o House Judiciary Approves Bill Giving Jail Time to File-Swappers

Washington -- The House Judiciary Committee on Wednesday approved the Piracy Deterrence and Education Act of 2004, which would make it a crime to share 1,000 or more copyrighted works on file-sharing networks, in addition to banning camcorders in movie theaters used to record first-run movies. After a federal appeals court ruled last month upheld a ruling that said file-sharing networks themselves aren't liable for copyright infringement, copyright owners have increasingly turned to legislators to aid in their campaign against piracy. "Piracy of intellectual property over the Internet, especially on peer-to-peer networks, has reached alarming levels," said Rep. Lamar Smith (R-Texas), an author of the bill. "This legislation increases cooperation among federal agencies and intellectual property owners, and assists federal law enforcement authorities in their efforts to investigate and prosecute intellectual property crimes." Under the proposed legislation, which will now come before the full House, file-swappers would face up to three years in prison for a first offense, or five years if there is financial gain involved. The Senate approved similar bills on mass file-swapping and movie theater camcorders in June.

o Kazaa Partner Altnet Sues RIAA for Patent Infringement

Los Angeles -- Altnet, a partner of Sharman Networks that sells legitimately licensed works on the Kazaa file-sharing service, announced that it has filed a patent infringement suit against the Recording Industry Association of America (RIAA), which it says has infringed Altnet technology in the course of its anti-piracy campaign. The technology in question is called "TrueNames," which identifies files on a P2P network using a digital fingerprint, and which Altnet said that the RIAA and co-defendants Overpeer and Media Sentry have used to seed file-sharing networks with "spoof" files that are bogus or corrupted. "We've exhausted every means of trying to work with these defendants and those they represent to patiently encourage and positively develop the P2P distribution channel," said Altnet CEO Kevin Bermeister. "We cannot stand by and allow them to erode our business opportunity by the wholesale infringement of our rights." Bermeister and executives at Kazaa parent Sharman Networks have been sued by the RIAA for copyright infringement; however, a federal appeals court recently ruled that providers of file-sharing software are not liable for any copyright infringement committed by users of such software.

o RealNetworks Sells 3 Million $0.49 Songs in Three-Week Promotion

Seattle -- RealNetworks announced on Thursday an early close to its 49-cent song download promotion, adding that over 3 million songs were sold from its online store during the first three weeks of the scheduled month-long offer. The company said when announcing the program that cost of providing songs at such a discount would affect its third-quarter earnings. RealNetworks will continue to sell a selection of 10 songs each week at the 49-cent price point, which will be chosen by editors from RealNetworks and Rolling Stone. RealNetworks also said it will integrate Harmony -- its technology that enables songs purchased from its store to play on Apple's iPod -- into its Rhapsody digital music service later this year. The company claims a combined total of 550,000 paying members for its Rhapsody and RadioPass music services.

o Appeals Court Says "Unrecognizable" Sample is Copyright Infringement

Cincinnati -- The 6th Circuit Court of Appeals in Cincinnati has ruled that any "sample," or piece of one song that is used in a new work -- even if the sample is unrecognizable -- should be licensed, and if not amounts to copyright infringement, the Associated Press reported. "If you cannot pirate the whole sound recording, can you 'lift' or 'sample' something less than the whole? Our answer to that question is in the negative," the court said. "Get a license or do not sample. We do not see this as stifling creativity in any significant way." The case involved a sample of a guitar riff from Funkadelic's "Get Off Your Ass and Jam" that was sampled in the NWA song "100 Miles and Runnin," and eventually appeared in the 1998 movie "I Got the Hook Up" from rapper Master P. The two-second guitar sample was lowered in pitch and looped for the NWA version, to the point that it was not recognizable, according to the court, which still likened the unlicensed sample to copyright infringement. The 6th Circuit remanded the case back to the lower court.

o Anti-Piracy Software Firm Smarte Solutions Acquires Vincera

Austin, Texas -- Smarte Solutions, a developer of anti-piracy technology used by Sony, announced on Thursday that it has acquired Vincera Software, a provider of software that monitors real-time usage of digital content files. Financial terms of the transaction were not disclosed. Smarte Solutions will change its company name to Vincera following the close of the deal; Vincera CEO Dave Malmstedt will also become president and CEO of the merged company. Austin-based Smarte Solutions' technology has been used by Sony to secure content delivered on CD media. The companies' combined offering will provide a broad platform that collects and categorizes real-time usage of digital content files, websites, Web-based applications and PC-based software.

o Texas Firm Sues Major League Baseball Over Internet Video Patents

Austin, Texas -- A company holding patents on Internet video has sued Major League Baseball Advanced Media (MLBAM), over features offered on the baseball league's websites that allegedly infringe the patents, CNET News.com reported. Austin-based DDB Technologies says that MLB.com features such as simulations of live games, video highlights, searchable video and a stat tracker infringe on its patented technology. DDB has previously won a license of its technology from SportsLine.com, and said it is currently talking to other sites that provide similar live sports features. "Hopefully, MLBAM will take the license to DDB's patents, and eventually, we hope, others will as well," Michael McLaughlin, a spokesman for DDB, told News.com. MLBAM plans to take the matter to court. "We have preliminarily reviewed the allegations," MLBAM spokesman Jim Gallagher told News.com. "We believe the suit to be without merit, and we will see them in court."

o Haptics Developer Sensitive Object Raises $2.4 Million in First Round

Paris -- Sensitive Object, a France-based technology start-up focusing on haptics, or interfaces using the sense of touch, announced that it has received 2 million euro ($2.4 million) of first-round funding. The company is developing a technology that can turn just about any object into an input device. Using sensors and a process called "time reversal acoustics," the technology allows users to change TV channels, control personal computers or answer telephones merely by touching tables, windows or chairs. Sofinova, a venture capital firm based in San Francisco, led the round. Under the terms of the investment, Jean Schmitt of Sofinova will join Sensitive Object's board, the company said. Separately, Sensitive Object also announced that co-founder Ros-Kiri Ing had been named president and Hubert Cospain chief executive officer.

(Las Vegas) Slot machine manufacturer Alliance Gaming Systems announced on Thursday that it has signed a licensing agreement to develop a line of slot machines based on classic Atari video game titles.
