o Consumer Electronics Industry Attacks Hollywood Over Copyright Issues

San Francisco -- The consumer electronics industry has asked Hollywood
copyright owners to work with, instead of against it in copyright matters,
as well as pleaded for policymakers to scrutinize copyright owners' claims
before placing impediments on technology in any new legislation. In a
speech delivered at a technology conference in San Francisco, Consumer
Electronics Association (CEA) CEO Gary Shapiro told an audience, "The
growth of reproduction, storage and transmission technology has terrified
copyright owners. The content community has gone on a scorched earth
campaign, attacking and burning several new recording and peer-to-peer
technologies… copyright owners have used the Congress, media and courts to
challenge the legality of technology and the morality and legality of
recording." Shapiro also attacked the copyright industry's labeling of
downloading of media off of the Internet as immoral, as well as statements
that copyright protection is paramount to the deployment of broadband

o Music Choice Petitions Copyright Office On Rulemaking Participation

Horsham, Penn. -- Music Choice, a provider of digital music radio
programming to satellite and cable TV operators, has filed a Petition for
Rulemaking with the U.S. Copyright Office. The petition requests that
Copyright Office rules be amended to allow for greater participation by
parties other than large copyright owners or technology companies in
determining matters such as the rate paid by webcasters to stream music
online. "Rate setting by the Library of Congress is an extremely
complicated and expensive process that limits the ability of smaller
entities to participate. The result is a closed process in which only the
largest stakeholders are fully able to participate in setting rates that
apply to all copyright owners and users... Only when rates are set in a
fair and transparent manner, with the opportunity for full participation
by all affected parties, will consumers and competitors alike be reassured
of their fairness and suitability," said Music Choice president and CEO
David Del Beccaro. Pennsylvania-based Music Choice said its recommended
changes to the rules are narrowly tailored to this objective.

o Vivendi Universal Secures $2.94 Billion Line of Credit
 
Paris -- Debt-ridden media conglomerate Vivendi Universal said on
Wednesday that it has secured a 3 billion euro ($2.94 billion) credit
line, allowing the firm to avoid a cash shortage as it sells assets. The
new line was secured from ABN Amro, BNP Paribas, CDC Ixis, Citigroup,
Credit Agricole Indosuez, Credit Lyonnais, Credit Suisse First Boston,
Natexis Banques Populaires, Royal Bank of Scotland, Societe Generale and
Sumitomo Mitsui Banking Corporation. The medium-term credit replaces a
1-billion-euro ($980 million) short-term loan granted in July. Vivendi,
which has about 19 billion euros ($18.3 million) of debt, risked running
out of cash by November without the new loan, analysts said.

o Copyright Office Asks for Comment on Webcast Recordkeeping Details

Washington -- The U.S. Copyright Office has asked for proposals from
copyright owners and users of webcasting statutory licenses on the
electronic format in which recordkeeping data must be maintained by the
services using the licenses, as well as possible delivery methods of the
data to SoundExchange, the officially designated receiving agent for
royalty fees. Many smaller webcasters have objected that the proposed
reporting requirements are too burdensome and that software to facilitate
sufficient reporting does not currently exist. Proposals must be received
by Sept. 30. The Copyright Office will also hold a status conference to
discuss the formatting requirements on Oct. 8 at the Library of Congress.

databases on entertainment, has signed an agreement with independent music
distributor Red Distribution. Under the terms, New York-based Muze can now
stream 30-second sound clips in advance of album release dates for all Red

(Redwood City, Calif.) Game developer Electronic Arts announced on
Wednesday that its Origin game studio is celebrating the fifth anniversary
of the launch of its Ultima Online massively multiplayer online
roleplaying game. To mark the event, Origin is offering discounts of the
latest version of UO and by unveiling a new U.S. shard, or area, within
the game. The game currently counts 225,000 paying subscribers in over 130
countries. Redwood City, Calif.-based Electronic Arts also separately

Driver" game for the Xbox will become the first published title from
Microsoft's Incubator Program when it reaches retail shelves later this

(London) Shazam, a provider of song identification services through mobile
phones, announced on Wednesday that it plans to launch its service,
already available in the U.K., in the U.S. as the next market.
London-based Shazam's service allows mobile phone users who wish to know
the artist and title of a particular song to dial a number, hold the phone
to a speaker, and then receive the information as a text message on their
phones. The company did not say which network operators it has partnered
with for a U.S. launch.

technologies, announced on Wednesday that it has developed a voice
recognition application for the MP3 player on PocketPC portable devices.
