o Movie Studios File Suit Against More DVD-Copying Software Distributors

New York -- Two major movie studios yesterday filed lawsuits against the makers and distributors of software that allows consumers to make perfect copies of DVD movies. Paramount Pictures and 20th Century Fox on Wednesday filed suit in federal court in Manhattan against Tritton Technologies, distributor of the CopyWare application, as well as QOJ, World Reach and Proto Ventures. The companies sell software they say allows consumers to make legal backup copies of their DVD movies. The studios argue that the software illegally circumvents the anti-copying technologies embedded on DVD movies -- a violation of the Digital Millennium Copyright Act. The lawsuit asks the court to halt sales of Tritton's and the other firms' software, and seeks unspecified monetary damages. The Motion Picture Association of America is also embroiled in a lawsuit against 321 Studios, makers of DVD X Copy, a similar DVD copying program that can currently be purchased at CompUSA.

o WSJ: Bertelsmann, Warner Still See Potential Music Merger

New York -- Negotiations between major record labels Warner Music and Bertelsmann Music Group (BMG), concerning a "last-ditch" effort to forge a merger of the two companies, resumed this week, The Wall Street Journal reported. AOL Time Warner had reportedly offered to form a 50-50 joint venture between Warner Music and BMG, excluding its music publishing unit from the deal. o Avid Gets $6.7 Million Digital Upgrade Contract With NBC

Tewksbury, Mass. -- Avid Technologies, a manufacturer of professional video editing equipment, announced a new $6.7 million contract with NBC, to replace several of the network's tape-based news production systems with its digital newsroom systems. NBC will begin the deployment of Massachusetts-based Avid's systems at its NBC News headquarters in New York, its MSNBC news operations center in New Jersey, and NBC Washington bureau.

o Music Retailer Trans World Acquires Rivals CD World, Wherehouse

Albany, N.Y. -- Trans World Entertainment, operator of music retail chain stores including FYE (For Your Entertainment), Coconuts and Strawberries, announced on Thursday that it has reached an agreement to acquire the assets of fellow retailer CD World for $1.8 million. CD World, currently operating in Ch. 11 bankruptcy, operates 13 locations in New Jersey and Missouri. Earlier this week, New York-based Trans World said it would purchase the assets of another bankrupt retailer, Wherehouse Entertainment, for $41 million. The deal brought Trans World a total of 148 new locations, 35 of which it said will be closed and liquidated.

o Vendare Group Acquires Vivendi's TrafficMarketplace Online Ad Network

Sherman Oaks, Calif. -- The Vendare Group, a provider of performance-based online marketing solutions, announced on Thursday that it has acquired Vivendi Universal's TrafficMarketplace, an online advertising distribution network. Financial details of the all-cash transaction were not disclosed. TrafficMarketplace's ad-targeting technology delivers advertisers' messages to more than 70 million unique users per month via its database of participating publishers. Sherman Oaks, Calif.-based Vendare Group in June also purchased Vivendi's Flipside, an network of online games sites offering cash prizes.

o RealNetworks, Fox Sports Team on College Football Webcasts

Seattle -- Media delivery technology provider RealNetworks announced on Thursday that it has partnered with Fox Sports to offer exclusive, live video webcasts of both out-of-market and non-televised college football games for the 2003 season. The games to be broadcast will be announced on a weekly basis, depending on Fox Sports Net's college football television broadcast schedule. Out-of-market games will be available to subscribers to RealNetworks' RealOne SuperPass service for an additional $9.95 per month; the weekly Internet-only pay-per-view game (FOX Sports Game of the Week) will be offered for free to SuperPass subscribers, or else for $14.95 per game to non-subscribers.

(Madrid) Seeking to expand into Europe, Overture Services announced that it has launched pay-for-performance Internet search services in Spain. Once established, Overture Spain estimates that it will reach about 71% of Spain's Internet users, or more than 14 million people. The Pasadena, Calif.-based company also plans to set up operations in Austria, Switzerland and the Nordic countries by year's end.

(New York) MLB.com, the website for Major League Baseball, said on Thursday that it will offer subscribers to its MLB.TV service the ability to simultaneously watch two live, out-of-market game webcasts involving a pennant race each day for the rest of the regular season. The MLB.TV Double Play service will let viewers navigate between two games displayed side-by-side in separate media player windows.

(San Francisco) Faith West, a distributor of wireless entertainment content under the Modtones brand, announced on Thursday the release of new "musical animations," available for download by subscribers of Verizon Wireless' Get It Now service. The animations, released in Faith West's proprietary CMX format, will offer music combined with animations created by Shepard Fairey, Greg "Peanut" Galinsky, Ruby Gloom and French Kitty. The release also includes what Faith West claims is the first music video for mobile phones, "In the Waiting Line" by Quango/Palm recording artist Zero 7.

(Redwood City, Calif.) Game developer Electronic Arts announced that it will postpone the release of its "James Bond 007: Everything or Nothing" title until 2004, citing the need for additional development time for the game. EA also announced that recording artist Mya, who performs the "Everything or Nothing" title song for the movie's soundtrack, will now appear in the game as well. Separately, Redwood City, Calif.-based Electronic Arts announced the release of "Disney's Party" for Nintendo GameCube and Game Boy Advance, created in conjunction with Disney Interactive, a publishing label of Buena Vista Games. The title was developed by Japanese firm Hudson Soft.

(Redmond, Wash.) Microsoft Game Studios has announced a development deal with North Carolina-based Epic Games, creator of the "Unreal" multiplayer title and game engine technology. Under the terms, Epic's Scion Studios will develop several new titles to be published for Microsoft Xbox and the Windows PC platform.

(New York) AtomTelevision, a cable television channel joint venture between short films distributor AtomFilms and Global Media Holdings, announced on Thursday that Altrio Communications has launched AtomTelevision content on the company's video-on-demand service. Altrio provides bundled high-speed Internet access, local and long-distance telephone service, and television and video-on-demand services in the Los Angeles area, including the cities of Pasadena, Arcadia and Monrovia.

(Los Angeles) Cell phone maker Nokia said on Thursday that it will offer owners of its phones with multimedia messaging service (MMS) the option to receive pictures snapped by photographers equipped with Nokia 3650 camera phones on the red carpet at the Emmy Awards this Sunday. The service will be available to Nokia owners subscribed to carriers AT&T Wireless or T-Mobile.

(San Francisco) CNET News.com recently featured an interview with Recording Industry of America (RIAA) president Cary Sherman, on the topic of the group's recent filing of 261 lawsuits against individuals who traded music on file-sharing services. Sherman discusses the public relations backlash resulting from the legal campaign, why the group didn't first investigate those whom it had subpoenaed, and the likelihood of additional suits being filed against file-swappers. "We'll be filing another round of lawsuits next month," Sherman told News.com. "The idea is to keep the lawsuits coming in order to reinforce the message that we are serious about changing people's behavior, and that they should not engage in the illegal activity. If people thought this was a one-time thing, the deterrent impact would be lost. So we feel like we have to go forward with additional lawsuits, and we intend to do so."

(New York) The New York Times on Thursday published an interview with about 50 students at a middle school outside San Francisco, on the topic of music downloading, including their reactions to the recent lawsuits filed against individual song-swappers, and the steps some students and their parents have taken to discuss the issue. "If you're not selling it [downloaded music], why is it wrong?" asked 13-year-old Korbi Blanchard. "If it's something for personal use, as long as you're not redistributing it, it should be O.K." "They're [musicians] not losing money, because we still buy the T-shirts and go to their concerts," said fellow classmate Sonya Arndt. "They're still famous."
