o Report: New Microsoft Web Radio Service Skirts Copyright Law

Redmond, Wash. -- A controversial feature of Microsoft's new MSN Music store that reproduces the playlists of 978 popular radio stations with "fewer ads, no DJ chatter and less repetition" may run afoul of copyright laws, Wired News reported on Friday. The $4.99 per month Radio Plus service culls playlists of U.S. and Canadian stations and then attempts to re-create them from Microsoft's library of 500,000 licensed songs. It also uses the stations' actual call letters and nicknames (i.e. K-Earth 101), and in some cases even their slogans, such as "lite rock, less talk." "The use of station names is applied only to indicate the top artists on a station, and we believe it's simply a factual statement about the radio station, similar to many other public radio charts on the web," Microsoft said in a statement. Essentially, Microsoft argues that a radio station playlist is a "fact," which may not be protected with a copyright. "A lot of radio companies are extremely defensive about having someone else use something they consider to be their property," radio consultant Tommy Hadges told Wired News. "If I'm saying I'm Kiss FM and there's a Kiss FM that's trying to rip you off, perhaps there's a basis for a lawsuit there."

o Lucas: Piracy Fears Prompted Early Release of "Star Wars" DVD Trilogy

Los Angeles -- "Star Wars" creator George Lucas said in an interview with the Associated Press this week that fear of piracy was the main reason for the decision to release the original film trilogy on DVD this week, instead of following the release of the last film in the series, as was originally planned. "Star Wars: Episode III Revenge of the Sith" is slated for release in May 2005, while the DVD trilogy containing "A New Hope," "The Empire Strikes Back" and "Return of the Jedi" was released on Tuesday. "A lot of people are getting very worried about piracy. That has really eaten dramatically into the sales," Lucas told AP. "It really just came down to, there may not be a market when I wanted to bring it out, which was like, three years from now. So rather than just sit by and watch the whole thing fall apart, better to bring it out early and get it over with."

o Tiscali, CinemaNow Team Up on Video-on-Demand Website

London -- CinemaNow Inc., an Internet video-on-demand service, announced on Friday that it has entered into a partnership with Tiscali, an Italy-based Internet service provider (ISP), to offer videos-on-demand for Tiscali's broadband customers in Germany, Italy and the U.K. "Just as we did with our Music Club, Tiscali is stepping in the domain of legal online movie distribution throughout Europe," said Tiscali Vice President Mario Mariani. "Working with CinemaNow allows us to expand our content offerings and provides us with a technology solution that can manage the complexities of a video-on-demand service." As part of the agreement, CinemaNow will manage digital and territorial rights protection, user profiling, comprehensive pay-per-view and subscription services and detailed report generation, the companies said.

o French Aircraft Maker Airbus Trials Mobile Phone on Flight

Paris -- Airbus SAS, a France-based aircraft maker, announced on Friday that it has successfully completed the first in-flight trial of GSM mobile phones aboard an airplane, a move experts say could lead to passengers soon being able to use mobile phones in flight. "The tests are a major milestone in the offering by Airbus of personal mobile telephones aboard commercial aircraft from 2006," the company said in a statement. Airbus said trials aboard its A320 plane in which phones were used to send and receive both calls and texts showed that mobile phones could be used without interfering with navigation systems. PDAs and other wireless devices were also tested successfully, Airbus said.

(San Francisco) Following favorable court rulings saying that makers of peer-to-peer file-sharing software are not liable for potential copyright infringements committed by users of the software, Internet service provider EarthLink posted an internally-developed file-sharing program on a company research website this week, CNET News.com reported. A disclaimer on the site says that EarthLink advocates "in no way file sharing outside the boundary of fair use." The "SIPshare" application is meant to show how peer-to-peer technology may be used in Internet telephony and P2P video services. "EarthLink believes an open Internet is a good Internet," the site says. "An open Internet means users have full end-to-end connectivity to say to each other whatever it is they say -- be that voice, video, or other data exchanges -- without the help of mediating servers in the middle, whenever possible."

(London) Atlantic Records artists The Darkness have partnered with retailer Recordstore.co.uk to launch an online store to sell digital downloads of their songs, U.K. news site The Register reported. The album may be purchased in Windows Media format -- which won't play on Mac devices -- for about $11.56, which is about $1.80 more than what Apple's iTunes Store charges for the same album. Recordstore.co.uk is using digital distribution technology from DX3 (Digital Distribution Domain) for the service.

(Redmond, Wash.) Microsoft on Friday said that its newly launched MSN Music beta service will offer new and archival live performances from the Monterey Jazz Festival, which holds its 47th annual event this weekend. Under the agreement, MSN Music will offer six live performances from this year's festival -- from artists including the Don Byron Ivey-Divey Trio, the Terence Blanchard Sextet and the Bill Charlap Trio -- in addition to nearly a dozen more tracks from the festival's archives, for download and purchase from MSN Music.

(London) 3 UK, a mobile network operator based in the U.K., announced earlier this week that it has teamed up with National Rail Enquiries to provide users with train information on their video mobile phone. The new My Trains service is now live on the 3 video mobile network, the company said. (Redwood City, Calif.) Video game publisher Electronic Arts on Friday shipped its "The Sims 2" title to retailers. Developed at EA's Maxis studio, the title is a sequel to the top-selling PC game of all time, which has sold over 36 million units worldwide. The sequel features the addition of "genetics," with the DNA of Sims passed down through virtual generations. "For the first time, players will see emotions, live through life's most memorable moments and unleash their inner film-making capabilities, all in one game," said Lucy Bradshaw, executive producer for the game at Maxis.

(Edmonton, Alberta) Video game developer BioWare Corp. announced on Friday that it has licensed fellow developer Epic Games' Unreal Engine 3 game technology for use in an upcoming title. North Carolina-based Epic Games created the popular "Unreal" PC game, and the physics engine technology that powers the game has been used in Ubisoft's "Tom Clancy's Splinter Cell," Electronic Arts' "Harry Potter and the Sorcerer's Stone" and "America's Army: Operations" from the U.S. Army. Canada-based BioWare is responsible for "Baldur's Gate" and "Star Wars: Knights of the Old Republic," and said Epic's Unreal Engine 3 would be used in an as-yet unannounced title that will figure as its third original game.

(Tokyo) Chipmaker Intel and Japanese game developer Square Enix said on Friday that they have collaborated to enable Square Enix's graphics-intensive "Final Fantasy XI" title to be played on mainstream consumer PCs without the need of an external graphics card. Intel said the game will run efficiently on machines featuring its Intel 915G Express chipset, which contains integrated graphics technology, and is "a key component for volume mainstream PCs for the second half of 2004 and beyond."

(Espoo, Finland) Cell phone maker Nokia on Friday announced its "Connect to Art" program, a collaboration between the company and a number of audiovisual artists. Visual works will be downloadable to Nokia's 6600, 6620 and 7610 imaging smartphones; the company said the concept will also soon expand into music. The program will first launch in Nokia's native Finland, featuring three Finnish artists -- Stefan Lindfors, Osmo Rauhala and Kati Aberg -- whose works are currently available for free download.

(San Francisco) CNET News.com and MusicAlly both recently reported on talks being held between Microsoft and major record labels about the software company's support for CD copy-protection technologies in its upcoming "Longhorn" Windows operating system, the successor to Windows XP expected to come out in late 2006. The labels hope that Microsoft will integrate technology in its operating system that would recognize a copy-protected disc and prevent unauthorized uses, instead of current technologies that are relegated to software placed on the CD itself. A meeting planned for next week is expected to be the beginning of a long negotiation process between the two parties.
