o U.S. Senate Panel Votes Against Hard Deadline for Digital TV Transition

Washington -- The U.S. Senate Commerce Committee on Wednesday voted to reject a proposal from committee chairman Sen. John McCain (R-Ariz.), which would have mandated a nationwide transition to digital broadcasting of TV signals by 2009. The panel did approve almost $1 billion in funding that would be used for the purchase of low-cost receivers for low-income TV viewers, but some analysts said the lack of a hard deadline may postpone the digital TV transition indefinitely. The current rules state that 85% of a market must have the equipment to receive digital signals before broadcasters can be forced to abandon their analog broadcasts and upgrade to digital. Lawmakers then hope to sell off the freed spectrum to pay for low-cost receivers, as well as provide some of it to emergency communications services, which were hampered during 9/11 terrorist attacks.

o U.S. House Passes Bills on Video Voyeurism, Counterfeit Media Labels

Washington -- The U.S. House on Tuesday approved a bill that will criminalize "video voyeurism," or the practice of placing hidden cameras to capture the "private areas" of unsuspecting persons on video. "With the development of smaller cameras and the instantaneous distribution capability of the Internet, the issue of video voyeurism is a huge privacy concern," said House Judiciary chairman James Sensenbrenner (R-Wisc.). The penalties include fines of up to $100,000 and up to a year in prison. A similar bill already won approval in the Senate. The House also passed a bill that will criminalize the sale of "counterfeit labels" on DVDs, CDs or computer applications.

o Report: Portable MP3 Player Market to Hit $58 Billion by 2008

Framingham, Mass. -- The market for portable MP3 players like Apple's iPod is expected to leap to nearly $58 billion by 2008, fueled by falling price points, the availability of legitimate downloads and subscription services, and integration of MP3 support in DVD players and gaming devices, according to a report from Massachusetts-based research firm IDC. The sector is projected to experience a five-year compound annual growth rate of 20%. IDC reports that over 12.5 million flash memory-based players were sold in 2003, a number expected to grow to 50 million by 2008 as flash memory costs fall. "New opportunities abound for chip vendors, device manufacturers and paid music service providers to guide mainstream music consumers into this rapidly evolving market," said IDC senior analyst Susan Kevorkian.

o Sony to Pay $82 Million in Immersion Corp. Patent Infringement Ruling

San Jose, Calif. -- A jury has ruled that Sony's PlayStation 2 video game console infringes on patents on "force-feedback joysticks" owned by San Jose, Calif.-based Immersion, and ordered Sony to pay $82 million in damages. The judge in the case has not yet entered a judgment, though, and Sony is expected to file a range of post-trial motions, Immersion said. Sony said in a statement that it plans to appeal the jury's findings. Immersion has also won licenses of its haptic technology, which causes game controllers to shudder in players' hands in sync with game action, from Microsoft, Logitech and Kensington.

o Report: World Video Game Market Revenue to Hit $41.4 Billion in 2009

San Diego -- The world market for PC and video game hardware and software is expected to increase from $23.2 billion in 2003 to $31.6 million in 2009, according to a report from San Diego-based market research firm DFC Intelligence. When combined with DFC's projection of a $9.8 billion online games market in 2009, total world interactive entertainment revenue for 2009 is predicted to reach $41.4 billion. The report is a scenario based on Microsoft launching a next-generation console gaming system one year before Sony and Nintendo. It also takes into account new entries into the handheld market in the form of Nintendo's DS and Sony's PSP, which are expected to drive sales in the portable game market from $3.9 billion in 2003 to $11.1 billion in 2007.

o Bankrupt Cable TV Firm Adelphia Launches Sale Process

Greenwood Village, Colo. -- Adelphia Communications, the cable TV operator that filed for bankruptcy following a fraud scandal implicating its founding Rigas family, announced on Wednesday that it has launched a sale process for the company as part of its Chapter 11 proceedings. Interested parties, who are reported to include Comcast, Time Warner and Charter, will be able to bid on seven regional cable system clusters including Northern New England/Eastern New York; Cleveland/Greater Ohio Valley; Florida/Southeast; California/Western; Virginia/Maryland/Colorado Springs/Kentucky; Pennsylvania; and Western New York & Connecticut. The company has set a price of between $17 and $20 billion for the entire company, but analysts have said it is more likely the company will be sold in parts.

o Report: Warner Licenses Films to Netflix for Potential TiVo VOD Service

San Francisco -- Movie studio Warner Bros. has licensed a selection of films to online DVD rental service Netflix as part of a test of a planned Netflix video-on-demand service, CNET News.com reported, citing sources familiar with the plan. Although Netflix denied any relationship with Warner for video-on-demand, News.com previously reported that Netflix and TiVo are collaborating on a service that would allow users to download movies from Netflix that could then be delivered to a TiVo box and viewed on a television. o Gov. Schwarzenegger Prohibits Use of Calif. State PCs for File-Sharing

Sacramento, Calif. -- California Gov. Arnold Schwarzenegger has signed an executive order prohibiting the use of state resources to illegally download copyrighted material. Schwarzenegger charged the state's chief information officer with the development of a statewide policy regarding the use of peer-to-peer file-sharing programs on state computers, which will apply to all state agencies, departments, boards, commissions and offices of the executive branch. "So many of the entertainment industry's talented musicians, actors, writers and programmers devote their careers to creating products that enrich our society," said Schwarzenegger. "Today California is taking a stand against use of state resources for illegal downloading of this material and standing in support of the work of these talented Californians."

o Independent Music Digital Retailer eMusic Re-launches MP3 Service

New York -- Independent music service eMusic on Wednesday debuted a new version of its service that offers over 500,000 tracks in MP3 format, as well as editorial content from renowned music writers including Rolling Stone's Michael Azerrad. The site offers tracks from independent record labels that fall into the "indie rock" genre, as well as a large selection of tracks from jazz and classical labels. The re-launched service offers new community features, as well as live tracks recorded at clubs that are part of eMusic parent company Dimensional Associates' Digital Club Network. The eMusic subscription service offers 40 songs a month for $10; 65 songs a month for $15; and 90 songs for $20 a month.

(Los Angeles) Gemstar-TV Guide International, a provider of electronic program guides for digital TV services, announced on Wednesday that consumer electronics firm Hitachi America has signed a multi-year licensing agreement to use Gemstar's program guides in its digital televisions sold in North America. Last week, Gemstar announced similar license agreements with Sony and Panasonic.

(Salt Lake City) U.S. Digital Television (USDTV), the first "over-the-air" digital subscription cable TV service in the U.S., announced on Wednesday that it has surpassed 10,000 subscribers. The company offers a low-cost alternative to cable TV that includes many "basic cable" channels to subscribers in Salt Lake City, Albuquerque and Las Vegas. The receiver needed to receive USDTV's signals is sold at Wal-Mart stores.

(Buena Park, Calif.) Hyun Won America, the U.S. unit of the Korean consumer electronics firm, on Wednesday officially entered the U.S. market with the launch of its DAH-1000 and DAH-1200 MP3 players. The flash memory-based devices, which range in price from $99 to $209 with a top capacity of 512MB, feature a sonic lyric viewer that can display song lyrics in synchronization with the track, as well as direct MP3 recording from any source.

Digital audio device manufacturer iRiver on Wednesday introduced its H300 series of portable media players, which in addition to playing music feature a color display for viewing photos. Both the $329 20GB model and $429 40GB model support Microsoft Windows Media 10 and secure portable device services such as Napster To Go. The devices will be sold online and at Best Buy stores in October.

Spoken word audio provider Audible on Wednesday announced a partnership with wireless carrier Sprint that will enable users of select Sprint PCS Vision Smart Devices to play back audiobooks and other Audible content. (Santa Monica, Calif.) Video game publisher Activision announced on Wednesday that it will release a version of its "Spider-Man 2" game as a launch title for Nintendo's DS handheld. The DS version will be developed by New York-based Vicarious Visions. Separately, Santa Monica, Calif.-based Activision said that it shipped its "Rome: Total War" PC game to retailers. The title is the latest installment in U.K.-based developer Creative Assembly's "Total War" series.

(Sarasota, Fla.) Infinium Labs, developer of the Phantom PC-based broadband video gaming console, said on Wednesday that over 20 game publishers have signed on to supply more than 500 titles to the company's game subscription service. Publishers will include Vivendi Universal Games, Atari, Eidos, Kuma Reality Games and Codemasters. Florida-based Infinium is expected to launch the Phantom service in the fourth quarter of 2004.

(San Francisco) Downhill Battle, the website that hosted the "Grey Tuesday" protest that offered downloads of a banned Danger Mouse/Jay-Z remix album, has launched another online protest against a recent 6th U.S. Circuit Court of Appeals controversial ruling on music sampling, Wired News reported. The ruling stated that the rap group NWA should have licensed a 1.5-second sample of a Funkadelic song used in one of its tracks, even through it had been altered to the point it was not easily recognizable as the original. The protest encourages people to submit 30-second songs created from the 1.5-second sample in question. "It's becoming impossible for any producer -- even the wealthiest producers like Puff Daddy -- to make collage, sample-based music," Downhill Battle's Nicholas Reville told Wired News. "Albums like the Beastie Boys' Paul's Boutique would be totally impossible to make now."
