o Aussie Court: Kazaa Guilty of
Copyright Infringement
Sydney -- An Australian federal court has ruled that Sharman
Networks, distributor of the Kazaa file-sharing application, is
guilty of copyright infringement and must filter out copyrighted
songs traded on its peer-to-peer network within two months. Federal
Court Justice Murray Wilcox said in his ruling that it was in the
financial interest of Sharman "to maximize, not minimize, music
file-sharing," and ordered Australia-based Sharman, U.S.-based
partner Altnet and several other defendants to pay 90% of the music
industry's court costs. A separate hearing will be held to determine
copyright infringement damages against Sharman and its partners. "On
the heels of the unanimous Grokster ruling by the U.S. Supreme
Court, this decision reflects a growing, international chorus: those
who promote theft can be held accountable no matter how they may
attempt to escape responsibility. A corrupt business strategy of
attempting to hide 'off-shore' is not off-limits to the enforcement
of rights by creators or law enforcement," said RIAA CEO Mitch
Bainwol. Sharman plans to appeal the ruling. "While the judgment has
yet to be studied in detail, Sharman Networks is obviously
disappointed with the decision. However, we will appeal this
decision vigorously and are confident that we will win on appeal,"
the company said in a statement.

Independent Battle.net Game Servers Violate Copyrights
St. Louis -- The U.S. 8th Circuit Court of Appeals has ruled that
programmers violated the Digital Millennium Copyright Act (DMCA)
when they created their own multiplayer game servers for Vivendi
Universal-owned game publisher Blizzard Entertainment's games, CNET
News.com reported. Programmers had created their own unofficial
versions of Blizzard's Battle.net online gaming service for titles
like "Diablo" and "Warcraft", after complaints about the official
site's performance. In its 3-0 decision, which upheld a lower
court's October ruling, the appeals court said that the defendants
violated the agreement they clicked on when installing Blizzard's
games on their computers that prohibits reverse-engineering.

185,000 PlayStation Portables During U.K. Launch
London -- According to figures compiled by U.K.-based market
analysis firm Chart-Track, more than 185,000 of Sony's long-awaited
PlayStation Portables (PSPs) were sold in just four days, making the
device the fastest-selling video-game console in U.K. history. By
comparison, Sony rival Nintendo sold only about 87,000 of its
Nintendo DS consoles during its launch week in March. The PSP, which
can browse the Internet and play videogames, movies and music, went
on sale in Europe on Sept. 1, nine months after the gadget hit
Japanese stores and six months after its launch in the U.S. So far,
the device has been hugely popular in every market it has entered,
and the U.K. looks to be no exception. In fact, Sony said it expects
to sell more than 1 million PSPs in the U.K. before Christmas.

Alviso, Calif. -- TiVo on Tuesday announced a new $150 mail-in
rebate that will drop the price of its 40-hour TiVo Series2 digital
video recorder to an all-time low of $49. The company also announced
the launch of a search for a "TiVo Ambassador," a contest that will
award the winner $25,000 and a TiVo-branded Mini Cooper -- as well
as the opportunity to participate in various promotional activities
for TiVo for one year.

Adults Have $2,200 of Entertainment Stored on Devices
San Jose, Calif. -- Young adults between the ages of 18-24 have
an average of about $2,200 worth of entertainment stored on devices
such as computers, MP3 players, DVRs and mobile phones, according to
a new survey conducted by KRC Research and Hitachi Global Storage
Technologies. The figure is nearly double that of all U.S. adults,
who average $1,135 in entertainment content. Hitachi said that the
results point to the notion that as the cost of digital storage
becomes less than 10% of the content value, it is affordable enough
for that content to be permanently retained -- increasing the
pervasiveness of hard disk drives. The telephone survey of 1,004
adults was conducted during August.

Virgin Megastores Throw Down Gauntlet to Apple in U.K.
London -- HMV, the largest specialist music seller in the U.K.,
announced that has launched a new digital music service giving
consumers online access to a library of more than 1.3 million songs.
The news follows a similar announcement made last week by Virgin
Megastores, the second-largest music chain in the U.K. Many analysts
say that Virgin Megastores and HMV's inclusion into an already
highly competitive market is likely to spark a digital music war.
The U.K. music download market, while still relatively small, is
expected to grow by leaps and bounds. About 500,000 songs, for
example, were downloaded legally from the Internet in all of last
year; now, about 500,000 songs are legally downloaded every week.
Industry experts predict that online music sales in the U.K. will
nearly double from about $63 million this year to more than $120
million in 2006 and approximately $480 million by the year 2010.

Physics Developer Ageia Acquires Sweden's Megon
Mountain View, California -- Ageia Technologies, a developer of
hardware-accelerated physics for video games, announced that it has
acquired Meqon Research, the Sweden-based physics-development
company behind 3D Realms's "Duke Nukem Forever" and Saber
Interactive's "TimeShift" games. Ageia said the deal would combine
its expertise in multi-threading, high-speed collision detection and
hair and clothing simulation with Meqon's industrial physics
simulation, content creation tools and character and vehicle
simulation. "Ageia is a physics juggernaut in the games industry
with its strategic acquisitions and its groundbreaking Ageia PhysX
processor," said Meqon CEO Jonas Lindqvist. "Our team is thrilled to
join forces with Ageia to transform the future of next-generation

Casino Sportingbet Confirms Talks with Empire Online
London -- Sportingbet, a U.K.-based Internet betting and gaming
group listed on the London Stock Exchange's Alternative Investment
Market, confirmed that it is holding takeover talks with Empire
Online, a U.K.-based company that provides marketing services for
the online gambling industry. "These discussions are at a very
preliminary stage, and there can be no certainty whatsoever that
agreement will be reached and an offer will be forthcoming,"
Sportingbet said. Last week, Empire admitted that it received a
$1.45 billion bid approach after takeover rumors caused its share
price to increase sharply; the company, however, declined to
identify its suitor. Quoting an unnamed source familiar with the
talks, a Financial Times report said that other suitors, such as
PartyGaming and 888.com, may yet make rival bids for Empire, which
launched an initial public offering (IPO) less than three months
ago.

Online Casino Cassava Planning IPO for 888.com
London -- Cassava Enterprises, a Gibraltar-based online casino
operator, announced that it is planning an initial public offering
(IPO) for its online casino 888 sometime this month. Cassava said it
would seek a full listing on the London Stock Exchange in a move
that could value the company at more than $1.29 billion, according
to estimates by the Financial Times. "The industry has reached a
stage where consolidation is going to be the name of the game over
the next 18 months, and we want to be there and take it forward,"
888 CEO John Anderson said. Cassava said the IPO would also help it
to make acquisitions and hire staff, as well as provide a partial
exit for shareholders. Cassava runs several online casinos,
including Pacific Poker and Reef Club Casino. 888.com currently
boasts more than 20 million members in more than 150 countries.

According to the Business Online, Microsoft has teamed up with
European wireless network operator Orange to develop a mobile phone
that will double as a Microsoft music player. "Porting digital music
on to mobile phones represents a massive opportunity for Microsoft,"

Apple has sold about 10 million iPods worldwide to date, a quarter
of the world's population own mobile phones, which Microsoft
software can turn into digital music players." The phone will

(London) Napster announced that the U.K. version of its digital
music service has sold or streamed a combined 55 million tracks to a

the world's largest mobile maker, said they would be willing to buy
mobile TV services for a monthly fee of about $15. Fifty-eight

content was suitable for short-period viewing and that phone

(London) BBC World Service announced that it has entered into an
agreement with Norkring, a subsidiary of Norway-based
telecommunications group Telenor, for digital broadcasting over
short wave, digital radio mondiale (DRM). DRM is a new digital radio
standard specifically designed for use in short wave, medium wave
and long wave bands. The agreement involves the broadcast of radio
channel BBC World Service "English for Europe" to Central Europe for
an initial period of 18 months. The BBC said that it is also using
U.K.-based transmitters owned and operated by VT Communications to
provide a multi-frequency network aimed at the Benelux region.

new software program developed by iParadigms and LexisNexis -- the
periodicals database -- which can search out and catch potential
plagiarism in reporters' stories. The software will be marketed to

not plagiarized from other sources. "We take digital fingerprints of
individual documents and compare them to the digital fingerprints of

he wrote and recorded two songs in response to the aftermath of
Hurricane Katrina, and will donate all proceeds from the digitally
