o Napster Appeal Denied by Ninth Circuit

San Francisco -- Napster has lost its appeal to set aside a ruling by U.S.
District Court Judge Marilyn Hall Patel, who ordered the company's
file-sharing service offline until its filters could block 100 percent of
copyrighted songs. The Ninth Circuit Court of Appeals on Tuesday ruled
against Napster and said that no further filings should be made to the
court unless it requests them. Napster voluntarily took its service
offline on July 2nd, before the ruling in question was delivered. Judge
Patel will next consider the recording industry's request for a summary
judgment against Napster that it is contributing copyright infringement,
in which case the trial would proceed directly to determining monetary
damages Napster would pay record labels. The summary judgment hearing is
scheduled for October 10.

o Hacker Breaks Into Yahoo News Site, Changes Story

Santa Clara, Calif. -- Yahoo has confirmed that a Reuters story carried on
its news site was hacked into and its contents altered, CNET reported on
Thursday. The break-in was originally reported on SecurityFocus.com, which
said that the hacker, Adrian Lamo, was attempting to bring to light holes
in Yahoo's security. Lamo said that he altered a number of stories over
the course of three weeks, but Yahoo's admission relates to a news report
on Russian programmer Dmitry Sklyarov. Lamo has used similar tactics to
show weaknesses in AOL's Instant Messenger and technology used by
Excite@Home. Yahoo has not yet said whether or not it will charge Lamo.

o Australian Firm Wins 'Net Defamation Case Against Dow Jones

Canberra, Australia -- An Australian mining company has won a defamation
case filed against Wall Street Journal publisher Dow Jones over an article
defaming the company that was published on the Internet in the U.S., the
Associated Press reported on Thursday. Dow Jones today appealed the
ruling, in a case could have significant implications if foreign countries
are allowed to sue for defamation related to articles published on the Web
from the U.S. "We filed an appeal on Tuesday on a case that could have
major impact in the way media companies operate throughout the world,"
said Steven Goldstein, vice president of corporate communications for Dow
Jones. "We do not believe that Australia is an appropriate venue for a
case involving a story that was published in New York."

o "Sex" Bumped from Top Search Term as Users Seek Out News

Palo Alto, Calif. -- The word "sex" fell from the list of
most-searched-for terms on search engines last week, as Web users instead
sought news and information related to the terrorist attacks on the United
States, Reuters reported. AltaVista spokesman David Emanuel noted that
"popular search terms last week turned almost exclusively to
disaster-related information," adding that "sex" dropped to No. 17 on
AltaVista's list. Google reported its top search terms from last week
included Nostradamus, World Trade Center, CNN, Osama bin Laden, American
Flag and American Airlines.

o Disney Forms Buena Vista Game Entertainment Studio, Names President

Los Angeles -- The Walt Disney Company announced on Thursday the formation
of a new video game development unit, Buena Vista Game Entertainment
Studio (BVGES). Current Disney Interactive president Jan E. Smith will
assume the additional role of president of BVGES. Disney said the new
division will "combine new and emerging technologies, such as broadband
and wireless, with video consoles, PCs, other technological innovations,
and online games." BVGES will develop titles based on Disney's movies and
other media holdings as well as its family of brands.

o Wireless Content Device Maker SimpleDevices Raises $5 Million

La Jolla, Calif. -- SimpleDevices, a developer of consumer electronics
products that can wirelessly stream content either from a home PC or
directly off the Internet, has raised $5 million from Motorola and Proxim
as part of its second round of funding, VentureWire reported on Thursday.
The company plans to close the expected $12 million round in November. La
Jolla-based SimpleDevices markets products such as a wireless digital
audio receiver for cars, a device that includes a hard drive placed in the
trunk to store media files that can be wirelessly streamed to the car from
a home PC. The company plans to use the funds for research and
development, sales and expansion.

o Rich Media Software Firm Digital Lava Selling Assets, Shutting Down

Marina del Rey, Calif. -- Digital Lava, a provider of rich media software,
announced on Thursday that it plans to sell its assets to New York-based
Interactive Video Technologies for $700,000. If the liquidation plan is
approved, Digital Lava will then pays off its debt, return the remaining
funds to its stockholders and cease operations. "Given our financial
position and inability to secure additional funding, we are pleased to
have entered into this agreement with IVT,'' said Digital Lava CEO Bob
Greene. The Marina del Rey-based firm provides software that can stream
video and audio with other synchronized text, graphics, animation and Web
links.
