o Greek Court Trumps Recent Law Banning Electronic Games

San Francisco -- A Greek court has ruled that a recent law designed to
prohibit online gambling sites, but written so broadly that it in effect
banned all electronic games, is unconstitutional, CNET News.com reported
on Wednesday. Charges against three people connected with Internet cafes
where people play online games were dropped; the accused would have faced
three months in jail and up to $5,000 in fines. "Nobody from the members
of the parliament realized or could foresee the effects that this would
have for PC games, Internet games and game consoles, simply because they
are not familiar with that side of technology," Nikos Kakayanis, managing
director of a string of Internet cafes called The Web, told News.com.

o LA Times: Microsoft In Talks to Buy UK-Based Game Developer Rare

Los Angeles -- The Los Angeles Times reported on Wednesday that Microsoft
is currently in negotiations to acquire U.K.-based video game developer
Rare Ltd., which is 49 percent-owned by rival Nintendo. Rare is
responsible for creating titles including the upcoming "Starfox
Adventures" for GameCube, "Donkey Kong Country" and "Goldeneye 007" for
Nintendo 64 and classic titles like "R.C. Pro Am" and "Battletoads" for
the 8-bit NES console. The Times reported both Microsoft and Nintendo
declined to comment on the matter. The purchase would enable Microsoft to
develop versions of Rare games for its Xbox console, for which none
currently exist.

o RIAA, MPAA, NMPA Ask for Summary Judgment in Kazaa Copyright Case

Los Angeles -- The Recording Industry Association of America (RIAA),
Motion Picture Association of America (MPAA) and National Music Publishers
Association (NMPA) have filed a motion for summary judgment in their
copyright infringement case against file-sharing services Kazaa, Morpheus
and Grokster. "The defendants' principal defense that they have no ability
to control the network is belied by a myriad of facts, including the fact
that Kazaa demonstrated its ability to turn off the Morpheus system at
whim," the groups said in a joint statement. "This is Cybernetic
shoplifting. The Defendants have used the Internet to enrich themselves
and deprive creators and copyright holders of their right to be
compensated for their works," said MPAA vice president and director of
legal affairs Mark Litvack. For its part, Morpheus operator Streamcast
Networks filed its own motion for summary judgment in the case earlier
this week, asking for a ruling in its favor.

o Yahoo, ISPs Support Verizon In Dispute With RIAA Over File-Sharer

Washington -- Yahoo and a number of ISPs and groups including the Computer
and Communications Industry Association have filed a "friend of the court"
brief supporting Verizon's refusal to submit data on one of its Internet
access subscribers -- an alleged massive file-sharer -- after receiving a
subpoena for the data from the Recording Industry Association of America
(RIAA). The groups argue in their brief that the RIAA has overstepped the
bounds of the subpoena process outlined in the Digital Millennium
Copyright Act, and is asking Verizon to betray it's subscriber's privacy.
"What we hope to accomplish is to force the RIAA to follow established
legal procedures and due process," David McClure, president of the U.S.
Internet Industry Association, which organized the brief, told CNET
News.com. "The music industry pays the RIAA to investigate and prosecute
copyright infractions. They don't pay us a penny to do that. They don't
pay ISPs a penny to do that. Even if they did, it would be a violation of
due process and subscriber privacy."

(Denver) On Command, a provider of pay-per-view and video-on-demand
services to hoteliers, said on Wednesday that four movies -- "Monsters,
Inc.," "Lord of the Rings," "Black Hawk Down" and "Spider-Man" -- each
grossed over $1 million in fees this summer in hotels the company serves.
Denver-based On Command provides video delivery systems to 916,000 rooms
in over 3,000 hotels, including Four Seasons, Westin, Hilton and Holiday

(Miami) Game developer Interplay Entertainment said on Wednesday that it
has partnered with the maker of Bawls -- a high-caffeine soft drink -- to
provide product placement for the drink in its upcoming title "Run Like
Hell" for PlayStation 2. Irvine, Calif.-based Interplay will insert Bawls
vending machines and the drink itself into the game's action, while Bawls
will create limited edition bottle caps promoting the game and feature the
game in its television ads. Bawls has actively marketed to gamers,

services, said that BB Cable TV, a Japanese broadband TV service being
launched by Softbank Broadmedia Corp., will use its broadband TV
