o Digital Media Wire, Consumer Electronics Association Announce Partnership

Los Angeles - Digital Media Wire and the Consumer Electronics Association (CEA), the trade group that represents the $125 billion consumer electronics industry, on Wednesday announced a partnership that includes an undisclosed investment by CEA in Digital Media Wire, and sponsorship of several of the news organization's events. "The content and technology industries are intersecting, as both work together to bring innovation, technology and content into the lives of consumers," said Gary Shapiro, president and CEO of CEA. "CEA's partnership with Digital Media Wire was the next logical step in expanding and growing the relationship between consumer technology and the content community." Under the deal, CEA will sponsor and help promote Digital Media Wire's Future of Television Forum, scheduled for Nov. 16-17, and its Digital Music Forum East, set for March 6-7, 2007. "CEA has been hugely successful in promoting the consumer electronics industry through industry conferences and events including the International CES," said Ned Sherman, CEO and publisher, Digital Media Wire. o Universal Music Acquires BMG Music Publishing; Napster Litigation Settled

Paris - Media conglomerate Vivendi's Universal Music Group major record label announced on Wednesday that it has signed an agreement with Germany's Bertelsmann, to acquire BMG Music Publishing for $2.1 billion. Bertelsmann's music publishing arm includes a catalog of over one million copyrights, for compositions from artists ranging from Coldplay and Justin Timberlake to Puccini and Ravel. "This is an historic acquisition which will further diversify and expand our portfolio of music assets into such key areas production music library, classical and Christian music," said Universal Music chairman and CEO Doug Morris. "As a result, UMG will not only be even better positioned to fully capitalize on the many new and exciting opportunities in the current marketplace, but able to better serve our artists, songwriters and business partners." Separately, Bertelsmann announced that it has settled outstanding litigation with Universal Music Group over its early financial support of Napster, when it was still a free file-sharing service. Under the terms of the settlement, Bertelsmann will pay UMG $60 million, which includes both damages for copyright infringement and reimbursement of legal fees and expenses.

o Sony Delays Launch of PlayStation 3 in Europe to March 2007

Foster City, Calif. - Sony Computer Entertainment America (SCEA) on Wednesday reaffirmed the Nov. 17 North American launch date for its PlayStation 3 video game console, following an announcement earlier in the day that the European launch date for the console has been pushed back to March 2007. "The change in the release date for PlayStation 3…will not impact our launch for the system here in North America," said SCEA president and CEO Kaz Hirai. "Our plans remain unchanged, and we are on track to meeting our goals with this important launch. It is also important to note that the previously announced global PlayStation 3 shipment forecast of six million units within the fiscal year ending 2007 has not changed." SCEA said the launch postponement in the other territories was "caused by the delay in the mass production schedule of the blue laser diode within the Sony Group, thus affecting the timely procurement of key components to be utilized in PlayStation 3."

o Shares of XM Satellite Radio Fall on SEC Inquiry

Washington - Shares of XM Satellite Radio fell more than 3% in late-day trading on Wednesday after the company revealed that the Securities and Exchange Commission (SEC) is requesting information about the satellite radio provider's subscriber targets and related costs for the final two quarters of 2005. The company said that the requests "appear to pertain to matters similar to the issues underlying the previously disclosed securities litigation filed against us earlier this year." That suit, filed by shareholders in U.S. District Court in D.C., alleges that XM misled investors about the high price the company had to pay to reach its goal of 6 million subscribers last year. XM said that it will cooperate fully with the SEC's inquiry.

o Anheuser-Busch to Launch Broadband Entertainment Site

St. Louis - Anheuser-Busch announced on Wednesday plans to launch an online entertainment network -- Bud.TV -- that will feature multiple channels of original content targeting the same young male demographic as the company's television ads. Slated to launch in February 2007, Bud.TV will feature webisodes, sporting events, user-generated content, field news reports, celebrity interviews, music downloads and comedy clips. Content partners with the site include Wild West Picture Show Productions, actor Kevin Spacey's TriggerStreet.com project, LivePlanet, SEED, @radical.media, Omelet and DDB Worldwide. St. Louis-based Anheuser-Busch said it named former vice president of creative development Jim Schumacker to head up its new digital marketing team overseeing Bud.TV. "With adults spending more time online looking for entertainment to fit their lifestyles, we believe Bud.TV will enable us to reach them in an engaging and fun way," said Anheuser-Busch president August Busch IV.

o MTV, Sunflower Broadband Launch National Video-on-Demand Ads

Lawrence, Kan. - Regional cable TV provider Sunflower Broadband announced on Wednesday that it has partnered with Viacom's MTV Networks to insert national ads into cable video-on-demand (VOD) programming. The VOD ads will be powered with technology from SeaChange International and Atlas On Demand. The first campaign was created by Mediaedge:cia for the upcoming Paramount Pictures/MTV Films release "Jackass Number Two". o SpiralFrog Licenses EMI Music Publishing for Ad-Supported Download Service

New York - SpiralFrog, a start-up digital music service that plans to offer free songs supported by advertising, announced on Wednesday that it has licensed EMI Music Publishing's catalog for legal downloading in the U.S. New York-based SpiralFrog, which aims to launch its service later this year, has also licensed Universal Music Group's catalog for inclusion on the service. The deal with EMI also includes the rights for SpiralFrog users to search for and display the lyrics to its Anglo-American repertoire. "The industry's overall perception of what constitutes piracy has not changed," said SpiralFrog CEO Robin Kent. "By supporting our service that provides people with a compelling alternative experience and lets them enjoy high-quality music they've legally downloaded, Universal and EMI Music Publishing have enabled SpiralFrog to move the music industry barometer."

o Sybase to Acquire Content Delivery Firm Mobile 365 for $425 Million

Chantilly, Va. - Sybase, a California-based maker of software for managing data center information, said on Wednesday that it will pay about $425 million in cash to acquire Virginia-based Mobile 365, a provider of mobile messaging and content delivery services. Privately held Mobile 365 generated about $90 million in revenue last year, and is backed by Draper Fisher Jurvetson, Draper Atlantic Venture, 3i Technology Partners, Institutional Venture Partners and Mayfield. The company primarily delivers mobile data and messaging for mobile operators such as Verizon Wireless, T-Mobile and Cingular, but also mobilizes content for companies such as Citibank, Yahoo and AOL. The deal is expected to close before year's end, when Mobile 365 will begin to operate as a Sybase unit called Sybase Mobile 365. Marty Beard, Sybase's senior vice president of corporate development and marketing, will become the unit's president.

New York - Video-sharing service Motionbox announced on Wednesday that it has raised $4.2 million in its first round of venture capital financing. Investors participating in the round included Canaan Partners, SAS Investors and Japan's Itochu Corporation. New York-based Motionbox says its service makes it easier for less tech-savvy users to upload and share their personal videos online. The funds will be used for further product development and marketing efforts.

o Mobile Games Firm Sennari Raises $10 Million in Third Round

Cupertino, Calif. - Sennari, a developer of customer relationship management applications for mobile phones, said on Wednesday that it has raised $10 million in its third round of funding, led by Mayfield Fund. Previous investors UV Partners, Novak Biddle and Blacksmith Capital also participated. Cupertino, Calif.-based Sennari's PrizePlay mobile gaming service launched in 2005, and is currently in use by carriers such as T-Mobile, Vodafone, O2 and Orange. The company also offers loyalty programs for carriers and handset makers, as well as a free promotional music channel for mobile phones.
