o Report: Time Warner in Talks to Sell AOL Stake to Microsoft

Dulles, Va. -- In a deal that could potentially change the landscape for Internet service providers in the U.S., the New York Post reported on Thursday that software giant Microsoft is in "advanced" talks to acquire a stake in America Online from parent Time Warner, then combine it with its own MSN Internet offering. Citing two sources, the Post reported that Microsoft would pay an undetermined sum, leaving it and Time Warner as equal partners in the venture. A different source, however, told Reuters that the Post's report is "way overblown," adding that the two companies are discussing possible cooperation between their Internet search and advertising networks. The Post's sources said the deal potentially could be completed within the next several weeks. Time Warner has reportedly also had similar discussions with both Yahoo and Google, though Microsoft remains its preferred partner. Hurt by an exodus of dial-up subscribers fleeing to broadband providers, AOL has seen its customer base dwindle from 26 million to less than 22 million since 2003. Time Warner merged with AOL in 2000. In recent weeks, billionaire financier Carl Icahn has been in discussions with Time Warner regarding ways that the media company can increase shareholder value. Specific plans for AOL, however, had not been made public.

o U.K. to Fully Abandon Analog TV for Digital Broadcasting by 2012

London -- The U.K. government's Culture Secretary on Thursday announced official plans for a complete switchover to digital TV broadcasting in the country, which will begin in 2008 and is expected to be completed in 2012. Already, 63% of U.K. households have digital televisions, and 2 million have converted over the past year -- an increase of 18.4% over the previous year. "Digital television is no longer a probability, it is a certainty. And I believe it can leave us with a legacy of more choice, for more people, than anywhere else in the world," said Culture Secretary Tessa Jowell. The U.K. switchover plan will be funded through the government's BBC license fee charged to TV viewers, and provide financial aid and equipment installation for those who are elderly, disabled, or receiving some form of government financial aid. "Many of those yet to go digital are exactly the people that the State has a duty to protect -- the elderly, the disabled, the poorest," added Jowell. "They have in many cases the most to gain from a fully digital world. And we have to make sure they aren't left behind."

o Senate Shelves Digital TV Transition Legislation

Washington -- Legislation aimed at setting a hard deadline for the U.S. transition to digital television broadcasting -- seen as a means of freeing up spectrum space for emergency communications services -- has been shelved until at least late October, a Senate Commerce Committee spokesperson told CNET News.com. The Senate Budget Committee has postponed action on legislation related to the digital TV transition and other issues in light of Hurricane Katrina. Several lawmakers have previously pressed for a mandatory deadline of Jan. 1, 2009 for all broadcasters to abandon their analog signals and switch to digital, but have met opposition from technology and consumer groups who say the sets are too expensive for many, in addition to existing legislation that says 85% of consumers in a given market must own such sets before broadcasters may shut off their analog signals.

o Xbox 360 to Launch in U.S., Europe & Japan Before Holidays

Tokyo -- Microsoft announced on Thursday that its Xbox 360 next-generation video game console will go on sale on Nov. 22 in the U.S., Dec. 2 in Europe, and on Dec. 10 in Japan -- in time for the holiday shopping season in the three key world markets. The company will have a considerable head start on its competitors, as both Sony's PlayStation 3 and Nintendo's Revolution console aren't due for release until next spring. Microsoft also announced pricing for the Xbox 360 in Japan ($342); in the U.S., a basic version will sell for $299, while a premium model with a hard drive will cost $399. While 27 working titles for Xbox 360 will be on display at the Tokyo Game Show this weekend, between 25 and 40 titles are expected to be available for purchase at launch. Microsoft hopes to gain the same type of advantage that Sony garnered by releasing its PlayStation 2 ahead of the Xbox and GameCube; Sony has now sold 75.6 million PS2s worldwide, compared with 19.8 million Xbox consoles.

o RIAA Sends Cease-and-Desist Letters to 7 File-Sharing Firms

Los Angeles -- In the wake of a landmark Supreme Court ruling that found peer-to-peer software providers ultimately culpable for the copyright infringement committed by their users, the Recording Industry Association of America (RIAA) has sent cease-and-desist letters to seven file-sharing software firms, demanding that they stop "enabling and inducing" copyright infringement, The Wall Street Journal reported. The RIAA would not identify which companies received the letters, although The Journal reported that BearShare, WinMX and LimeWire were recipients. The Supreme Court ruling directly affected defendants Grokster and StreamCast Networks (Morpheus). Other big-name file-sharing firms include Kazaa, eDonkey and BitTorrent. "We demand that you immediately cease-and-desist from enabling and inducing the infringement of RIAA member sound recordings. If you wish to discuss pre-litigation resolution of these claims against you, please contact us immediately," reads a copy of the RIAA letter obtained by CNET News.com.

o Business Owner Sentenced for Selling Pirated Games, Modified XBoxes

Washington -- Biren Amin, the owner of Pandora's Cube, a major retailer of pirated games and illegally modified Microsoft Xboxes in the DC area, has been sentenced to five months in prison with three years of supervised release, including five months of home confinement, the DC-based Entertainment Software Association (ESA) said on Thursday. Amin was also fined $247,000 and ordered to complete 80 hours of community service as part of his sentence. "Sentences of this magnitude send a clear message to game retailers that selling pirate products has serious consequences," said Douglas Lowenstein, president of ESA, the trade association representing U.S. computer and video game publishers. Four employees from Pandora's Cube, which has locations in College Park, Springfield and White Marsh, have now been found guilty of conspiring to commit felony copyright infringement and conspiring to violate the Digital Millennium Copyright Act (DMCA). The employees modified Xbox consoles and turned them into what the store called "Super Xboxes," designed to defeat the Xbox's copyright protection system and permit the user to avoid paying for legitimate Xbox games. They also loaded illegal copies of video games onto the hard drives of the Super Xboxes.

o Napster Adds 53 Schools to University-Based Subscription Service

Los Angeles -- Napster announced on Thursday the addition of 53 new colleges to its university-based subscription service initiative. New additions include the University of California, which comprises 10 campuses including UCLA and UC Berkeley; Cal State University, which includes 23 campuses in cities like Northridge and San Luis Obispo; the University of North Carolina, a system of 16 schools including Chapel Hill, Greensboro and Charlotte; and standalone schools Brown University, American University, Bentley College and Grove City College. The company also signed deals with First Worthing Housing, which provides residential housing to students nationwide, and Spartan.net Housing at Michigan State. The campus service includes unlimited streaming and hard drive downloading from Napster's 1.5-million song library, and the ability to purchase permanent song downloads for 99 cents per song and albums starting at $6.95. Napster also said that some schools have implemented the service into curriculum offerings, citing as example an American popular music course at Penn State University.

o Online Gambling Software Firm CYOP Raises $15 Million

Beverly Hills, Calif. -- CYOP Systems, a provider of online gaming software and gambling portals, announced on Thursday that it has raised $15 million in financing from Cornell Capital Partners. The funding includes $650,000 plus a $15 million standby equity distribution agreement. California-based CYOP, which operates SkillArcade.com, TenSeatPoker.com and other gaming portals, said it will use the funds for global marketing and promotional efforts for its online games, as well as to increase direct sales efforts to promote its Internet poker licensed platform and online casino games to third parties. Yesterday, the company announced a deal with a Slovakian game developer to create online multiplayer versions of craps, roulette and other casino games.

o Sports Game Site PicksPal Launches with $2 Million in VC

Mountain View, Calif. -- Tom Jessiman, a former senior executive with CBS SportsLine.com, Sports.com and Ziff-Davis, said that he has launched PicksPal.com, a company offering free, weekly online games designed to test the knowledge of sports fans, backed by $2 million in venture capital from Canaan Partners. Site members compete for points -- no money is involved. They each begin the week with 1,000 points, and have the chance to earn more points by picking the outcomes of real sporting events based on real odds. The site said that it works like a live stock picking contest, except that it's based on the outcomes of sporting events. Winners are honored on the site. The company also said that Kenneth Dotson, the CMO of TicketsNow.com, has joined its board of directors. He is the former vice president of marketing for CBS SportsLine.com.

Acacia Research, which holds patents on digital media transmission and other technologies, announced on Thursday that it has licensed its interactive TV patent portfolio to Japan's Matsushita Electric (Panasonic). The patents cover receivers like set-top boxes and digital televisions that enable certain interactive TV features. Newport Beach, Calif.-based Acacia has successfully licensed its patents to a growing list of companies, including Disney, Sony and Playboy, and is also currently suing major cable and satellite TV providers including DirecTV and Comcast for patent infringement.
