o Authors Guild Sues Google for
"Massive Copyright Infringement"
New York -- The Authors Guild, a trade union for published
authors, announced on Wednesday that it has filed suit against
search engine firm Google in federal court, claiming the company's
Google Library program that scans books into its index amounts to
"massive copyright infringement." The Google Library program aims to
scan the text of thousands of books in the public domain into its
index, so that users may read them for free online; the company has
also partnered with numerous libraries to scan their texts, offering
restricted page viewing and prohibiting printed copies from being
made. After initial criticism from some publishers, Google now
allows them to opt out if they choose not to have their works
indexed. "This is a plain and brazen violation of copyright law,"
said Authors Guild president Nick Taylor. "It's not up to Google or
anyone other than the authors, the rightful owners of these
copyrights, to decide whether and how their works will be copied."
The lawsuit, which seeks damages and an injunction to halt further
infringements, was filed on behalf of authors Herbert Mitgang, Betty
Miles and Daniel Hoffman -- who were not consulted by Google before
their works were included in the Google Library project by the
University of Michigan's library. "We regret that this group has
chosen litigation to try to stop a program that will make books and
the information within them more discoverable to the world," Google
said in a statement.

Would Compete with Yahoo, Google in Portal Space
Dulles, Va. -- Time Warner CEO Richard Parsons on Wednesday
sidestepped questions about the potential sale of its America Online
unit, instead telling an audience of investors that turning around
the company's struggling Internet arm is the key to increasing
shareholder value. While Parsons admitted that Time Warner has
entertained the notion of spinning off AOL, he downplayed the
possibility and called AOL the company's "No. 1 point of focus"
because of its strong growth potential, Dow Jones Newswires
reported. Parsons declined to discuss reports that software giant
Microsoft is in talks to buy a major stake in AOL. Parsons said that
plans for AOL include transforming it from an ISP into a major web
portal that would compete against the likes of Google and Yahoo.

o Verizon Signs
Disney Channels for FiOS TV; Deal With News Corp. Close
New York -- Verizon announced on Wednesday that it has signed a
long-term programming agreement with Disney, to carry 12 of the
company's television networks on its FiOS TV fiber optic-based TV
service. Verizon will offer channels including ABC News Now, Disney
Channel, ESPN, Toon Disney and a video-on-demand package with a
range of different content when FiOS TV becomes available to 3
million homes this year. As part of the deal, Verizon agreed to
track subscribers allegedly engaged in copyright infringement of
Disney works, and forward notices sent to them to Disney that do not
identify the subscriber; the company also agreed to provide
subscriber information pursuant to a subpoena, and also terminate
Verizon accounts for subscribers "who have infringed Disney
copyrights and received multiple notices." Verizon recently launched
a pilot of its FiOS TV service in Keller, Texas. Reuters also
reported on Wednesday that News Corp. CEO Rupert Murdoch says his
company is close to signing a deal with Verizon that would bring
channels including Fox, FX and Fox News to FiOS TV.

Content Firm Jamster to Fight U.K. TV Commercial Restrictions
London -- Mobile entertainment distributor Jamster, a unit of
VeriSign, said on Wednesday that it plans to contest a recent ruling
from the U.K. Advertising Standards Authority Council, stating that
the company's ads appeal to children and should be restricted to
broadcast only after 9 P.M. "In particular, the ASA fails to
adequately consider the well-established fact that the overwhelming
majority of Jamster's customers are above age 16 or the protective
measures that Jamster has exercised as part of its advertising,
including a specific '16-and-over' callout button," the company said
in a statement. Jamster cited an ICM Research study that found the
mean age of its customers to be 32, and that just 1.6% of its
customers were under the age of 16. The company's "Crazy Frog"
animated character and ringtone was the first to cross over and
become the top-selling overall U.K. music single, bettering Oasis
and Coldplay. It also recently partnered with MTV on mobile
entertainment initiatives. "Jamster intends to pursue all legal
means to overturn the ASA's unjust and unfounded decision about its
past advertisements," the company said.

Nike Tightly Integrate Shoe Product Placement In "NBA 2K6"
New York -- 2K Sports, a unit of game publisher Take-Two
Interactive, announced on Wednesday that it has partnered with Nike
to tightly integrate Nike basketball shoe branding and product
placement its "NBA 2K6" video game. For instance, the game's
Streetball Mode will award a new pair of Nike basketball shoes as
players advance levels. Players will be able to use the same Nike iD
shoe customization feature available on the company's website for
Nike shoe buyers to customize the virtual rewards. 2K Sports will
also offer secret codes throughout the upcoming NBA season, which
will unlock newly released Nike signature shoes in the game. The
title will also integrate "performance attributes associated with
specific footwear models," and over 200 Nike-sponsored athletes will
be wearing their actual Nike models within the game. "NBA 2K6" is
slated for release in the fall for PlayStation 2, Xbox and Xbox 360.

Game Publisher InfraWorlds Acquires Mobile Digital Media
Paris -- Following on its acquisition of U.S. mobile game
publisher 995 Soft in July, French mobile game publisher InfraWorlds
announced on Wednesday that it has acquired Mobile Digital Media (MDM),
a Mountain View, Calif.-based publisher of mobile device software.
Financial terms of the deal were not disclosed. MDM has published
memory card and CD-ROM mobile games based on titles from Electronic
Arts, Atari and Microsoft, in addition to dictionaries, bibles and
encyclopedias for mobile phones. InfraWorlds said the purchase will
strengthen its entertainment catalog and provide it with new
expertise in the retail distribution of mobile device content.

Infineon to Offload Loss-Making Memory Chips Unit
Frankfurt -- According to a report in German news daily
Handelsblatt, Infineon, the largest semiconductor maker in Europe,
is planning to offload its loss-making memory chips division by
year's end. The company's memory chips have been used in Microsoft's
Xbox 360 and other consumer electronics. Quoting unnamed sources
familiar with the situation, Handelsblatt said that a supervisory
board meeting on Nov. 17 would approve a proposal to sell the
division. What's more, the report said Infineon Chairman Wolfgang
Ziebart has been planning the move since he took the company's reins
more than a year ago. Ziebart reportedly sees more opportunities for
Infineon's other semiconductors division for the automotive and
telecommunications industries because the memory-chip unit is
subject to large sales and earnings swings depending on the
vicissitudes of the market. Infineon has declined to comment on the
report.

announced that Sony Europe President Chris Deering has decided to
resign after just 18 months on the job. Sony said Deering would be
replaced by Fujio Nishida -- currently in charge of Electronics
Marketing at Sony Tokyo -- on Nov. 1. Sony said Deering and Nishida
would work closely together to ensure a smooth transition, after
which Deering will continue to work with the company as a
consultant. Sony did not give specific reasons for Deering's
decision to step down, saying only that he resigned to pursue
"personal opportunities in the U.S.", where his family now resides.

(New York) Clear Channel Radio's online music and radio unit
announced on Wednesday that it has named Ronning Lipset Radio as its
exclusive, national third-party ad sales firm for its online
properties. New York-based Ronning Lipset also provides third-party
ad sales for the AOL Radio Network, Yahoo Music's LAUNCHcast, Live
365 and Microsoft's MSN Radio. The company will sell national ads
for Clear Channel's network of 1,200 radio station websites, which
claimed 850,000 unique visitors in July, according to Arbitron/comScore.
"The market has been eagerly awaiting a traditional radio company to
jump into the online radio space with both feet," said Ronning
Lipset managing partner Andy Lipset. "Clear Channel's innovative

announced the development of a 30GB, dual-layer HD DVD disc, which
doubles the capacity of its previously announced 15GB disc for the

announced on Wednesday that there are now over 500 AM and FM radio
stations in the U.S. broadcasting with
its technology that allows them to transmit a digital signal
alongside their traditional analog signals. The company additionally
said that several of the largest broadcast firms have also launched
multicast channels, adding brand extension channels in other formats
like dance music or local music. "This has been a breakthrough year
in the rollout of HD Radio technology. Broadcasters are converting
stations at a pace of more than one per day as they ramp up efforts
to market and promote the technology to consumers," said iBiquity
president and CEO Robert Struble, adding, "the emergence of
multicasting as the system's first killer application has been
critically important."

(San Diego) Veoh Networks on Wednesday announced the launch of a
beta test of its software that lets video content producers publish
full-screen video to a peer-to-peer network. Veoh 1.0 Beta allows
only producers of amateur or other approved video content to post to
the network, and also enables them to integrate publishing of their
works with Google Video and RSS. Users who have downloaded the
software may then search out, download and view content available on
Veoh's peer-to-peer network. The San Diego-based company raised an
undisclosed sum in a first round of venture capital financing in
August, led by Shelter Capital Partners. Veoh says its Internet TV "peercasting"
network is not hampered by the financial, geographical or regulatory

announced on Wednesday that it has signed an agreement with UFO
Moviez for the sale and installation of 500 digital cinema
projectors in India. U.K.-based DPI said that 65 projectors have
