said its retail partners have attributed jumps in GameCube
hardware sales averaging 50 percent to the new game. Nintendo's Mario
franchise has seen a record $7 billion in worldwide game sales since 1983.
