o Tauzin Bill Would Mandate Digital TV, Broadcast Flag by 2006

Washington -- U.S. House Energy and Commerce Committee chairman Rep. Billy
Tauzin (R-La.) has introduced draft legislation that would create a solid
deadline of January 2006 for TV broadcasters to be required to begin
broadcasting digitally. Among other things, the draft legislation mandates
that a "broadcast flag" be inserted into programming to prevent piracy,
and that manufactures of TVs, DVD players, digital video recorders and
other devices include technology that disables the recording and
retransmission of certain programs containing the flag. The legislation
would also direct the Federal Communications Commission to provide for the
termination of televisions with analog outputs -- which enable recording
of any signal, regardless of anti-piracy technologies -- be discontinued
entirely by July 2005. "The lack of progress in private inter-industry
negotiations and the number of outstanding FCC rulemakings has led to
uncertainty in the marketplace and makes it very difficult for businesses
to make solid plans for the future," Tauzin said in a statement. Consumer
advocacy group DigitalConsumer.org opposed the draft legislation. "The
bill is Hollings for TV -- it is based on a principle with which we
disagree -- that the federal government should mandate and perennially
regulate the development, feature set, and behavior of millions of
consumer electronics devices and will be controlling the future
development of a wide variety of technologies," the group said in a
statement.

o Directors Guild Denounces Movie "Sanitizing" Software

New York -- The New York Times reported on Thursday on a feud between the
Directors Guild of America (DGA) and a group of software developers who
have created technology that can "sanitize" movies by deleting swearing,
sexual or violent content. Several Utah-based companies, including Trilogy
Studios, Clear Play and Family Shield Technologies, are offering software
that can screen out offensive content; others are simply editing the films
and selling the resulting versions in small video store chains. Last month
Clean Flicks, one such chain selling sanitized videos, sued a number of
directors asking a court to declare its practice legal. The DGA is
expected to file counterclaims this week. "This is very dangerous, what's
happening here," Jay D. Roth, national executive director of the Directors
Guild of America, told The Times. "This is not about an artist getting
upset because someone dares to tamper with their masterpiece. This is
fundamentally about artistic and creative rights and whether someone has
the right to take an artist's work, change it and then sell it."

o XML Content Publishing Software Firm Xyleme Raises $10.8 Million

Paris -- Xyleme, a provider of XML content technology to the news and
publishing industries, announced that it has raised $10.8 million in its
second round of venture capital financing. Deutsche Bank led the
investment round; previous investors Societe Generale Asset Management,
Vivendi Universal's Viventures and Credit Mutuel du Nord also
participated. Paris-based Xyleme's customers currently include French
media group Le Monde Group, business publisher Le Group Moniteur and
Agence France Presse. Xyleme will use the funds to expand its sales and
marketing initiatives and to move into the U.K. and U.S. markets.

o Sony Announces 40 Million PlayStation 2 Consoles Shipped Globally

Tokyo -- Sony Computer Entertainment announced on Thursday that it has
shipped over 40 million of its PlayStation 2 video game consoles
worldwide. The company said 10.97 million of the units were shipped to
Japan, 17.01 million to the U.S. and 12.06 million were shipped to Europe.
In May, Sony announced it had passed the 30 million units shipped mark.
The company recently began selling a network adapter for the console that
lets players challenge one another in certain games over the Internet.

o Wireless Marketing Software Firm M-Qube Raises $6.9 Million

Boston -- M-Qube, a developer of software that enables marketing,
promotions and advertising campaigns over wireless networks to cell
phones, announced that it has raised
$6.9 million in its first round of funding. Bain Capital and General
Catalyst Partners led the investment round, which also included
participation from M-Qube employees. Boston-based M-Qube said its software
lets marketers design, target, test, execute and view reporting on
permission-based mobile marketing campaigns sent to consumers using any
mobile device. The company is demonstrating its technology this week at
the DEMOmobile conference in La Jolla, Calif.

worldwide licensing agreement with Marvel Enterprises -- creator of the
"Spider-Man" and "X-Men" comics -- granting it the right to create
massively multiplayer online games based on Marvel's roster of
superheroes. The agreement includes the rights to create versions of
titles in multiple languages across all existing and future online game
platforms, including PCs and console-based systems. The first title will
begin development at Vivendi Universal Games for release in 2005.

(Las Vegas) Broadband Wireless International, a provider of branded

(Seattle) RealNetworks announced on Thursday that it has signed an
expanded agreement with America Online to allow the Internet access
service to offer RealNetworks' interactive marketing campaigns and
streaming video advertisements to advertisers on its service. Terms of the
agreement were not disclosed. As part of the agreement, AOL will be
distributing a player update with its new version AOL 8.0 this fall to

(Paris) Video game publisher Ubi Soft Entertainment announced on Thursday
that it has partnered with Sony Online Entertainment to create and operate
a Chinese version of Sony's "EverQuest" massively multiplayer online game.
Paris-based Ubi Soft's online arm, Ubi.com, will provide the necessary
local infrastructures to host and operate the game, scheduled to launch at
the beginning of 2003. The two companies also said they are developing a
localized European version of the game -- "EverQuest: Renaissance" -- in
English, French and German languages for release in the fall.

(Tokyo) Game developer Bam Entertainment announced on Thursday it has
partnered with Japanese developer Cavia to create games for
next-generation consoles. Cavia is a joint venture between Tokuma Shoten
Publishing, Nippon Television Network Corp., Tohokushinsha Film Corp.,
Tokyo FM Broadcasting, Mitsubishi and Amuse Capital, and is led by former
Sega president Hayao Nakayama. The company has created titles including

Entertainment said the first jointly-published title will be released in
September 2003.
